A meeting of the City Council for the City of Rexburg, Madison County,
held September 20, 1989, at 7:30 P. M. at the City Hall.
Present were the following: Mayor: John C Porter
Councilmembers: Bruce Sutherland
Nyle Fullmer
Darlene Blackburn
Glen Pond
Nile Boyle
Absent: Bruce Casper
Pledge to the flag was led by J. D. Hancock.
A motion was made by Bruce Sutherland and seconded by Darlene
Blackburn. All Aye.
RE: CONTRIBUTION
Glenn Pond questioned the contribution of $500 to the Chamber of
Commerce and Madison County Boosters as discussed. in the last council
meeting. Mayor Porter told him that they did not get the tournament in
Rexburg so we would not need to contribute.
RE: ZONE CHANGE
Mayor Porter read the Ordinance changing the zoning on the Neal Brown
property on Center and West 2nd South, from R2 to R3.
ORDINANCE NO 695
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF
REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATIONS OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATE IN REXBURG, MADISON
COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN
THIS ORDINANCE SHALL BECOME EFFECTIVE.
RE: READ ORDINANCE N0. 695
A motion was made by Councilman Nyle Fullmer and seconded by Bruce
Sutherland that the rules requiring an ordinance of a general and
permanent nature to be read on three occasions be dispensed with and
that said ordinance be numbered 695.

RE: ORDINANCE 695 PASSES
Ordinance 695 was then placed before the council. The mayor then
called for the voting of final passage of the Ordinance, and the motion
was made by Nile Boyle and seconded by Bruce Sutherland that ordinance
695 be passed.

The roll showed all councilman present voting "Aye" carried, the Mayor
declared that the majority of all the members of the City Council had
voted for the passage of said Ordinance, and that said Ordinance was
duly and regularly passed. Mayor Porter declared the motion carried.
Mayor Porter read a Resolution Approving an Amended
Multi-Jurisdictional PRETREATMENT Agreement Between The City of Rexburg
and The City of Sugar City: Authorizing the Mayor and City Clerk To
Execute Said Agreement: and Providing An Effective Date.
(copy of resolution on file) A motion was made by Nile Fullmer and
seconded by Darlene Blackburn to approve the resolution the changes in
the agreement. All Aye
RE: CONTRACT WITH ECIPDA
We have had a contract with ECIPDA to monitor the Nursing Home and
Ultimate Directions and they want to have it extended for two more
years. A motion was made by Bruce Sutherland and seconded by Nyle
Fullmer to extend the contract for two more years. All Aye
RE: MARY ANN MOUNTS NEW MEMBER OF PLANNING & ZONING
Barry Genta has resigned from the Planning & Zoning Board. Glen Pond
has suggested Mary Ann Mounts to serve on that board. A motion was
made by Glen Pond and seconded by Bruce Sutherland to approve Mary Ann
Mounts as the new member of the Planning & Zoning board. All Aye
RE: SOLD THE BONDS FOR LID 26
The mayor told the council that we have sold the Bonds for LID 26, the
total amount was between $90,000 and $100,000 the interest rate is 7
1i2~.
RE: 2ND EAST PROJECT
Mayor reported on 2nd East. They put the tact coat from 17th to the
student dorms. They also started laying some oil on the other end.
They will try to have it done by Monday or Tuesday on next week. They
will do the seal coat next spring, at that time they will paint the
cross walks and stripe the road, and in the approach at the
intersections is suppose to be plastic and that will be done in the
spring. Under the contract the old traffic signs is to be put back
up. They want to replace all the metal traffic sign post with a 4'x4'
treated post.
The College Homecoming parade was to go down that street, but the mayor
contacted the college and they have an alternative plan.
RE: SENIOR CITIZENS BUS
The Senior Citizens Bus is under new regulations and the bus has to be
bid. There will be a notice run in the paper. After reading the
specifications, it will make it hard for anyone making a bid except
KART. So next year KART will be operating the Senior Citizens Bus.
RE: MONUMENT TO HONOR THE FIRST SCHOOL IN REXBURG
Denise Rommell, head of the daughters of Utah Pioneers, was in the City
Hall and they want to put up a monument to honor the first school in
Rexburg. They want to put up the monument at the Pump House. The
first school was in the first or second house just north of the Pump
House. It was in the home of one of the Ricks wives. The council
okayed it.
RE: ORGAN AT TABERNACLE
Mr. Pool, the man who is repairing the organ, is over to the tabernacle
putting in the pipe organ. It should be in by the end of the week and
be working.
RE: DEARDENS

Mayor reported that he, Chief Siepert, and the k9 Officer went before
the judge to defend the city against the Deardens for the suit about
the cat.
RE: PARKING AT HARMONY HOUSE
Nyle Fullmer said he was concerned about the parking at the new
addition at Harmony House. He felt that if he has space for the
additional parking he needs he should take care of it now. Nyle said
he had talked to the Monteaus, and he has not dealt nicely with them.
Mayor Porter said the Planning & Zoning had went over it. He has space
for parking but would have to take out his green belt. Bruce
Sutherland said we get to a certain point and should put our foot
down. Nile Boyle read the Planning & Zoning minutes. Nile suggested
that we need to give him a set time to adhere to the ordinance. Nyle
Fullmer made a motion that we send him a letter that he has to be in
compliance within 90 days. Glen Pond said the Planning & Zoning was
concerned about the green belt. The mayor said in the ordinance it
states that if he needs more spaces he will have to rent more spaces
within 1000 yards. Nyle Fullmer said if he rents more spaces he needs
to prove that he has these additional spaces. Nile Boyle said he felt
that it is too late this fall and we should give him until spring.
Nyle Fullmer withdrew his motion. A motion was made by Nile Boyle and
seconded by Bruce Sutherland that Mr Flukinger be required to be in
compliance by June 1, 1990.

RE: STOP SIGNS ON 2ND EAST
Nile Boyle said the people on 2nd East have talked to him about putting
stop signs on 2nd East. He ask Bruce Sutherland to have the Safety
Committee look at it. He wondered if the grade had been changed so
they might change the 4 way stop from 1st South and 2nd East to 2nd
South and 2nd East.
A motion was made by Nile Boyle and seconded by Glen Pond to pay the
bills. All aye
