A meeting of the City Council for the Gity of Rexburg, Madison County,
held December 21, 1988, at the City Hall.

A motion was made by Nile Boyle to approve the minutes with one
correction. Where is talks about Dar Mickelsen, it should read "If we
can use his piping, but if we can't because of drainage problems, he
will have to participate in the LID." Seconded by Bruce Sutherland.

RE: BEER LICENSES APPROVED

Mayor Porter read the following beer licenses for approval, for sale of
canned and bottled beer for not consumption on the property.Payless Drug
Rays Service Station
Chips Country Market
A motion was made by Darlene Blackburn and seconded by Nile Boyle to
approve the licenses. All Aye.

RE: ANNEXATION OF LAKES GOLF COURSE
Mayor Porter said we now have unanimous approval from the County
Commissioners to pass the annexation ordinance to annex part of the
je Tc~L Lakes Golf Course into the city. Nile Boyle said Doyle Walker did
not want the County sheds annexed and did not want the annexation
extended into the buffer zone.
Mary Smith read ordinance 687: AN ORDINANCE ANNEXING CERTAIN LANDS TO
THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A
PART OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING MAP OF THE
CITY OF REXBURG, IDAHO, TO SHOW SUCH ANNEXATION AND THE CLASSIFICATION
OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO,
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.

Nile Boyle said there is a little three corner piece of property
belonging to the county that will be annexed, but no other property
except golf course. Mary said it would be zoned R1 class 2 used as
public golf course.
A motion was made by Councilman Nile Boyle and seconded by Nyle Fullmer
that the rules requiring an ordinance of a general and permanent nature
to be read on three occasions be dispensed with and that said ordinance
be numbered 687.

Ordinance 687 was then placed before the council. The Mayor then
called for the voting for final passage of the Ordinance 687 be passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor
declared that the majority of all the members of the City Council had
voted for the passage of said Ordinance, and that said Ordinance was
duly and regularly passed. Mayor Porter declared the motion carried.
This annexation will include the well and the back nine and up to the
club house.
RE: PLUMBING LICENSE
Mayor Porter reviewed Ordinance 686, for contractors licence for
plumbing. It will require all the plumbing firms that come to Rexburg
from out of the city have to be licensed in Rexburg. Mary Smith
introduced the ordinance and read it for the first time.
Mayor Porter said we would just introduce it tonight and then give the
plumbers a chance to review it. If they want any changes made, we can
amend it before we pass it.
RE: STUDENT PARKING
Ordinance on student parking 676. It would provide .7 spaces, which
measure a minimum of 9' x 20' for each occupant of a dwelling unit.
Mary read Ordinance 685: AN ORDINANCE AMENDING PARAGRAPH 6 OF
SUBPARAGRAPH DESIGNATED AS "Off-STREET PARKING SPACES REQUIRED" OF
ORDINANCE NO. 478, WHICH ORDINANCE IS DESIGNATED AS THE ZONING
ORDINANCE FOR THE CITY OF REXBURG, IDAHO.
The mayor says what it does is it provides for .7 spaces, but if the
owner rents to students so that the number of cars owned by the
students exceeds that, he will have the responsibility to find
parking for them, and not just leave them parked around the streets.
This makes the owner of the property where the kids are renting
responsible.
This ordinance will amend Paragraph 6 in Ordinance 476 on student
parking. The planning board is working on an off street parking
ordinance that will include a lot of other things on parking. They
thought if we could amend this and get it going so if someone comes in
and wants to build another apartment, their parking will be regulated.
A motion was made by Councilman Glen Pond and seconded by Nile Boyle
that the rules requiring an ordinance of a general and permanent nature

RE: STUDENT HOUS-ING
The city attorney reviewed the Inspection of Rental Housing Safety
Ordinance 684. AN ORDINANCE RELATING TO THE SYSTEMATIC INSPECTION OF
RENTAL HOUSING;SETTING FORTH THE PURPOSE OF THE ORDINANCE; ESTABLISHING
DEFINITION OF TERMS: REGISTRATION REQUIREMENTS AND MANNER OF
REGISTRATION; TRANSFER REQUIREMENTS; INSPECTION REQUIRED AND THE
FREQUENCIES THEREOF: CERTIFICATION OF INSPECTION REQUIRED; INSPECTION
PROCEDURE: CERTIFICATE AVAILABILITY;CREATING AND ESTABLISHING HOUSING
BOARD OF APPEALS AND THE APPEAL PROCESS; ESTABLISHING INSPECTION FEES;
EXEMPTION OF UNITS SUBJECT TO INSPECTION OF OTHER GOVERNMENTAL UNITS;
VIOLATION OF PROVISIONS OF ORDINANCE DECLARED A MISDEMEANOR AND THE
PENALTY THEREFORE, AND PROVIDING THE EFFECTIVE DATE OF ORDINANCE.
The mayor explained to the council that he and Mary had talked it over
with the student housing people and he had talked it over with Gordan
Tychsen who will be doing a lot of the inspections. They had changed
it so they don't have to be inspected only every two years instead of
every one year. If someone complains about something then we go and
inspect the apartment. The inspection that we do regularly we won't
make a charge for it, but if we get a complaint and we have to go over
and make an inspection, and we find a violation, then they will have to
pay for the inspection. We will then give them 30 days, 60 days, ar 90
days to get the thing corrected, depending an what the correction is.
We have talked about doing it for those apartments over four units.
Since we decided that there a lot of basement apartments and they are
worse than any others. We did not put any restrictions, any rental
unit, we can go in and inspect it.
A motion was made by Councilman Nyle Fullmer and seconded
Bruce Sutherland that the rules requiring an ordinance of
permanent nature to be read three occasions be suspended
said ordinance be numbered 684.

RE: LID'S DISCUSSED
The mayor said that Joyce from the paper said we discussed the parts of
the LID but did not vote on them.
Area ~~3- 3rd East between East Main and 2nd South. We decided to
eliminate that one on the night we discussed it.
Area ~~2- 5th South, last time we decided that we would do 1/2 of it and
try to get the rest of it in. Nile Boyle said he visited with Don
Rasmussen a couple of weeks ago and again last night and also visited
with Terrell Siepert. They neither one want to do it but for the good
of the city it needs to be done. A motion was made by Nile Boyle that

we include the entire project as written in, and Don had some questions
about how we assess the property owner. He wants it broken down. The
motion was seconded by Nyle Fullmer. All Aye
Area ~~l- West Main Street. A motion was made by Nile Fullmer to adopt
that part of the LID and also to work as hard as we can to utilize the
piping that Dar Mickelsen has if we can to minimize the cost to him.

Area ~I4- Shoshone Ave. There were no protests on that. A motion was
made by Nyle Fullmer and seconded by Glen Pond to except that portion
of the LID. All Aye

RE: TREE PLANTING PROGRAM
Mayor Porter told the council that he had received a letter from the
Department of Commerce which they ask us to plan for the "Second
Century of Trees". The mayor had got in touch with Jim Long and he is
working on a tree planting program that will take place in an arbor day
in the spring. We can get trees from the USDA-Soil Conservation
Service,USDA-Forest Service, the University of Idaho, and the Idaho
Nursery Association.
RE: GREEN RIVER ORDINANCE
Mayor Porter told the council that the City of Idaho Falls and the City
of Pocatello have been in courts defending the Green River Ordinance
and lost. In the legal news put out by the Association of Idaho
Cities, they suggest that cities change the ordinance, that everyone
that goes out calling from home to home has to be licensed. We can in
City Hall establish a list of names of people that do not want
salesman calling on them at home, and have them mark it on their
door. They suggest that we amend the ordinance. They would have to
drop in here and get their name on the list. We could put a notice on
the water bills. The mayor ask Mary to draw up an ordinance.
RE: CONSERVATION MEETING
The mayor told the council that they had a meeting in Boise on
Conservation. The AIC and Bonneville Power sponsored it. Dave
Thibault went over to the meeting. If we we adopt the Conservation
ordinance as part of our building code, we can receive $8000 to $15,000
to help up train our people, and contractors. Any house that is built
under the conservation plan, the contractor will receive $850 to help
with planning. They will come over and put on a seminar. When we get
all the information that would be the way to go. We don't have to do
all that if we don't want to. There is a Bonneville Power man from
Idaho Falls that is coming up here with a sample ordinance for us to
look over. Before we do anything we need to have the contractors in
and let everyone be aware of what we are doing.
A motion was made by Nile Boyle and seconded by Glen Pond to pay the
