State of Idaho) County of Madison( City of Rexburg) A meeting of the City Council for the City of Rexburg, Madison County, held March 8, 1989, at the City Hall. Present were the following: Mayor: John C Porter Councilmember: Nile Boyle Bruce Casper Bruce Sutherland Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by Darlene Blackburn and seconded by Bruce Casper to approve the minutes. All Aye. RE: EXTENSION ON HARMONY HOUSE Jay Flukinger was at the meeting, he has a proposal to extend his apartments, Harmony House, to the south. In order to do this he would need to buy the three houses on the south on 2nd South. They are zoned. R2, in order to build the apartments the zoning would need to be changed to R3. A petition had been taken out to the people within 300 feet. The only objections we got was people that thought he might put parking on College Ave. They did not really object to the apartments. He would have enough parking according to the new ordinance. A motion was made by Nile Boyle and seconded by Bruce Casper to set a public hearing for the zone change. All Aye RE: PLANNING AND & ZONING REPORT Rose Bagley reported on the Planning & Zoning Meeting. RE: RESOLUTION FOR GOLF COURSE TO LEASE PURCHASE EQUIPMENT The mayor told the council that we approued a resolution about two months ago to allow the Golf Course to make lease purchases of some equipment. At that time the council wanted to know before anything was purchased, as to what it was going to be. The things they need to purchase now are: Jacobson tees mower Kawasaki utility trailer Jacobson 7-gang reel 2 year warranty extension Heston tractor Total purchase price: $47,390.55 The golf course plans on paying for this out of their Golf Course revenue. We have a lease purchase agreement with Idaho First National Bank. The interest rate was 7 1/2 %. A motion was made by Nile Boyle and seconded by Bruce Casper to approve the purchase agreement with Idaho First National. All Aye RE: US WEST AGREEMENT Three years ago we entered into a agreement with US West for a phone system, ECSI Executone, it has worked out very well. That agreement to operate that phone system has expired. They have another contract that they have brought into us. If we sign this agreement for a period of about 5 years we will get it for about 3% less money than we have gotten it for. A motion was made by Nile Boyle and seconded by Darlene Blackburn to authorize the mayor to sign the agreement. All Aye RE: ORDINANCES FOR UNIFORM BUILDING, PLUMBING & FIRE CODES. The mayor told the council that we need to pass some ordinances to adopt the Uniform Building, Plumbing and Fire Codes. Ordinance 688 for the Uniform Building Code for 1988 AN ORDINANCE REPEALING SECTION II OF ORDINANCE N0. 670 OF THE CITY OF REXBURG; ADOPTING THE UNIFORM BUILDING CODE, 1988 EDITION, TOGETHER WITH AMENDMENTS AND REVISIONS THEREOF WITH THE INCLUSION OF APPRENTICES; REQUIRING COPIES OF SAID CODE TO BE KEPT IN THE OFFICE OF THE CITY CLERK; ALSO PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. A motion was made by Councilman Bruce Casper and seconded by Bruce Sutherland that the rules requiring an ordinance of a general and permanent nature to be read three occasions be dispensed with and that said ordinance be numbered. Those voting aye: Nile Boyle Bruce Casper Bruce Sutherland Darlene Blackburn Those voting nay: None Those absent: two Ordinance 688 was then placed before the council. The mayor then called for the voting for final passage of the ordinance 688 be passed. Those voting aye: Nile Boyle Bruce Casper Bruce Sutherland Darlene Blackburn Those voting nay: None Those absent: two The roll showed all councilmen present voting "Aye" carried, the mayor declared that the majority of all the members of the City Council had voted for the passage of said ordinance, and that said ordinance was duly and regularly passed. Mayor Porter declared the motion carried. Ordinance 689- Fire Code AN ORDINANCE REPEALING SECTION II OF ORDINANCE N0. 672 AND ADOPTING THE UNIFORM FIRE CODE, 1988 EDITION, COPYRIGHTED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND WESTERN FIRE CHIEFS ASSOCIATION;REQUIRING COPIES OF SAID CODE TO BE KEPT IN THE OFFICE OF THE CITY CLERK; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. Mayor Porter declared the motion carried. 1 Ordinance 690- Plumbing Code AN ORDINANCE REPEALING SECTION II OF ORDINANCE NO. 673 AND ADOPTING THE UNIFORM PLUMBING CODE, COPYRIGHTED BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, 19.88 EDITION, FOR THE CITY 4F REXBURG, IDAHO; REQUIRING COPIES OF SAID CODE TO BE KEPT IN THE OFFICE OF THE CITY CLERK; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILITY: ANIJ REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES. IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME: EFFECTIVE. Mayor Porter declared the motion carried. Mayor Porter made a report on the trip to Washington to see about canceling the FEMA Loan. Discussion on Health Insurance will be at the next meeting. Those present were: Mayor: John C Porter Councilmembers: Nile Boyle Bruce Casper Nyle Fullmer Darlene Blackburn Bruce Sutherland Also Present: Mary Smith, Attorney Rose Bagley, Clerk Richard Horner, Treas. Mayor Porter discussed George Flint, he suggested that we keep him on the insurance for one ar two months until we get it settled. We will not pay him a salary during that time. He suggested that we help him get on the job training or training from the votec. We can't let him drive ar work on the Sanitation Department anymore because of his health condition. Mayor Porter made a report on the trip to Washington D.C. They met with the Senators. Met with the Justice Department, with the man handling it and went over it with him, and told him whey we thought it should be canceled. They met with the Attorney of Public Works and went over it. He felt the case was just. In September they might can get a bill in with an amendment to forgive us of the obligation. The bill would have to be signed by the President. The Attorney of Public Works agreed to discuss it with members of the commerce. We met with Jack Jarard from Mc Clures office. J.D. Hancock had a friend there who was 2nd man in the Legal Department of the Commerce Department. He told J. D. that it was a political matter. Sims and Mc Clure are on the appropriation committee. When the justice appropriation is made they can insert a clause saying they can't use any of this money to prosecute the City of Rexburg. The mayor told them if we have to pay the claim it will jeopardize airport extension. It will jeopardize our bonding capacity. It will jepordize us being able to keep the Diet Center in Rexburg. It would effect all of Idaho. The mayor had talked to Gerald Taylor and was going to talk to Richard Smith and Roger Ferguson and get them to write letters about effecting the airport extension. Mayor Porter told the council that First Far West Insurance has gone Bankrupt. We have a letter from Dave Cleverly and he says we are okay. Mary has called the State Insurance Commission and they are investigating it and don't seem too alarmed. We haven't paid this month bill. The dental and eye are with a different company. It was discussed if we should continue with the insurance for the month of March. We have talked to Blue Cross and Blue Shield and they agree that they will cover all the bills from the 1st of March if we go with them. We will try to continue the investigation until. the next meeting on the 15th of March.
