RE: APPROVAL OF MINUTES Nile Boyle Brad Liljenquist Farrell Young Bruce Sutherland Nyle Fullmer Glen Pond Darlene Blackburn J. D. Hancock, Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by Nyle Fullmer and seconded by Bruce Sutherland to approve the minutes. All Aye RE: PROPERTY DEEDED TO CITY ON TED GARNER PROPERTY The mayor explained to the council that there is a situation on Ted Garner property. It is in the area where Garner Construction property was before the flood. It is just west of the school district office. The property is 60' x 124' 911. The Garners was going to dispose of this property and found that this small piece of property in the center of all there property belonged to the City. In 1918 it was deeded to the city by Mr Evans. The property was never deeded from the city back to anyone. In 1962 George Garner deeded all that property in that block to Teed and gave him a quick claim deed that included the property owned by the city 60' x 12419" piece of property. It was recorded in the courthouse, but since it was in the same family they did not get title insurance. Garners have paid taxes on this property. The city didn't know they owned it. To legally dispose of it we would have to have a public hearing after the council decided to dispose of it. After the hearing there would need to be an appraisal and an ordinance would have to be passed. After the ordinance is passed there is a 60 day wait to determine if anyone objects, then it can be sold or conveyed. A motion was made by Bruce Sutherland and seconded by Farrell Young to proceed with the hearings. (discussion) All voting Aye. RE: DISCUSSION ON WEATHERSTON'S SINGLE WIDE TRAILER AT HOUSE AT 133 SOUTH 4TH WEST Frank Bell was at the meeting to make a request to the council. The Weatherston estate own property with a trailer house on it at 133 South 4th West and next to it is a house at 145 South 4th West. Grandpa Weatherston owned the trailer house. We want to sell the house and trailer and the people that want to buy it want to rent the house and trailer. He was asking for permission for the people that want to buy it to continue to rent the trailer rather than moving it. The mayor referred to minutes from a council meeting in 1981, restricting trailers. At that time there was a trailer board that reviewed all the trailers and had all of the single wide trailers removed with the exception of the ones that senior citizens lived in and they were grandfathered until the time of their death. Nyle Fullmer said his concern would be that it would be establishing a precedence. A motion was made by Bruce Sutherland and seconded by Brad Liljenquist to refer the issue to the Planning & Zoning for a recommendation. All Aye RE: DISCUSSION ON ENCOURAGING COMPLIANCE WITH THE SEAT BELT LAW 5 The State of Idaho Transportation Department have been doing surveys on the compliance in various cities of motorists obeying the seat belt law. The Chief of Police had written a letter to the council. Rexburg is the lowest compliance city in the State of Idaho on seat belt use. The police have starting giving tickets on this. The mayor ask the city council if there was anything we could to encourage compliance on this. The mayor said we need to encourage all the city employees and their families to wear seat belts. Bruce Sutherland said we need to comply and require all employees to wear seat belts in the city vehicles. Nyle Fullmer stated that we need a recommendation from the safety commission. RE: MOTION PASSED TO USE THE STATE AS THE ELECTRICAL INSPECTOR The mayor stated that at the last meeting we discussed the electrical inspector position. We talked to the State of Idaho at that time about signing an agreement for them to do the inspections. We checked with Twin Falls and Coeur de Alene that use the state and they are happy with it. A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to go with the State Inspection and to let the Mayor make a decision on which method to use. All Aye RE: COUNCIL TO BE HELD THE NIGHT BEFORE THANKSGIVING The mayor ask the council if they wanted to hold council meeting the night before Thanksgiving. It was decided to leave it as it is. RE: DISCUSSION OF HONORING AN EMPLOYEE AT THE EMPLOYEE CHRISTMAS PARTY The mayor told the council the employee Christmas party would be December 13. In the past we have honored an employee of the year. The mayor ask the council if they had any ideas on how to do it. (discussion) J. D. Hancock said the school district honored those who have retired or who have given 5, 10, 15 years of service because they have run into the same problem. The council felt that the party was enough unless we show appreciation for retirement, service or an outstanding performance during the year. RE: PUBLIC HEARING HELD FOR TETON COMMUNTICATIONS CONSTRUCTION OF A BUILDING AND A 60 FOOT RADIO TRANSMISSION TOWER 8:00 P. M. Public Hearing for Teton Communications to be granted a permit for Limited Commercial use for construction of a building and 60 foot radio transmission tower in an R-2 zone. The said property is located on the East side of South 2nd East near the water tower. Tony, from Teton Communications explained the project. Gerald Stucki a neighbor to the property ask if it would include a fence. Tony said it did not include a fence but if necessary they would build a fence. Gerald was concerned of the safety of the children if if was not fenced. Tony said if fencing was a solution they would agree. Gerald also ask what would happen to the rest of the property. Tony said they would spray the ground for weeds and possibly plant grass. Blair Heinz was at the meeting and had no questions. The mayor told the council that the P & Z had recommended it. RE: MOTION PASSED TO ALLOW THE CHANGE OF ZONING FOR TETON COMMUNICATIONS Nyle Fullmer made a motion to except the recommendation of Planning & Zoning and allow the zoning of the piece of property to changed to Limited Commercial. Seconded by Brad Liljenquist. All Aye. RE: DISCUSSION OF THE PROBLEM WITH EPA ON SEWER LAGOONS The mayor told the council we still have a problem with EPA on the sewer lagoons. It will require a dechlorination effluent before it goes back into the river. As it looks like it will be below $100,000. If we can do it for less than $100,000 we could do it out of the depreciation fund. The council felt we should do that. 1 RE: APPROVAL OF THE STREET FINANCIAL REPORT The mayor ask the council to look at the Street Financial Report in their folders. A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to approve the report. All Aye. RE: MOTION PASSED TO CHANGE THE PLOT PLAN OF JIM NEWMAN'S DRIVEWAY The mayor reported on the Planning & Zoning. Jim Newman applied for a variance on a driveway. The driveway needs to go over 2 1/2 feet on Steve Clark's property to make a 20 foot driveway. The Planning & Zoning felt he would not need a variance but we would need to modify the plot plan to allow the driveway to be 2 1/2 foot narrower. A motion was made by Brad Liljenquist and seconded by Nyle Fullmer the change to the plot plan. All Aye. RE: DISCUSSION OF THE REQUIREMENT ON BUILDING PERMITS Another item from Planning & Zoning was the requirements on a building permits requiring an Architect or Engineer drawing on businesses and apartments. We have had two people complain because they had their plans already. The P & Z recommendation is instead of having their own architect or engineer draw the plans we could do like Idaho Falls does and have a licensed Architect or Engineer Plan Check the plans and make sure they are okay and charge the builders the Plan Check fee. The mayor had talked to Idaho Falls Building Department and they will send us information about possibly contracting to do our plan check. The builders would then have an option to do one or the other. The council felt we should proceed with that. RE: COMPLAINT FROM DEBRA MOULTON ABOUT HER NEIGHBOR'S YARD Nyle Boyle said he had a complaint from Debra Moulton on 3rd West and 3rd South about her neighbor. The neighbors yard had a lot of garbage and cats and she wants it cleaned up. RE: NEW PARK WILL BE NAMED THE REXBURG AQUEDUCT AND WILD LIFE PARK Jay Wixom, Director of the Economic and Development was at the meeting. He discussed the new park. He will help with it. It will be called the Rexburg Aqueduct and Wild Life Park. RE: APPROVAL OF THE MINUTES A motion was made by Nyle Fullmer and seconded by Brad Liljenquist to approve the minutes.
