HomeMy WebLinkAbout1990.09.27 CITY COUNCIL MINUTES[1 CITY COUNCIL SPECIAL MEETING 09/27/90 Those Present: Mayor: Nile Boyle Councilmembers: Nyle Fullmer Bruce Sutherland Brad Liljenquist Darlene Blackburn Farrell Young RE: APPROVAL OF CROUCH'S REQUEST FOR A CONDITIONAL USE PERMIT Dr Max Crouch was at the meeting to request a Conditional Use Permit on property at Ash and 1st South. The planning and zoning had discussed it at their regular meeting on September 26 and recommended that he be given a Conditional Use Permit. They did recommend that the Traffic Committee study the safety problem in that area. Bruce Sutherland declared that he did have a conflict, being that he lives in that area. Nyle Fullmer ask if he would put a sidewalk on the end of it. Dr Crouch discussed that and the landscaping, showing the plans. There would be no retail business. All building would have to meet the Conditional Use conditions. A motion was made by Nyle Fullmer to except the Planning & Zoning recommendation and set the Public Hearing for October 17. Seconded by Farrell Young All Aye. RE: NELSON AGREEMENT Mayor Boyle told the council that Zyrl Nelson would not sign the agreement. (discussion) Nyle Fullmer recommended that if Zyrl has to sign it by the next meeting or we will file suit. The council agreed. RE: SEWER DAMAGE FROM THE SEWER BACKUP ON THE GAIL RILEY RENTAL UNIT J. D. Hancock discussed the damage from the sewer backup on the Gail Riley rental unit. When De Lynn checked it out and found that it was the city's problem, he promised Gail that the city would take care of it. We settled with the Cooks with the deductible on our insurance. They sued Rileys and Rileys want us to pay their attorney fee. The attorney fee is about $600. (discussion) A motion was made by Bruce Sutherland and seconded by Nyle Fullmer if we can compromise and negotiate for a settlement not to exceed $400 for the attorney to go ahead.. All Aye RE: IDAHO RESIDENTIAL ENERGY STANDARDS The mayor told the council that the State wants to have a meeting to discuss the Idaho Residential Energy Standards. It was decided to hold the meeting October 10 at 7:00 A. M. RE STEVE CLARK'S COTTAGE APARTMENTS A discussion on the Clark apartments. The deadline is October 15.
