A meeting of the City Council for the City of Rexburg, Madison County,
held October .18, 1989, at 7:30 P. M. at the City Hall.

A motion was made by Nyle Fullmer and seconded by Bruce Sutherland to
approve the minutes. All Aye.
A group of scouts was at the meeting, Mayor Porter ask one of them to
lead the group in the Pledge to the flag.
RE: COTTAGE APARTMENTS ADDITION
We received a letter from the Attorney of Ross Farmer owner of
Greenbrier Associates Student Housing. He is concerned about the
Cottage Apartments addition, owned by Steve Clark. He wanted to make
sure that the zoning is correct. When the apartments were first built
the eves protruded over into 5 footage between buildings. The
foundation was 5 feet from the property line but the eves were about 18
inches protruding out in the 5 footage. He wanted to make sure that
was not done on the new construction. The building inspector went. up
and inspected it. He has assured the mayor that they are moving it
over two feet. He is also recommending that a drain be fixed under the
old building so it will drain that property so it won't go over onto
the Greenbrier property. Mr Farmer knew they couldn't do anything
about the old buildings but wanted to make sure the new buildings was
in compliance.
RE: VENDERS PARKING ON THE STREET
Bruce Casper told the council that down by the school on Main Street he
almost hit a student. We gave Junk Food Heaven a permit to sell on the
street. Now we have some Pizza people parking there vending on the
street. The kids are coming out around the vehicles and not paying
attention and getting in the street. He thought we needed to do
something about all of the venders parking on the street. The mayor
said the Pizza people came in and ask the mayor. Both business have
the same license to operate. The Health Department called and are
going to have some restrictions on the selling of Pizza. Glen Pond
suggested that we leave it up to the school. If they want them there
they can let them park in the bus lane or on the closed street.
RE: 2ND EAST PROJECT
Bruce Casper said as you go up 2nd East there is a 1/4 of a street that
goes between the water tower and the apartments, and then we have about
75 yard of gravel before the new black top and we have a manhole
setting up in the air about 6 inches to a foot with a red and white
barrel on it. He ask if we should be paving that street so we have a
through street. Nile Boyle told him the initial paving is done by the
property owners. The mayor said possibly before H & K leave they will
lower the manhole. The mayor said he would talk to De Lynn about it.
RE: BUILDING FOR THE FIRE ENGINE

Bruce Casper told the council that Chief Larson is upset about the
article that was put in Speakout about the new building they are
building for the Fire Engine. The East side of the building will be
cut out and there will be windows in it for people to see the Engine.
It will also be lighted on the inside and outside.
RE: RECYCLING FUND RAISING PROJECT FOR THE CAROUSEL
The mayor said if you go over to the J C Penny Parking lot there is a
building in the north side of the parking lot. It is to be used for
the recycling fund raising project for the Carousel. There will be 4
or 5 bins. They will ask people to sort their garbage and put the
recyclable articles in plastic bags and put in the bins and it will be
picked up once or twice a week. The money will be used for the
Carousel. It was built by Dick Davis on a volunteer basis, and the
material was donated by the lumber yards in Rexburg.
RE: GAS CARDS TO OPERATE THE RETAIL GAS SALES
The mayor discussed the gas tank Federal regulations. We decided to
use cards to operate the retail gas sales at the service stations. We
could then abandon our underground gas tanks. We also have to dig them
up and get rid of them. Don Watson from ECIPDA has been hired to tour
the state to present the rules and regulations. He went over it with
the mayor. We have Gordon Tychsen who is a qualified inspector. We
send in a notice to the state that we are going to take the gas tanks
out. The state man and Gordon Tychsen will inspect the sight to see if
there has been any gasoline leakage and if there has we will have to
dig deeper. We then fill the tanks with water and empty them out and
then you need to get someone who has expertise to put a stick of
dynamite in and blow the ends out and then we can dispose of them. Mr
Watson suggested that we do it as soon as possible. After the first of
the year there will be more rules and regulations that will make it
more difficult. The council agreed to go ahead.
RE: 4-WAY STOPS UP ON 2ND EAST
During the past couple of weeks since the 2nd East has been finished we
have received calls about the traffic, speed and the trucks on that
street. In checking it there is an increase of traffic. We have had
the police make a radar check every day. They have given out tickets.
They have also averaged the speed. The fastest is 42 mile per hour,
and the average is about 27 miles per hour. There is a petition going
around to have the council install some 4 way stop signs at 2nd South
and 3rd South. It was the mayor's recommendation that we immediately
install a 4 way stop at 3rd South as a temporary measure. In the
winter the grade is such that people going south might not be able to
start up. The council discussed it. Glen Pond discussed the
pedestrian traffic crossing on 2nd South and possibly it should be at
that intersection. They discussed a three way stop. Bruce Sutherland
said it could be dangerous. They discussed getting the school to put a
school crossing guard at that corner. Nyle Fullmer said a stop sign at
3rd South would be more expectable because of the grade. A motion was
made by Nile Boyle and seconded by Bruce Sutherland to put a 4 way stop
at 3rd South on a temporary basis and have the Traffic Safety Committee
study it. The mayor called for a vote. All Aye.
RE: SIGN REMOVED
Nile Boyle told the council there is an ugly sign in front of Beverly
Hanson's and Margaret Barrick's house and wondered if it could be
removed. The mayor said he would talk to Farrell about it.
RE: 18 WHEELER TRUCKS ON 2ND EAST
The mayor said there are a lot of 18 wheeler trucks going on 2nd East.
Most of them are ones that service the college. He had contacted the
college to have them go another route.

RE: ORDER TREES FOR 2ND EAST

Bruce Sutherland ask if the landscape contractor had received the
changes on the trees. We need to make sure they get the the trees
ordered.
RE: DRUG FREE WEEK
Last year the City sponsored a Red Ribbon tag for Drug Free Week. The
FBI is putting on a program at the Holiday Inn in Pocatello at 6:00 P.
M. on October 26. The mayor suggested that we buy gas for a car load
of Drug Free Group to attend the meeting. The council agreed. The
mayor said he would contact them.
RE: ZONE CHANGE
The mayor read Ordinance 697 making the zone change from Commercial to
R3 on South 5th West just south of Les Schwab Tire.
ORDINANCE 697
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF
REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATIONS OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG, MADISON
COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN
THIS ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by Councilman Bruce Sutherland and seconded by Nyle
Fullmer that the rules requiring an ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 697.

Ordinance 697 was then placed before the council. The mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded by Nile Boyle that.
ordinance 697 be passed.

The roll showed all councilmen present voting "Aye" carried, the mayor
declared that the majority of all the members of the City Council had
voted for the passage of said ordinance, and that said ordinance was
duly and regularly passed. Mayor Porter declared the motion carried.
A motion was made by Nile Boyle and seconded by Bruce Casper to pay the
bills. All Aye
RE: MEETING TO DISCUSS PROPERTY
The mayor told the council that we need to have a meeting to discuss
some property. The meeting is set for Tuesday morning at 7:30 A. M.
RE: ENFORCE PARKING ON SIDE OF THE STREET ON CORNELL
Glen Pond said we need to enforce the parking on one side of the street
on Cornell. It needs to be patrolled especially on Sunday.
