A motion was made by Darlene Blackburn and seconded by Nyle Fullmer to
approve the minutes. All Aye
RE: APPROVE BILLS
A motion was made by Bruce Sutherland and seconded by Darlene Blackburn
to approve the bills. All Aye.
RE: MAYOR PORTER SAYS THANKS TO THP -CITIZENS OF REXBURG
Mayor Porter stated that he had enjoyed the years as mayor of Rexburg.
He wanted to thank the citizens of Rexburg for the help and loyalty.
He also thanked the city council for the help they had given him.
Rexburg's economic base is farming }yet we have Artco, Diet Center,
Louisiana Pacific, American Potato and a strong retail business.
People come here for services, medical, and education. We have been
able to maintain a rural atmosphere and a religious base. We have also
become an Urban Community. He said he felt fortunate to have served as
mayor.
RE: OATH OF OFFICE
Mayor Porter gave the oath of office to Nile Boyle to swear him in
office as the new mayor of Rexburg. He then gave the oath of office to
the two new councilman and the incumbent councilman, Farrell Young,
Brad Liljenquist and Bruce Sutherland.
RE: OFFICE OF MAYOR TURNED TO NILE BOYLE
Mayor Porter then turned the office of mayor over to the new mayor,
Nile Boyle.
RE: ASSIGNMENTS OF COUNCILMEMBERS READ
Mayor Boyle read the new assignments to the councilmembers.

RE: NOMINATION FOR PRESIDENT OF THE CITY COUNCIL
Mayor Boyle ask for a nomination from the council for a President of
the City Council. A motion was made by Darlene Blackburn and seconded
by Nyle Fullmer to nominate Glen Pond as President of the City
Council. All Aye.
RE: PROBLEM ON CREATVIEW DRIVE
Mayor Boyle told the council that there is a run off problem on
Crestview Drive. Brian Groom was at the meeting, he is the owner of
the lot on that street that is effected because of a lack of a curb and
run off system. It is the last house in the city limits at the west
end of the street on the north side. It is just east of the home owned
by Argus Clinger which is just outside of the city limits. The mayor
said he had looked at it and he thought it was a problem for the
developer. He thought they would probably have to pipe it or put in
curb and gutter to run the water on past. Mr Groom said he had bought
the lot from Kent Jolly and would like to start building in the
spring. Chuck Frost was at the meeting and said it was a serious
problem. The mayor said they would get with Kent Jolly and get it
worked out. Chuck Frost ask where the water would go if it was piped.
The mayor said the only place it could go is in Wards field or on the
college property. Chuck said the college had contacted Forsgren
Perkins about a year ago about it and there was some talk about putting
in a storm drain. Farrell Young suggested that if we fix it we need to
be careful. The mayor we need to get all the interested parties
together.
RE: APPOINTMENTS OF THE DEPARTMENT HEADS
Mayor Boyle announced the appointments of the department heads.

A motion was made by Glen Pond and seconded by Bruce
approve the department heads as listed. All Aye
RE: INTRODUCED ORDINANCE 699

Mayor Boyle introduced Ordinance 699 an ordinance for the appointment
of a tabernacle management committee.
ORDINANCE NO. 699
AN ORDINANCE PROVIDING FOR THE APPOINTMENT OF A REXBURG TABERNACLE
MANAGEMENT COMMITTEE; THE TERMS OF OFFICE OF ITS MEMBERS AND THE DUTIES
OF SUCH COMMITTEE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
A motion was made by Councilman Bruce Sutherland and seconded by
Councilman Nyle Fullmer that the rules requiring an ordinance of a
general and permanent nature to be read on three occasions be dispensed
with and that said ordinance be numbered 699.

RE: ORDINANCE 699 WAS PASSED
Ordinance 699 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded by Brad Liljenquist that
ordinance 699 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared the majority of all the members of the City Council had voted
for the passage of said ordinance, and that said ordinance was duly and
regularly passed. Mayor Boyle declared the motion carried.
RE: INTRODUCED ORDINANCE 700
Mayor Boyle introduced ordinance 700, prohibiting the parking of any
vehicle in a designated fire lane.
ORDINANCE 700 AN ORDINANCE PROHIBITING THE PARKING OF ANY VEHICLE IN A
DESIGNATED FIRE LAND AND AUTHORIZING THE POLICE TO ENTER UPON PRIVATE
PROPERTY WHEN NECESSARY TO ENFORCE THIS PROHIBITION; PROHIBITING THE
STOPPING, STANDING OR PARKING IN NO -PARKING ZONES AND FIRE ZONES IN
PUBLIC OR PRIVATE PARKING LOTS AND AUTHORIZING THE CITY POLICE TO ENTER
UPON PRIVATE PROPERTY TO ENFORCE THIS PROHIBITION; PROVIDING FOR A
PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
Dale Walker representing Valley River Center. He said he thought the
ordinance sounded good. Chuck Frost said he was representing the
college. They were very much in favor of the ordinance. They wanted
to be sure that the college police force enforces the parking on the
college property that there be some kind of an agreement that it isn't
necessary for the city police to enforce parking on the college private
parking. The mayor told him we wouldn't go on any private property
unless the owner wants to put signs up and give us permission to do
SO. Farrell Young ask who determines where the fire lanes will be.
The mayor told him that the city has adopted the State Fire Code so
there are set rules. The Fire Inspector goes around and inspects
those. If they are not correct they are notified. They discussed fire
lanes on apartments and businesses. Glen Pond suggested that we just
do the first reading of the ordinance tonight and have Blair Siepert
discuss it with Tom Lehman and do the second reading at the next
council meeting. The council agreed.
RE: INTRODUCED ORDINANCE NO. 701
Mayor Boyle introduced Ordinance No. 701, establishing the Revolving
Loan Fund.
ORDINANCE NO. 701
AN ORDINANCE ESTABLISHING A CITY OF REXBURG REVOLVING LOAN FUND AND THE
PURPOSES FOR WHICH THE FUNDS MAY BE USED; PROVIDING FOR THE REPAYMENT
OF SAID FUNDS, TOGETHER WITH INTEREST: AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
Brad Liljenquist questioned the section that says the money can be used
for city use. The mayor said an example would be if the city wanted to
start recycling and needed to buy a compactor for cardboard boxes which
would cost about $10,000 and would pay for itself quickly and the money
could be paid right back with interest. Brad said his concern would be
if the city borrowed it and then we had a chance to help a business to
come into the city and that presents a road block. He also ask what it
meant by Prime Rate. Richard Horner said the prime rate is set by the
banks and we go 1% or 2% above that. The city council would make that
determination.
A motion was made by Councilman Glen Pond and seconded by Councilmember
Darlene Blackburn that the rules requiring an ordinance of a general
and permanent nature to be read on three occasions be dispensed with
and that said ordinance be numbered 701.

RE: ECIPDA WILL ADMINISTER THE LOANS
Brad Liljenquist ask if ECIPDA will administer the loans. The mayor
told him yes.
RE: APPROVE LEASE -PURCHASE
The mayor reminded the council that when we budgeted this year we
budgeted for some office equipment which needs to be put on a
lease -purchase financing.

2) IBM 401 Laser Printer
3) IBM 3477 CRT's (3)
4) Recoh 5560 Copier
The best rate was West One Bank. The purchase price is $20,316 with
$8000 down, the lease needed $12,316. It would be financed over one
year, with one payment due on February 1, 1991. Brad Liljenquist ask
how many bids we got. Richard Horner said we had all the banks in town
bid on the financing of equipment. A motion was made by Nyle Fullmer
and seconded by Farrell Young to approve this lease -purchase. All Aye.
RE: ROAD CLOSURE ON MILLHOLLOW
The mayor stated that we have advertised for a Hearing for the Road
Closure on Millhollow on January 17, which is the same night as the
Farmers Merchants Banquet. Glen Pond said if we have advertised it so
we need to have it. Mayor Boyle said we could have it and then adjourn
it to another time. Glen suggested that we start the council meeting
at 8:00 P. M.
