RE: MEETING WITH JUB
The Mayor told the group that we had a meeting with JUB Engineers to
give us a presentation on our problems with EPA on the sewer system.
A scout led the Pledge to the flag.
RE: APPROVE MINUTES
A motion was made by Bruce Sutherland and seconded by Farrell Young to
approve the minutes. All Aye.
RE: AUDIT
Bob Hardy and Scott Bond representing Rudd and Company was at the
meeting to present the audit. Bob Hardy said they were pleased with
what they saw in the city. They appreciate the opportunity to serve
the city with the audit. They went through the audit explaining it.
Bob said it is important that the city budget for all activities. We
weren't budgeting for the Golf Course capital projects, Airport
Fund,the Tabernacle Restoration Fund, Lid Guarantee Fund, and the
Community Block Grant. The office runs very smoothly. The audit
report and requirements we have from Richard and Rose came out in a
timely manner, and we were pleased with that. You might want to do
some structural changes within your accounting department, in who
oversees what. You will have to look at that from an operational
standpoint. In a city this size it is hard to segregate everything.
It would cost you more in salaries and benefits than it you would
recognize in savings. J. D. Hancock ask as part of the audit, did you
go to the county to verify that Madison County was giving the city its
proper share of each of the funds. Bob said we confirm with them in
what they give you, but we have to rely on their auditors to test that
the percentages are being allocated correctly. A motion was made by
Brad Liljenquist and seconded by Nyle Fullmer to except the audit as
presented. All Aye.
RE: PARKING FEES
Mayor Boyle reviewed Ordinance 700 for parking in fire lanes. On the
recommendations of the Chief of Police we changed the fine for parking
in the fire land from $25 to $10. He also recommended that we change
the Parking Ordinance fees. It would raise the parking fines all over
the city. There is a provision for an additional fee for paying
parking fines late.
RE: ORDINANCE 700
Ordinance 700 with the only change being the fine would be $10.00
instead of $25. AN ORDINANCE PROHIBITING THE PARKING OF ANY VEHICLE IN
A DESIGNATED FIRE LANE AND AUTHORIZING HE POLICE TO ENTER UPON PRIVATE
PROPERTY WHEN NECESSARY TOE ENFORCE THIS PROHIBITION; PROHIBITING THE
STOPPING, STANDING OR PARKING IN NO -PARKING LOTS AND AUTHORIZING THE
CITY POLICE TO ENTER UPON PRIVATE PROPERTY TO ENFORCE THIS PROHIBITION;

PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
RE: ORDINANCE 700 WAS PASSED
Ordinance 700 was placed before the council. The mayor then called for
the voting for final passage of the ordinance, and the motion was made
by Nyle Fullmer and seconded by Darlene Blackburn that ordinance 700 be
passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the city council had
voted for the passage of said ordinance, and that ordinance was duly
and regularly passed. May Boyle declared the motion carried.
RE: ORDINANCE 704
Ordinance 704 changing the amount parking fines.
AN ORDINANCE AMENDING SECTION IX OF ORDINANCE NO. 537, SETTING FORTH
PENALTIES FOR PARKING VIOLATIONS; AND PROVIDING WHEN SAID ORDINANCE
SHALL TAKE EFFECT.
A motion was made by Councilman Bruce Sutherland and seconded by
Councilman Farrell Young that the rules requiring an ordinance of a
general and permanent nature to be read on three occasions be dispensed
with and that said ordinance be numbered 704.

RE: INCREASED ON TICKET IF NOT PAID WHEN DUE
Bruce Sutherland stated that when the tickets are printed that they
need to state on the ticket that the fine will be increased if not paid
when due.
RE: POST SIGNS IN A FIRE LANE ON PRIVATE PROPERTY
The mayor stated that in order to enforce ordinance 700 prohibiting
parking of a vehicle in a fire lane on private property, it will have
to be posted.
RE: PUBLIC HEARING ON ZONE CHANGE IN PARK VIEW AND HENDERSON
SUBDIVISION

Subdivision and the Henderson Subdivision from R2 to Rl. (copy on file)
The city passed a petition around to the property owners within 300
feet. Everyone voted that they do not object to the zone change.
RE: LETTER STATING NO OBJECTIONS TO THIS ZONE CHANGE
Mayor Boyle read a letter from the Rexburg Idaho Center Stake
Presidency stating that they have no objections to this change in
the zoning. They recommended that the developer be encouraged to
provide proper access to the area. That at least two access points be
provided from 5th West Street and independent of Park Street. (Letter
on file)
RE: MARJORIE WAHTCOTT ENCOURAGES THE COUNCIL TO CONSIDER ACCESS
ROADS ON 5TH WEST
Marjorie Whatcott- Speaking as a resident of the Starlite Addition and
also as the principal of the Kennedy school. She said she would
encourage the council to consider access roads that was mentioned in
the above letter because she felt that we have a lot of traffic on 5th
West already and with so many children on that street it would be
helpful to have a access road from the west. Park Street is a narrow
road, and it would be helpful to drain as much of the traffic off Park
Street as possible.
Bruce Sutherland ask if the access roads had anything to do with the
zone change. The mayor said it didn't but it was a good time to
address that issue. It would be nice in the future to have the road go
to the West over to that other road.
RE: EXTEND A ROAD GOING TO THE WEST CONNECTING TO THE COUNTRY ROAD
Reed Wyatt- Representing the Stake Presidency, he had looked at the
plat. There is one road that goes into the sub division that is the
access road to the church, it would be a good thing on the South West
corner of the sub division to extent a road going to the west
connecting to the county road.
RE: SUGGESTED TO HAVE TWO ACCESS ROADS FROM 5TH WEST
Mayor Boyle said it had been suggested to have two access roads from
5th West, with that many homes in the sub division. That is a lot of
cars to come out of the sub division. The final plat has not been
excepted. We can re -zone it without the final plat. Another problem
is the property that is part of the church parking lot now that turns
by Geddes' going back to the South is going to have to be delineated as
a street and not just as a parking lot. Before the final plat is
excepted those things will have to be addressed. We will give Mr
Henderson a copy of the suggestions.
RE: ALLEY IN BACK OF PARK STREET
Grant Benson- How about an alley in back of Park Street for an access
to the back of that property. Mayor Boyle said it would be difficult
to force that homeowner to give up that much ground. That would not be
a requirement of the Planning & Zoning to require an alley.
RE: CHANGE THE ZONING FROM R2 TO R1
A motion was made by Brad Liljenquist and seconded by Farrell Young to
change the zoning from R2 to Rl. All Aye.
The mayor said we would try to address the issues on access, on the
alley and on the traffic flow.
RE: PARK STREET CHAPEL
Calvin Whatcott- The entrance on the east and west is fine, but if you
bring any street north to the Park Street Chapel parking lot that will
make Park Street, which is already too narrow, a driveway for people
coming into that sub division. He did not think there should be an
access road from the Park Street Chapel out of that sub division. The
mayor said there would need to be an access, because those people will
want to go to church.
RE: HOUSE BY KINGDOM HALL
Nyle Fullmer said he had a call about the house by Kingdom Hall is
really getting junked up with a lot of old cars. They need to be
cleaned up. It is the old Straton property. The mayor said he would
talk to Blair about it.
RE: ORDINANCE 703
The mayor introduced ordinance 703 vacating and closing the alley in
the Mill Hollow Subdivision. AN ORDINANCE VACATING AND CLOSING A CITY
ALLEY IN THE MILL HOLLOW SUBDIVISION IN THE CITY OF REXBURG, IDAHO;
PROVIDING THAT SAID ALLEY REVERT TO THE OWNERS OF THE ADJACENT REAL
ESTATE ON THE EAST AND WEST OF SAID ALLEY; AND PROVIDING WHEN SAID
ORDINANCE SHALL TAKE EFFECT.
A motion was made by Councilman Nyle Fullmer an seconded by Councilman
Bruce Sutherland that the rules requiring an ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 703.

RE: SIGN FOR ZION LUTHERAN CHURCH
Mayor reviewed the Planning & Zoning minutes. There is a request to
put a directional sign for the Zion Lutheran Church on the corner of
278 West Main. The ordinance is specific on this "Advertising signs
not to exceed 3 feet square attached flat to house or building." The
zoning board voted that this sign not be allowed in the R2 zone. Ken
Schauer, Pastor of Zion Lutheran Church was as the meeting to discuss
the matter. He said we have several Lutheran families in Rexburg who
had to go to Ashton to attend church, so they decided to hold church in
Rexburg in the Catholic church. The problem came up with the
Sunbirds. The average attendance in the winter is only about 10 or 12
and in the summer it is 50 or 60. We have always had a retired Paster
to take care of the administered to these people during the summer. We
decided that we needed a sign to direct the people to the meeting
place. He had told Pastor Schauer that he had talked to Mayor Porter
about the sign and he said he had everything cleared and just needed to
find a property owner who would let us put a sign up. He died last
summer. In August the Pastor and some of the Sunbirds came into city
hall and someone told him it would not be a problem. After checking
with the property owners in that area they finally got permission from
Merrill Rudd who owns this property, to put a sign up. In January when
he checked in the city hall, the City Clerk told him he might have a
problem. Nyle Fullmer said he felt that this sign was a little
different than an advertising sign, it is a informational sign. The
council discussed the location of the sign and possibly looking at
putting the sign on the other side of the street or on city property.
A motion was made by Brad Liljenquist and seconded by Bruce Sutherland
to schedule a public hearing to grant a variance for the sign. All Aye
RE: ZONING ORDINANCE
The Planning & Zoning recommended that we engage Renee Magee to update
our zoning ordinance and to have her submit a proposal. The council
agreed to pursue it.
RE: WATER
High Country Water Works have requested to buy water from Rexburg to
sell it in containers for drinking water. A motion was made by Nyle
Fullmer and seconded by Darlene Blackburn to allow them to buy water.

RE: BLUE CROSS
Mayor Boyle told the council that we got a notice from Blue Cross that
our premium would be raised 22% on March 1, 1990. We have budgeted for
it because we expected it. They discussed changing the stop loss. To
lower the stop loss down it would cost $3600 for the rest of the year.
The council wanted to check with the employees to see if they would pay
some of the increase for the change in the stop loss.
RE: TETON COMMUNICATION
We have a request from Teton Communications to put an antenna on the
water tower (letter on file). They would be willing to pay $100 per
month rent to do this. The mayor said he would do some checking on it
and bring it up in 2 weeks. J. D. Hancock questioned if we would have
any liability.
RE: PARKING LOT IN PORTER PARK
The mayor discussed putting a parking lot in Porter Park. Mayor Porter
had H & K draw up a plan last fall to put a parking lot west of the
swimming pool and south of the carousel. The cost to get it all black
topped would be $16,000. We budgeted it by taking the $5000 grant
given to the city by American Potato and the money left in the Tedro
parking lot money. Mayor Boyle said he had not been much in favor of
tearing out part of the park for the parking lot. There is a vacant
lot across the street owned by Merle Fisher. He would sell it for
$11,000. If we spent the money to buy the property we wouldn't be able
to black top it, but could gravel it and landscape it. He ask the
council to go down and look at it and see what is the best thing to
do. Most of the parking problems along that street comes from the Diet
Center employees parking along that street. Nyle Fullmer suggested
that if we had a parking lot across the street there would be a danger
of a child being hit by a car while he was running across the street.
RE: CENSUS MEETING
The mayor told the council that there was a Census meeting February 26
in Idaho Falls at 10:00 A. M.
RE: AIRPORT BOARD
The mayor said the Airport board called and John Ferguson has moved and
they would like to appoint Roger Porter to replace him on the board. A
motion was made by Brad Liljenquist and seconded by Darlene Blackburn
to appoint Roger Porter to the Airport Board. All Aye
RE: MAYORS RECEPTION
The Dance Festival Committee wants the city to take over the Mayors
reception. We need to set up a committee to start working on it.
RE: NATION CHILD PASSENGER SAFETY AWARENESS WEEK
We have a proclamation to Buckle Up For Love. We would designate next
week Feb 11 to Feb 17 as National Child Passenger Safety Awareness Week.
RE: WATER RUN OFF IN CREST HAVEN
Farrell Young ask about the problem with the water run off in Crest
Haven Sub division. The mayor said John Millar had made a drawing and
we gave it to the college and they are trying to get it approved for a
easement.
RE: APPROVE BILLS
A motion was made by Bruce Sutherland and seconded by Nyle Fullmer to
approve the bills. All aye

This letter is being written in regard to the proposed hearing
concerning rezoning an area south of the Park View Addition. The
be changed from R-2 to R-1. We have no objection to this change
ordinance.

We do strongly recommend that the developer be encouraged to provide proper
access to the area. It is recommended that at least two access points be
provided from 5th West Street and independent of Park Street. As you are aware,
Park Street is a residential street and was not designed for major traffic
volumes. Also, we are not able to predict at this time where people living in
this subdivision would attend church, however it would be important that proper
access be provided to the Park Street Chapel. The chances are good that
eventually this chapel would be used by families living in this subdivision.
In addition, we would encourage the City to include in their planning the
development and construction of a street from this new subdivision to the west,
past the Park Street Chapel, to the existing County Road. A street at this
location would be important for traffic circulation from the subdivision to the
West and South to the Stake Center. Any planning should include proper traffic
flow around the Park Street Chapel as well as proper access to the County Road.
We would be happy to work with you to implement changes in this area.
We appreciate the opportunity of commenting on these proposed zoning revisions.
