Minutes of The City Council Meeting
February 1, 1989
A meeting of the City Council for the City of Rexburg, Madison County,
held February 1, 1989, at the City Hall.
Present were the following: Mayor: John C Porter
Councilmembers: Glen Pond
Bruce Sutherland
Nyle Fullmer
Bruce Casper
Nile Boyle
Also Present: Mary Smith, Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A motion was made by Bruce Sutherland and seconded by Bruce Casper to
approve the minutes. All Aye.
RE: ORDINANCE 686
Mayor Porter stated that we have had before us in the last two meetings
Ordinance 686 AN ORDINANCE REQUIRING A STATE CONTRACTOR'S LICENSE TO
ENGAGE IN THE BUSINESS OF A PLUMBING CONTRACTOR; PROVIDING THAT THE
PERMIT FEES SHALL BE ESTABLISHED BY THE CITY PLUMBING BOARD; PROVIDING
THAT THE CITY SHALL NOT BE HELD TO ASSUME ANY LIABILITY BY REASON OF
INSPECTION, REQUIRING A CITY LICENSE BEFORE ENGAGING IN WORK OR
BUSINESS REQUIRING A CITY LICENSE FEE; PROVIDING FOR THE ISSUANCE OF A
MASTER PLUMBER'S LICENSE, THE RENEWAL OF A MASTER PLUMBER'S LICENSE,
APPRENTICE REGISTRATION AND WORK SUPERVISION.
All the plumbing contractors in Rexburg have had an opportunity to look
the ordinance over, and do not have any objections to it. The mayor
said the ordinance is now before the council for the third reading.
Ordinance 686 was then placed before the council. The Mayor then
called for the voting for final passage of the ordinance, and the
motion was made by Nyle Fullmer and seconded that ordinance 686 be
passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor
declared that the majority of all the members of the City Council had
voted for the passage of said Ordinance, and that said Ordinance was
duly and regularly passed. Mayor Porter declared the motion carried.
RE: SCOUTS
The mayor welcomed the scouts.
RE: DRUG AND ALCOHOL COMMUNITY ORGANIZATION
Edie Miller,Linda Stoddard, and Bonnie Meyers were at the meeting.
They wanted to talk to the council about a community organization that
will help to fight Drug and Alcohol Addition to educate people not to
use drugs and alcohol. Chief Blair Siepert was also at the meeting to
discuss the problem. He had a chart and gave a presentation. The
chart shows that we are on a steady increase. He said we do have a
problem, and the law enforcement is concerned. They have made it a
point that everyone under 18 years of age, when we pick them up we take
them to the office and notify the parents, and the parents come and
pick them up or they ask us to release them. The parents cooperation

has been good, there has been very few that have been negative. Some
that is the last time we see them but obviously there are some coming
back as repeaters. We are not getting to that type of youth for some
reason. The Judge has expressed concern and we feel that he is going
to put some pretty stiff penalties on. He said they are patrolling the
dancers heavier. That is where we are picking up some of the more out
of town students. Blair said he wanted them to know that we support
any type of program that will help as far as solving some of these
problems with the youth. He said in his department they are probably
giving two to three drug alcohol related talks per week. We are
handing out a lot of information. They had talked to kindergartens on
up to high school groups. He said he thought we should get to them at
a fairly young age.
The mayor said every quarter he attends the governers commission on
drug and alcohol awareness and advisory board. They are advised about
various programs that are going on in the state. These ladies are
concerned that in our own community there is awareness.
Linda Stoddard acted as spokesman for the group. She showed a flip
chart. The national average of encounter with alcohol is in the 4th
grade. A lot of problems start in the Junior High. That is why they
got involved at level as a PTA. As they became involved and started
some community awareness series, instead of PTA meetings, reams of
information have fallen into their hands. One statistic she told the
council was that marjuana stands next to potatoes as the cash crop in
Idaho. One problem we have in Rexburg is deniel, another is apathy,
the media needs to stand responsibility, there needs to be
alternatives, also lack of planning. What they see as a solution is a
comprehensive Community Action Plan. We need to develop our own plan.
There are three areas we need to be concerned about: the family, the
institution, and the community in the action plan.
She said the plan of choice has been in effect for 15 years. There is
a consultant who has been setting up programs unique to communities.
He comes in and trains and gives you information, he gives a four day
training and included in that is teachers, businessmen, church leaders,
citizens, lawyers, law enforcement, and the school. He will train 30
student counselers and they go back into the school and they can
recognize the symptoms of drug abuse and they steer those kids on a
level of three to six months earlier than when teachers or parents, or
law enforcements see it. They have decided to call the Action Plan
CAP, Comprehensive Community Action Plan. She said they needed some
people to help, they needed a steering committee of about 36 people.
The council can help by endorsing the plan and they need help for
volunteers. It needs to be self supporting. Madison School District
has applied for a grant. They have used a lot of that money for
videos, candy bars, and self-esteem things. They are trying to
coordinate the effort with the schools and the community. Mayor Porter
said he thought the ladies are interested in for example the Law
Enforcement People have a grant for law enforcement of drugs and
alcohol. In Rexburg we have the Accohol Rehabilatation Association,
and have a room in the Courthouse. There are a lot things going on but
no one knows about it. There needs to be some organization that
understands everything that is going on and try to get someone to do
something. There is federal money that is alloted to the schools.
There has to be somekind of coordination. Education is the thing that
is becoming most effective.
A motion was made by Nyle Fullmer and seconded by Bruce Casper to
endorse the program. All Aye
Nyle Fuller said he and his wife would help on the committee.
Chief Siepert commented that on a police level they see more effort
from the community to accept that there is a problem. Four or five
years ago when we would call parents to come and get their boy or girl
they would get upset but now it is accepted.
RE: RESOLUTION FOR DESTRUCTION OF SOME CITY RECORDS

Mayor Porter told the council that every year we have to pass a
resolution to authorize the destruction of some of the city records.

Nyle Fullmer to authorize the destruction of the records. All Aye
AT&T PAY TELEPHONE
AT&T has got in touch with the mayor and they want to do the same thing
with the pay telephones as ITI wanted to do. The mayor said if it was
okay with the council, he recommend that we go with AT&T for the pay
phones in Rexburg. A motion was made by Nile Boyle and seconded by
Nyle Fullmer to go with AT&T. All Aye.
RE: POLICE POST ACADEMY
All of our Police Officers have to go to the Post Academy and we pay
their salaries while they are at the academy, they pay everything
except the salaries. We feel that by paying their salaries and the
other expenses attached to this, the the officers that go to the
academy owe the city a certain amount of time after they go through
this certification program. Blair has made a Police Officer employment
agreement in which they agree to stay with the city for two years after
they go throughthe academy. If they don't then they have to pay so
much of this expense. The council discussed it. Blair said the
officers that have been to the academy are really in demand. The small
cities are loosing them. Blair said he felt that the officers did not
really get to be a good officer until he gets two years of experience.
He tries to give them on street experience for about six months, they
have to be certified within one year. That gives us a chance to feel
them out to see if they will make it as an officer. A motion was made
by Nile Boyle and seconded by Glen Pond to adopt the Police Officer
Employment Agreement. All Aye. Blair ask if it would be better to put
it in the Employee Manuel. The council agreed.
RE: SAFETY COMMITTEE REPORT
Bruce Sutherland reported that the Safety Commettee met. They got the
information from the police department on the intersection on lst South
and Center Street on the 4 Way Stop. They felt that it would be
counter productive to have a 4 Way Stop there. They will review it in
in six months. Mary Smith said she goes through that intersection
several times a day and people are treating that stop as a 4 Way Stop.
The people going North and South will stop for a minute and go right in
front of a car. Nyle Fullmer suggested that it would be a good idea to
label the stop signs TWO Way Stop. The council thought we should check
into that. Also the snow needs to be cleared from that intersection so
you could see the traffic. The snow needs to be cleaned from all the
intersections where it obstructs the view. Glen Pond said the trees
and shrubs by Albertsons are really bad for obstructing the view and
something needs to be done about it.
RE: AIRPORT BOARD MEETING
Nyle Fullmer reported on the Airport Board Meeting. Dave Furness has
asked to be released from the board. Richard Smith has been put on the
board. All of the members are excited to be serving on the board. The
airport board are all in favor of the extention of the airport. The
entire runway is in need of some serious repair. To go though and
re-surface the entire runway, we are looking at about two million
dollars; but it will cost about that same amount to re-surface the
runway and do the entire project. We are looking at getting 90~ of it
paid for with the federal funding. Nyle said the council needs to
decide what the decision is on the runway. Nile Boyle told him the
council had already done that possibly before he was on the council.
motion was made by Nyle Fullmer and seconded by Bruce Sutherland to
verbally endorce the program to expand the runway. All Aye We need
educate the public that we are not going after commercial aircraft.
RE: CONSERVATION PROGRAM

Glen Pond reported on a meeting with some people from the AIC,
Bonneville Power, and people from Idaho Falls about a conservation

program to include it in our building code. They have a building
standard for homes. They would like a building code so all homes have
to be built to this standard. They limit it to electrical heated
homes. A lot of contractors was there, but he did not get a feeling
that they were oppose to it. What advantage is it to the city. If the
city adopts it now they will put the money in to train the building
inspectors. One of the drawbacks that we have is if we go along with
it, the building inspector has got to be full time and very
knowledgeable. Nyle Fullmer said he had some contractors in talking to
him about it. Glen said he could not see a lot of advantage to it. We
need to put more study into it.
The mayor told the council that we are going to do some further study
on the rewinding program for energy saving and maintenance on the
pumps. Glen had some information on it that he gave to the council.
He said he had some reservations on it. They need to show us the
savings before and after. Nyle Fullmer said he talked to Delynn about
it and there are two pumps that need to be overhauled. DeLynn had given
him a letter to read on it with a list of some cities that have gone
this the program. Nyle planned on making some phone calls to check
into it.
RE: SUNBIRD COMMITTEE
Nyle Fullmer reported on going down to Arizona with the Sun Bird
Committee. They put together a better presentation, and revised the
slide presentation. We need to do everything we can to help them.
They would like the city to donate $1000. Mayor Porter said we have
$10,000 Economic Development in the budget which this would be a part
of, and he would recommend to the council that we go ahead and pay our
share.
RE: APPROVE BILLS
A motion was made by Glen Pond and seconded by Bruce Sutherland to
approve the bills. All Aye.
RE: CURFEW DISCUSSED
Bruce Casper stated that when he was in high school they had dances at
Teen Town and they had to be closed at 12:00. He is concerned that the
Galleria is open until 1:00 A.M. and 2:00 A.M. It was discussed. He
asked Mary if there is a curfew ordinance. Nyle Fullmer said he had
mixed feelings about it.

POI.! CE O1~'F ICER EMPLOYMENT AGREEMENT
Thls agreement, entered into this day of ,
1988, between herein referred to as the
EMPLOYEE and the City of Rexburg, a Municipal Corporation of Idaho,
herein referred to as the CITY.
WITNESSETH:
WIiEREAS, the EMPLOYEE desires employment with the CITY as a police
officer; and,
WHEREAS, the Parties recognize that there exist job requirements
which set this job apart from other types of city employment;
NOW TIiF.REFORE in consideration of the mutual promises contained
herein, the parties agree as follows:
1. The CITY agrees to employ the EMPIAYEE as a police
officer at a starting salary of ; per
month.
2. The EMPLOYEE understands that his employment is on
probationary status for a period of up to one year
and agrees to comply with all City employee rules,
all policies of the Rexburg Police Department, and
all laws.
3. The EMPLOYEE hereby agrees to reimburse the City far
salary earned by the EMPLOYEE while the EMPLOYEE was
at. the P.O.S.T. Academy .if the EMPLOYEE should term-
inate employment or should willfully cause termination
within two years of the date of employment. The amount
reimbursed will be prorated under the following sch~~dulc~:
- Tess than one year employed: full reimbursement
- one year to eighteen months employed: fifty perccant
(50x) of salary reimbursed.
- eighteen to twenty-four months employed: twenty-flue
(25X) of salary will bs reimbursed.
4. Pursuant. to Federal law and Bxecutive Order 11246, EMPIAYEE
hereby waives any right to payment of overtime during the
period EMPLOY88 is attending basic training at the P.O.S.T.
Academy.
5. EMPLOYEE hereby agrees to return all equipment issued to him/
her within three (3) days of the date his/her employment term-

inates. The parties agree that BMPLOYEB shall pay, and the
C1TY shall accept, a penalty of one hundred dollars (100) per
day for each day that City equipment or clothing is withheld
by EMPLOYEE in violation of this agreement. The parties fur-
ther agree that if it is necessary for the CITY to take legal
action to seek specific performance of this provision or dam-
ages, the EMPLOYEE shall pay the reasonable costs and attorney
fees incurred by the CITY. The EMPLOYEE also consents to the
CITY retaining his/her final paycheck until all equipment. is
returned.
6. This agreement shall be in effect from and after its passage,
approval and publication according to iaw.
