RE: DECLARATION OF IDAHO HUMAN RIGHTS DAY
Mayor Boyle issued a proclamation for Martin Luther King Jr. - Idaho
Human Rights Day. This has been designated as a holiday for city
employees. He stated that we need to promote Human & Civil Rights and
treat fairly the minorities.
RE: DISCUSSION OF BUYING A NEW GARBAGE TRUCK
The mayor stated that we need to buy a new garbage truck. We have been
getting some information on a truck that empties containers automatic.
In checking with Rigby and Shelly they both like this system. They run
the truck with one less man. The containers will cost about $90.
Farrell Young ask who would buy them. The mayor said he thought the
city would have to buy them. If we saved one man's salary we would pay
for the containers. Farrell Davidson said it is much faster and in the
cold weather, you don't have a man riding on the back of the truck.
One truck would be able to pick up the whole city. We could get a
mutual aid agreement with some of the surrounding cities in case our
truck breaks down or we could lease a truck. The containers have
rollers on so they can be rolled back and forth. They mayor told the
council that we need to decide this month.
RE: REQUEST FROM THE WILLMORE'S FOR A LIMITED COMMERCIAL USE PERMIT
7:30 A.M. a Public Hearing was held. Berkley and Janet Willmore have
requested that they be granted a permit for Limited Commercial use for
a single owner beauty parlor in an R-1 zone. The said property is
located at 655 Park Street. There wasn't anyone at the meeting to
protest. The Willmores were at the meeting to answer any questions.
motion was made by Nyle Fullmer and seconded by Bruce Sutherland to
grant the Willmores a Limited Commercial Use with the stipulation that
there would be no signs on the property and it would maintained as
residential property. All Aye
RE: DISCUSSION OF USING SAND OR RED CINDERS ON THE ROADS
Next on the agenda was sand vs red cinders. Farrell Davidson said they
did not have enough sand to finish the year. He had some of the
cinders left from last year. They had gone down to Walters and tried
to dig some sand out, but it is frozen. The cinders go farther than
the sand does. Cinders are easier to clean up and stay on the street
better. The council advised that we should use the sand and cinders
that we have and then go to cinders if we can't find sand.
RE: MOTION PASSED TO REQUIRE A PLAN CHECK OR DRAWN BY AN ENGINEER OR
ARCHITECT FOR A BUILDING PERMIT.

The council discussed the Building Permit Requirements. We require
that anything above a duplex or a business be required to have an
engineer or architect draw the plans. We have discussed having a plan
check instead. The mayor had talked to Idaho Falls about doing the plan
check. The fee they charge is 65~ of the UBC building permit fee for a
plan check. The mayor also stated that we need to require that all
permits be bought at the same time. It is a possibility to have Idaho
Falls do the plan checks. John Watson said if he did the plan check,
some people might think there was a conflict. Bruce Sutherland
recommended that we go either or and see how difficult it is to find a
plan checker. Farrell Young questioned if they are preapproved by a
chain of stores or motels or a previous plan would they have to be
checked. Bruce said the chain would have been drawn by an architect.
Dean Ricks said they have used the plans for the apartments fifteen
times and have only made minor changes. There have been no problems in
the past.
Farrell Davidson said it was the whole concept not just the
individual.
The mayor said we have adopted the UBC and need to set our fees with
the ones in the UBC. The UBC also requires a plan check.
A motion was made by Bruce Sutherland to make an amendment that we
require either a plan drawn by an engineer or an architect or have a
plan check. The mayor stated that the plan check fee will have to be
paid by the contractor.
Dean Ricks stated that the city is equipped to check plans. Glen Bean
is qualified to check plans. He said that resident buildings should
also have plans. The city does require plans for residents.
The motion was seconded by Brad Liljenquist. All Aye.
RE: ORDINANCE #714 PASSED
Mayor Boyle read Ordinance No. 714, an ordinance amending Ordinance No.
66 regulating fire crackers, fireworks, torpedo, firearms, air guns,
pneumatic guns, spring guns, B-B guns, rocket, grenade, molotov
cocktail, artillery projectile, pistol, catapult, flipper, ice bomb,
pip bomb, black powder bomb, or any other items, bombs or explosives
capable of damaging property or injuring persons or animals.
Ordinance 714
AN ORDINANCE AMENDING ORDINANCE NO. 66 PROHIBITING THE POSSESSION,
MAKING, MANUFACTURING, OR HAVING ACTUAL PHYSICAL CONTROL OVER AND
DISCHARGING OF ANY FIRE CRACKERS, TORPEDOES, ICE BOMBS, OR ANY OTHER
TYPE OF BOMB OR EXPLOSIVE WITHIN THE CORPORATE LIMITS OF THE CITY OF
REXBURG, IDAHO.
A motion was made by councilman Nyle Fullmer and seconded by Bruce
Sutherland that the rules requiring an ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 714.

Ordinance 714 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded by Bruce Sutherland that
ordinance 714 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance, and that said ordinance was
duly and regularly passed. Mayor Boyle declared the motion carried.
RE: RESOLUTION PASSED FOR LOCAL ADMINISTRATION OF THE IDAHO
RESIDENTIAL ENERGY STANDARDS.
Mayor Boyle read a Resolution For Local Administration of the Idaho
Residential Energy Standards. (on file) This would be enforcing the
Idaho laws. A motion was made by Nyle Fullmer and seconded by Brad
Liljenquist to pass the resolution. All Aye.
RE: DISCUSSION ON PROPERTY TRADE BETWEEN DAVE WALTERS AND THE CITY
Nyle Fullmer said Jerry Rigby had called him and said that prior Mayor
Porter leaving office we had approved a trade of some property of Dave
Walters and the city. The city has had the use of the property and
has gotten the dead from Dave, but Dave has never received a deed from
the city for the property he received. The mayor said we would follow
through on it.
RE: DISCUSSION OF OPENING THE ROAD WHERE THE RACE TRACK IS ON 5TH WEST
Brad Liljenquist ask if we had found out anything about opening the
road where the race track is on 5th West. The mayor said the county
commissioners are opposed to opening it. Bruce Sutherland ask if we
had deeded it over to them. Rose was ask to check on it.
Farrell Young ask if the Garners was aware of the decision. J. D.
Hancock said he had told the Garner's attorney and Rose had talked to
Mrs Garner.
RE: DISCUSSION OF THE PARKING SPACES THE E.G.& E. BUSES USE
Farrell Young ask if the E.G.& G. Buses pay for the parking space they
use. Rose said they do. He ask if a private individual could let them
park on his property. The mayor said that wouldn't be a problem if
they had enough parking for the buses and the cars that people leave
while they go on the bus.
RE: APPROVAL OF THE MINUTES AND BILLS
A motion was made by Nyle Fullmer and seconded by Bruce Sutherland to
approve the minutes and the bills. All Aye.
