MINUTES OF THE CITY COUNCIL MEETING
8/2/89

A meeting of the City Council for the City of Rexburg, Madison County,
held August Z, 1989, at the City Hall.
Present were the following: Mayor: John C Porter
Councilmembers: Nile Boyle
Bruce Casper
Glen Pond
Bruce Sutherland
Nyle Fullmer
Darlene Blackburn
Also Present: Mary Smith, Attorney
Rose Bagley, City Clerk
A motion was made by Nile Boyle and seconded by Darlene Blackburn to
approve the minutes. All Aye.
RE: GET ESTIMATE ON PAVING DIRT ROAD ON 3rd NORTH
Dale Hope was at the meeting to make a request. He lives on 3rd North,
it is still a dirt road. It is the back way to the fair grounds, main
road for the concrete truck, and city trucks. There is always a cloud
of dust. We can't have cooks out or hang clothes out on the line. The
road was treated but it does not work because there is too much gravel.
He wondered if there was someway they could get the road paved. The
mayor told him we have tried to get a project and LID to pave that
street, but there isn't enough people on the street to pay on the LID.
Mr Hope said he thought the city, county and Walters could get together
and it wouldn't cost that much to pave that road. Nyle Fullmer
suggested that we get an estimate on the cost of paving it. The mayor
said we could get an estimate on the cost of coal mix for the road
without a curb and gutter. The mayor told him we would see what we can
do.
RE: PUBLIC HEARING
Glen Pond gave a report on the Planning & Zoning meeting. All the
Planning and Zoning members approved the variance and zone change, so
we can go ahead with the Public Hearing on the Brown Property.
RE: ZONED FOR TRAILER COURT
Glen told them there was a lot of concerned citizens about the
Trailer Court on 5th West. The Planning & Zoning and Building
Inspector assured the neighbors that they would insist that they follow
the ordinance. It is zoned for a trailer court.
He reviewed the Harmony House parking plans.
RE: OCCUPANCY PERMIT
He reported that Mary Smith wrote a letter to Steve Clark telling him
he had to come into compliance. She will write another letter telling
him he will have to be in compliance by August 15 before he would be
given an occupancy permit.
RE: PLANT TREES ON 5th WEST
The mayor reported that they were going to plant trees on 5th West by
Squires Brick and Able Industries. They would plant May trees. We
would have to wait until the hot weather is over before we plant them.
RE: TRAFFIC SIGNALS

The mayor said he met with the Highway Department. They want to
modernize the traffic signals on Main and 2nd East and at the Adams
School. It would be no cost to the City except two flag men. Farrell
said while we are doing this we need to put in the handicapped ramps at
the Adams School and at lst East. At the crossing at the Adams School
when the big trucks turn the corner off of 1st North going on 2nd East
the wheels tear up the road. Farrell suggested that we put in
concrete. We will have to work with the State Highway Department on
that.
RE: PROBLEMS WITH NELSONS PIGS
The mayor told the council that another problem we have is the pigs on
the Nelson property. We called the Nelsons in, and they have evidence
that they have had pigs there all the time and claims they are
grandfathered. The ordinance was passed in 1967 and the property was
transferred to the children in 1965. They claim that they have had
continuous ownership and they have had at least one pig there all the
time. Now there is a problem, they have three pigs and those pigs have
had little pigs. Instead of keeping them in the barn, they have them
outside. Kwenden Nelson was cooperative but his brother was not.They
did say they would clean it up. Glen Pond said he wondered if when Mr.
Nelson was there if he had pigs at the time of the flood, they would
not have been there. A motion was made by Glen Pond and seconded by
Nyle Fullmer to enforce the ordinance and if need be go to court. All
Aye.
RE: WATER LINE BROKE
Mayor Porter told the council that Leon Gutierrez had a water line
break last winter. The rule i.s when the break shows up when they read
the meter after the winter we give them a credit of 1/2 the increase of
the first bill. If they don't get it fixed after the leak is found,
they have to pay the bill. These people let it go another month,
because they had hired Wayne Parkinson to dig it up and he was busy and
couldn't do it for a while. A motion was made by Nyle Fullmer and
seconded by Nile Boyle to give them credit of 1/2 the increase for the
second month. All Aye
RE: DAMAGE DURING THE WIDENING OF 2nd EAST
Mayor Porter told the council that we have a letter from Devon and Kaye
Ivie who own some apartment buildings located on 2nd East and 1st
South. They claim they sustained considerable damage during the
widening of 2nd East. The mayor said the city would deny the claim. H
& K Contractors are making a list of claims and have an adjuster
checking them out.
RE: DAMAGE DONE TO WINDSHIELD
Nyle Fullmer said Bryce Bell talked to him about damage done to his
windshield from a rock hitting it during the construction. He does not
feel he should have to pay the deductible. The mayor said he should
present the claim to H & K.
A motion was made by Bruce Sutherland and seconded by Nile Boyle to pay
the bills. All Aye
