A motion was made by Nyle Boyle and seconded by Bruce Sutherland to
approve the minutes, All Aye
One of the scouts present led the pledge to the flag.
RE: JUNK FOOD HEAVEN
Leonard Lemning, operator of Junk Food Heaven, was at the meeting to
make a request. He has another sight he wants to aperate his
business. Mr. Lemning said he talked to the people who have the old
Seminary building, that is used for the handicapped children to get
permission to park his truck on the north side of the building in the
parking lot. He wanted to get permission with the city to allow this.
The council said they had no problem with that. He said he would get
permission from the principle first. Nyle Fullmer expressed the
council's appreciation for your willingness to work with them to find a
safe place to park his truck.
RE: CANVASS THE VOTES
The next item on the agenda to Canvass the votes. Election results
attached. A motion was made by Darlene Blackburn and seconded by Nyle
Fullmer to approve the canvass of the votes with winners as announced.
All aye.
RE: BUDGET FOR VEHICLES
The mayor presented a resolution. We budgeted for some vehicles for
the city (copy attached). We are buying them on a lease purchase
agreement. We have to pass a resolution.
It is unanimously approved by the City of Rexburg, City Council, to
acquire and finance through West One Bank, Idaho, N. A. a Ford Pickup,
Two Police Cars, and a Suburban, costing $58,553.99 for a term of one
year at an annual percentage rate of 8.35%. The first payment of
$27,200.00 will be paid in advance, followed by one payment of
$34,581.73, due February 1, 1991. It was moved by Bruce Sutherland
and seconded by Darlene Blackburn to approve this resolution. All Aye.
RE: LID ~~26
We have completed all the work on the LID ~~26. It was the improvement
on West Main Street, 5th South and Shoshone Ave. The people in the LID
had so much time to pay their assessment. The amount of money that was
not paid in advance, we will borrow that amount on a ten year note.
The people in the district will be assessed. The interest we will
charge on these notes is 7 1/2 %. We have been issuing registered
bonds, instead of that we will issue promissory notes. Because of the
small amount it saves us quite a bit of money. We have to pass an
ordinance to allow us to do this.

AN ORDINANCE CONCERNING THE CREATION OF, IMPROVEMENTS IN, ASSESSMENTS
AGAINST PROPERTY IN, AND STREET IMPROVEMENTS REGISTERED WARRANTS FOR
LOCAL IMPROVEMENT DISTRICT N0. 26 FOR THE PURPOSE OF CAUSING CERTAIN
STREETS AND PARTS THEREOF WITHIN THE CORPORATE LIMITS OF SAID CITY TO
BE GRADED, RE-GRADED, PAVED, RE-PAVED AND OTHERWISE IMPROVE CERTAIN
STREETS WITHIN THE DISTRICT AND TO CONSTRUCT AND RECONSTRUCT SIDEWALKS,

CURBS, GUTTERS, DRAINAGE FACILITIES, AND OTHER WORKS INCIDENTAL TO ALL
OF THE FOREGOING IMPROVEMENTS WITHIN SAID DISTRICT, AND PROVIDING WHEN

RE: READING OF ORDINANCE N0.698
A MOTION WAS MADE BY Councilman Nyle Fullmer and seconded by Bruce
Sutherland that the rules requiring an ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 698.

Ordinance 698 was then placed before the council. The Mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded by Bruce Sutherland that
ordinance 698 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the City Council had
voted for the passage of said ordinance, and that said ardinance was
duly and regularly passed, Mayor Porter declared the motion carried.
RE: MANHOLE ON 5TH SOUTH
At the last meeting we discussed a manhole on 5th South that was
elevated. Farrell Davidson & De Lynn Edstrom went up and looked at
it. It is a sewer line that runs from that new development. The
manhole will just right for the street when it is developed. Rather
than lower it they will build up gravel around it.
RE: STEVE CLARK
We also had a letter regarding the construction of Steve Clark student
housing. The building inspector has check it and the eves are five
feet from the property line. He has check all the construction to make
sure it is according to the building code.
RE: NEW CENSUS
1990 is the year we have the new census. Rose has gone to a meeting on
it. They are having a regional meeting in Washington on it. No one
was able to attend.
The mayor told the council that the FEMA people will be here on Tuesday
RE; GEM COMMUNITY
Rexburg and Madison County have been designated a Gem Community. On
November 15 the Governor will be here at the courthouse. He will
present to the city and the county the designation of Gem Community.
RE: A GROUP WANTS TO BUY PROPERTY AND GIVE TO THE CITY
The mayor said he had been approached during the week by a group,
representing a group of people of 12 step organizations who are having
trouble finding a place to meet. One problem is a lot of them use
tobacco. They have their eye on the Kingdom Hall to meet. Their
meetings are quiet and there is a enough parking. They could have
meetings going on day or night. The problem is none of the groups can
own property. They want to :caise the money to buy the property and
give it to the city. The city could make it as part of the parks
program. They would take care of the heating. Bruce Sutherland ask
about the liability. The mayor said we could put it on our insurance,
on the blanket policy. Nile Boyle said we should check it out and if
anything is okay he did not see any problem. Nyle Fullmer said we
should have the attorney check it out. If it is checked out okay the
council had no problem with it.
RE: CROSSING GUARD ON 2ND EAST AND 3RD SOUTH
Bruce Sutherland said he had visited with Dorthea Young about a week
ago about 2nd East and 2nd South. Yesterday when he went up to the
Lincoln School he had visited with Jeff Hawks, Principal of Lincoln
School, concerned with that intersection especially in the morning.
There is about 41 students that cross that street. They would like us
to look into putting a 4 way stop at that intersection instead of at
3rd South. He had discussed with Mr Hawks a crossing guard or a
crossing sign put there. The mayor said he thought a crossing guard in
the morning would be the best. He said he had also received a call
from a lady who is concerned with the excessive speed along 1st North
from Adams School to the High School. We need to address the safety of
the kids.
RE: ARROWS PAINTED ON MAIN AND 2ND WEST
Nyle Fullmer said he was concerned with the intersection of Main and
2nd West, We need arrows painted and signs designating which lane is
for which direction of traffic is suppose to go.
A motion was made by Nile Boyle and seconded by Darlene Blackburn to
approve the bills. All Aye
RE: SELLING OUR OLD RADIO ANTENNA
The mayor said there is a Ham Radio Operator that wants to buy our old
radio antenna that we. had on the city hall before the explosion. It is
just stored down to Idaho Falls at Teton Communications. Nyle Fullmer
suggested that we check with the department heads to see if they have
any future need for it and if they don't go ahead and sell it.
