RE: APPROVAL OF MINUTES
A motion was made by Bruce Sutherland and seconded by Darlene Blackburn
to approve the minutes. All Aye.
RE: TREES ON 2ND EAST
Bruce Sutherland reported on the trees on 2nd East. Basically we would
like the State to give the City the bid. We will purchase the trees
and plant them ourselves. If the State still thinks they need to use
the sub contractor, we might have to reduce the number of trees
planted. Between 1st South and 4th South the people will still get the
trees they want, but we will have to reduce the number of trees planted
on the upper part of the street. The mayor said they were meeting with
the Department of Transportation in the morning to get that worked out.
RE: SUBDIVISION SOUTH OF SHOSHONE
Glen Pond made a report on Planning & Zoning. There was a request on a
change on a Sub Division by Greg Fullmer. The developer is going to go
ahead with a new proposal to re -do that sub division south of Shoshone.
RE: STEVE CLARK APARTMENTS
There has been a complaint issued on some apartments that are under
construction in the city and rather they are meeting code. The
recommendation from the Planning & Zoning is to get a Constructional
Engineer come up and check it to make sure it meets the Uniform
Building Code and the parking. It will probably cost about $200 to
$300. In the mean time they recommend that the City Attorney write and
put a stop order on the project until that is completed. A motion was
made by Nyle Fullmer and seconded by Bruce Sutherland that the
construction on the Steve Clark Apartments be halted until a
constructional engineer checks it to see if it is within code. All Aye.
RE: HOUSE AT 128 WEBSTER AVE.
The next item is there was a fire in a house at 128 Webster Ave about
November of 1988. The house burned, and there was no insurance on the
house. The house has become a nuisance to the neighborhood. The
Planning & Zoning has requested that we make a motion to the city
attorney to write a letter to the owner giving them notice that they
will have a certain amount of time to remove that building from the
property otherwise the city will remove it and bill the owner. A
motion was made by Darlene Blackburn and seconded by Nyle Fullmer that
the owner of that property be notified that the house is a nuisance
dangerous and will have to be torn down within 60 days or the city will
tear it down and bill the owner. All Aye
RE: REVIEWING FLOOD MAP

The Planning & Zoning is also reviewing the flood map.
RE: MEETING ABOUT FLOOD MAP
Mayor Boyle told the council that there will be a meeting on April 24
at 9:00 A. M. at the City Hall about the flood map. They would like to
invite the council and the public to attend. Glen Pond said the people
living on the north end of town close to the river would want to attend
that meeting.
RE: PARKING HARMONY HOUSE
Nyle Fullmer reminded the council that Jay Flukinger should be sent a
letter that his parking needs to be brought into compliance at Harmony
House by June 1. The city attorney will write that letter.
RE: TABERNACLE
Darlene Blackburn made a report on the tabernacle meeting. (copy on
file) one suggestion was that the name of the tabernacle be changed to
"Rexburg Tabernacle Civic Center". A motion was made by Glen Pond and
seconded by Nyle Fullmer to approve the suggestions of the Tabernacle
Board. All Aye.
RE: CHECK TO HELP WITH THE RESTORATION OF THE TABERNACLE
The mayor told the council that we received a check today from the
Idaho Commission of the Arts for $900 to put to the tabernacle, to help
with the restoration.
RE: RECYCLING AND CLEAN-UP
Farrell Young made a report on the Recycling. It was discussed that
through the general clean up in Rexburg, it was suggested that we hold
a recycling Olympics in conjunction with American Recycling. We would
distribute plastic bags to the schools, service clubs, to scout troops
or anyone who would be interested in helping us clean up the city. Any
recyclable item could be saved and brought into a recycling center
behind JC Penneys. At that time there will be games, refreshments,
and prizes. They are not only excepting aluminum cans, newspaper, and
card board but also excepting plastic milk bottles, tin cans, computer
paper and copper fittings. It will be held the 5th of May. The
proceeds from this will be donated to the Carousel Restoration Fund.
RE: NUISANCE ORDINANCE
The mayor ask if anyone was at the meeting to discuss the Nuisance
Ordinance. Hugh Hill, 351 Yale, was at the meeting to ask about the
restriction on compost pile. He said he had one for several years and
no one had complained about it. J D Hancock read the ordinance for the
2nd reading. The mayor told Mr Hill you could still have the compost
pile if it does not spread or harbor disease, emit unpleasant odors.
He did not think there would be a problem. Mr Hill said his compost
pile is grass, leaves and nitrate or suphate and cover it with dirt.
RE: AIRPORT
George Quarez was at the meeting and ask if the city could consider in
the definition of nuisance some solid waste that is regularly dumped by
airline operators on personal property, to the determent of their
property, their trees, their bushes and the safety of the household?
Mayor Boyle said it would be hard to do under this ordinance, but that
has already been illegal and EPA is really putting clamps on it. EPA
would be the ones to moderate it. Nyle Fullmer told him that the
Airport Board had already addressed that. Bruce Sutherland said one
difficulty is when the crop dusters spray up on the dry farms, as they
spray the fields and climb their becomes a vapor cloud and it floats
over Rexburg. Brad Liljenquist ask if they were spraying over Mr
Quarez neighborhood? He didn't think they were but the north part of
the city is getting the pollution.
RE: THIRD READING OF THE NUISANCE ORDINANCE

The mayor said their would be a third reading of the ordinance at the
next meeting.
RE: WEST ONE BANK TO FINANCE SOME GOLF COURSE EQUIPMENT
The mayor introduced a resolution with West One Bank to finance some
golf course equipment.
It is unanimously approved by the City Council of the City of Rexburg
to acquire and finance through the West One Bank two golf course mowers
and one sprinkle, costing $24,898.00, for a rate of 7.57% plus $100.00
loan fee. The first payment of $12,449 will be paid in advance,
followed by one payment of$12,449> plus interest on June 3, 1991.
RE: DOCUMENTS ON BEHALF OF THE CITY
A motion was made by Glen Pond and seconded by Darlene Blackburn to
authorize Mayor Nile Boyle to sign the necessary documents on behalf of
the City of Rexburg. Those voting aye: Darlene Blackburn, Nyle
Fullmer, Bruce Sutherland, Glen Pond, Farrell Young, Brad Liljenquist.
Those voting Nay: None. Motion passed.
RE: US WEST COMMUNICATIONS
Mayor Boyle told the council that in the past people have been able to
come to City Hall and pay their phone bills. U. S. West Communications
no longer wants to pay us to do it. They have ask us to put the
payments in a prepaid envelope and mail them to them, but would not pay
us to do so. The mayor said we have a lot of older people who come in
to pay their bills, and it would be a service to them. Glen Pond said
we need to think about the other utilities If we do it for one the
other might want us to do the same. Nyle Fullmer thought it would be a
liability to the city. Brad Liljenquist said he did not think we
should do it unless we get paid for it. A motion was made by Brad
Liljenquist and seconded by Glen Pond that we discontinue taking the
payments for U S West Communications as of June 1. All Aye
RE: PRE TREATMENT MANUAL
The next item on the agenda is the Pre Treatment Manual. J. D. Hancock
has read through it. He said it was put together well. He thought Dave
and De Lynn was setting themselves up for a a lot of work if they
follow what they have outlined. The mayor said it was mandated by
EPA. J. D. said he thought it was a marvelous thing if it will keep us
from future problems and fines, but he wanted to make sure they know
what they are suppose to do and follow through. Mayor Boyle said we
have no choice, we either have to pass this one or another one. Brad
Liljenquist said he has found with his experience with EPA we need to
do what they say. A motion was made by Nyle Fullmer and seconded by
Brad Liljenquist that we except this pre treatment manual. All Aye.
RE: SEWAGE TREATMENT
The mayor told the council that John Millar will have the study done on
the Sewage Treatment in two weeks. One problem is it was over
designed. Our retention time in the lagoons is too long. There will
need to be some repairs to the aeration system and lower the holding
time. We might cut the size of the lagoons down.
RE: PURCHASE SURPLUS PROPERTY
The mayor introduced a resolution designating the authorized people who
can purchase surplus property. Those authorized are Mayor Boyle,
Farrell Davidson, De Lynn Edstrom, and Blair K Siepert. A motion was
made by Brad Liljenquist and seconded by Glen Pond to pass this
resolution. All Aye.
RE: FISH POND
Mayor Boyle read an agreement with the Idaho Fish & Game for the fish
pond. (copy on file) A motion was made by Bruce Sutherland and
seconded by Nyle Fullmer to approve the agreement and authorize the
mayor and city clerk to sign it. All Aye.
RE: CURFEW ON THE PARKS FOR 11:00 P.M.
Mayor Boyle said there was a problem with people playing tennis after
10:00 P. M. at night. We have a curfew on the park for 11:00 P. M. and
we will get some signs put up.
RE: TREES NEED TO BE TRIMMED
There was a discussion about the trees that need to be trimmed. There
are eight places that need to be trimmed. Bruce Sutherland said he
would have the Street Department do it. We need to notify the
residents before we trim the trees.
RE: LA MONT BAIRD WANTS TO START A FARMERS MARKET
Darlene Blackburn said La Mont Baird from the R C & D want to start a
Farmers Market in the vacant lot of Fergusons by Mc Donalds. He wants
to know if they could operate it under one license. The council okayed
it.
The council discussed the new business license, licence for transit
business, and a tree ordinance. They felt that the tree ordinance
should fall under the Planning & Zoning.
RE: APPROVAL OF BILLS
A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to
approve the bills.
