A meeting of the City Council for the City of Rexburg, Madison County,
held October 4, 1989, at 7:30 P. M. at the City Hall.
Present were the following: Mayor: John C Porter
Councilmembers: Nyle Fullmer
Nile Boyle
Glen Pond
Darlene Blackburn
Bruce Sutherland
Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
A motion was made by Darlene Blackburn and seconded by Nyle Fullmer to
approve the minutes. All aye.
Pledge to the flag was given by a councilman.
RE: INSURANCE
We were insured with First Far West Insurance. The Claims are being
paid by the Department of Insurance of Oregon State. The agent had
under billed us. And he was going to make the money up himself because
he had bid lower than the actual cost of insurance. The Insurance
Department of the State of Oregon has written us and informed us that
we owe $6414.01. They are holding up some claims until that is paid.
The State of Idaho is in the process of holding a hearing with that
agent. We possibly have $10,000 worth of claims out.
RE: AGREEMENT FROM THE AUDITORS
We have an agreement from the Auditors, it is the same as a year ago
with a 4~ increase. It should not exceed $8600 plus federal grants to
be audited. A motion was made by Glen Pond and seconded by Bruce
Sutherland to except the agreement. All Aye
RE: AGREEMENT WITH THE STATE OF IDAHO
We have an agreement with the Treasurer of the State of Idaho where we
can take surplus funds and invest them with the State of Idaho. We
call a number and within 10 minutes the money is transferred to our
bank. They have some new rules and we have to sign a new agreement. A
motion was made by Darlene Blackburn and seconded by Glen Pond to
approve the agreement with the State of Idaho. All aye.
RE: BIDS FOR POLICE CARS
The bid opening for the Police Cars.

The specs were checked out. They are regular police cars with
equipment. A motion was made by Bruce Sutherland and seconded by
Darlene Blackburn to except the low bid with Madison Ford. All Aye.
RE: 2ND EAST STREET OPEN FOR PUBLIC
2nd East is now open for public use. There is a lot of traffic on it.
The police have been running a radar check. On 9/22/89 there were 5
warnings and 2 speeding tickets given. The speed is being kept under
control.
RE: DAVE THIBAULT
Nyle Fullmer told the council, the city has sent Dave Thibault to
school this summer and he is second in command under DeLynn Edstrom in

the water department. He will be doing all the environmental testing
for the water and sewer department. He isn't up for a step raise, but
we would like to give him a step raise and give him a title so we could
do that. We would call him the Assistant Water Superintendent. Glen
Pond said it should go before the Personnel Committee first. The mayor
said it isn't a step raise but a change in status. The mayor said we
would recommend the change to the Personnel Committee and if they
approve it give it to him. All Agreed.
RE: GAS TANKS VS. PUMP CARDS
We have to replace all the underground gas tanks. We have three tanks,
two at the street department and one by the city hall. It would be a
big expense to replace them. We would have to carry insurance and have
them inspected every year. It would cost about $1500 each year per
tank. ECIPDA has been given a grant to study and make recommendations
about the gas tanks. Don Watson from ECIPDA recommend instead of
changing the tanks we buy gas through stations. Three stations have
pump cards that have 24 hour access. Richard called the three stations
to see if they would discount the gas because of the volume. One
wouldn't, one is considering it and one Madison Coop, will sell it to
us for a ~ above the tank price. We would save money going this
route. We would have a card for every vehicle. It would have the date
and usage on each vehicle. The mayor suggested that we set up a
meeting with. Don Watson for a morning meeting and go over it. We have
to dig up the tanks and dispose of them and if there is any leakage we
will have to clean it up. It was okay with the council.
RE: FEMA
J. D. Hancock told the council he had a letter from FEMA and we need to
set up a meeting to discuss it.
RE: ZONE CHANGE
8:00 P. M. Public Hearing on the Zone Change from Commercial to R3 on
said properties located at 447 South 5th West and 455 South 5th West.
Rodney Matson was at the meeting to to request the zone change. He was
in the process of purchasing the home and found it was zoned commercial
which made the payments too high. No one was at the meeting to
protest. A motion was made by Nyle Fullmer and seconded by Darlene
Blackburn to change the zone from commercial to R3. All Aye.
RE: VARIANCE
8:05 P. M. Public Hearing for a variance for a garage to be constructed
on the following described property within three feet from the east
property line adjacent to the parking lot on the property owned by Reed
Wyatt. That said property is located at 340 West 2nd South. No one
was there to protest. A motion was made by Bruce Sutherland to approve
the variance and seconded by Nyle Fullmer. All Aye
