A motion was made by Darlene Blackburn and seconded by Bruce Casper to
approve the minutes. All Aye
RE: BUSINESS LICENSE REQUESTED
Don and Sandy Kettle at 530 Commanche was at the meeting to request a
business license. At the last council meeting it was decided to send
an impartial city employee around that street with a petition to sign
as to whether the people are for or against having this business at
that location with the limitations as set. They would operate a
Throphey Business at their home address. They would have a small
engraving machine in the basement, with little or no traffic. The
contact would be made by the phone and personal contact. The trophies
would be delivered. There would be no sign. The application would be
reviewed in one year. Glen Pond said there would be a lot less traffic
there than a piano teachers home. Nile said there were about 30 people
signed the petition and they all signed approved. Nile said if they
have protective covenants in a sub division, that has nothing to do
with the city. If it is against the covenants the individual property
owners can take action. A motion was made by Bruce Sutherland and
seconded by Nyle Fullmer to grant the business license as limitations
are set on the petition. All Aye
RE: ZITIGATION TO BE DISCUSSED (RECESS)
Nile Boyle announced that we have a couple of items in litigation we
need to discuss in an executive session. If we could recess right now
and discuss those two items. A motion was made by Bruce Casper and
seconded by Bruce Sutherland to recess to an executive session. All Aye.
RE: MEETING RECONVENED
Council reconvened.
Nile Boyle called the meeting back to order.
RE: ACCIDENT CLAIMS
A motion was made by Bruce Casper and seconded by Bruce Sutherland to
deny the accident claims and turn them over the the insurance company.
All Aye.
RE: LEGISLATIVE MEETING
Nile reminded the council of the Legislative Meeting in Idaho Falls on
Monday night at the Stardust at 7:00 P. M.
RE: SCOUTS
Nile recognized the scouts in attendance.
RE: LID PUBLIC HEARING

LID Public Hearing for LID 26 at 8:00 P. M. Nile Boyle told the group
that the city has had several requests for this LID. We were waiting
for the project on 2nd East so we will have a contractor in the area.
He said he had a lot of people on 3rd East that are oppose to that
one. We have about 30 letters from people that are against it.
RE: LID ON 3rd EAST
Gordon & Ethel Smith- 154 South 3rd East. He said the street seems to
be in good condition. He ask what the reason was to do this street
when there are a lot of streets in Rexburg that are in a lot worse
condition. Nile told him the reason that was put on the LID was
because the curb needed replaced. Nile told him the property owners
would be assessed $9.50 for the curb and gutter the city would pay for
the street. Gordon ask if they would have to replace their driveway.
Nile told him they would have to go to a seam and $22.00 a square yard
on driveways. ,The total cost for that street will be $118,000, the
city will pay $78,000 and the property owners will pay $39,000. Gordon
thought it would be okay if the property owners only had to pay for the
curb and gutter. Orene Mc Culloch ask if they were going to do the
sidewalk too. Nile ask John Millar to comment on the sidewalk. Orene
said they owned two lots and they were oppose to the project.
John Millar - It is a 35 foot street with sidewalk on each side, they
had proposed to widen the street to 42 feet, that would roll the curb
and gutter back to 5 to 7 feet on each side. Most of the widening
would be on the west side, because that is where the wide area is. We
would then patch in where the existing curb and gutter is and the new
curb and gutter and then put a asphalt overlay over the whole street.
In widening this it would require that some driveways be changed. That
would be on an individual basis if you wanted to replace the whole
. thing. The city is proposing that the property owners pay for the new
curb and gutter which would be $9.50 maximum. Sidewalks would be left
unchanged.
Marjorie Goodliffe asked why they would change it if they line it up
with the park, the street would be where our sidewalks are. If you
change that, I will not have any way to get into my home. John told
her we would have to come back about 2 feet minimum to put the curb and
gutter in, we are proposing widening as minimum as we can on the uphill
side. We are not proposing to widen it the width it is at the park.
She was opposed to it.
Gordon Smith - will you have to take any trees out. John told him we
would have to take out only one tree.
Bruce Casper - He had gone through the letters and there is 37 home
owners and there is 26 yes and 11 no. There were some at the meeting
that did not send in written protest that was in protest.
Nile Boyle said there quite a sizable opposition to it. As far as the
city is concerned that is a street that isn't traveled that much, it is
mostly just the people living on it. If the people that live there
don't want it I don't think the council cares if we delete it from the
LID.
Nyle FulLner said he had done some figuring and it would cost about
$6.00 a month with a 80 foot frontage. It should be taken into
consideration that it would be improving the area as far as snow
removal.
A motion was made by Glen Pond that due to the opposition that we have
that 3rd East be deleted from the LID. Seconded by Bruce Casper. All
Aye. Nile Boyle announced that 3rd East will be deleted from the LID.
6 people was at the meeting from 3rd East.
RE: PROPOSED IMPROVEMENT ON WEST MAIN
West Main - John Millar explained. The proposed improvement we have on
West Main. West Main has the deep curb and gutter. On portions of
West Main it has been changed to the standard curb and gutter. The
city has had some requests to change that area out there because of the
deep curb and gutter. There are problems with the arch type driveway,
with drainage and trying to keep it clean. On the north side of the
street from the north side of the street from the railroad tracks to
the canal, curb and gutter change and driveways change as required. On
the south side from the real estate office down to the canal changing
that curb and gutter. The street would remain the same width, we would
remove approximately 6 feet of asphalt, change the curb and gutter,
patch the asphalt back into transition into the curb and gutter. The
cost on this would be the same as 3rd East, the city will take care of
the cost of the asphalt replacement, the cost to remove the curb and
gutter. The city share of that would be $42,900 and the property owner
cost would be about $23,000.
Nile Boyle said that Dar Mickelse~ had contacted the mayor and he was
opposed to the LID.
Orrin Bates- He said he had not noticed the curb and gutter as much as
he had the sidewalk. Nile Boyle told him the sidewalk can be done
anytime, the city pays Z0~ a square foot and the property owner pays
the rest. Mr Bates ask if all the property along there has to be done
the same, because some of the property is okay.Wagoners does not have
anything wrong with it, but his place does need to be done. Nile told
him they would have to change it all the way to get good drainage.
Kenneth Wagoner-270 West Main- He ask if the city would pay for the
driveways. Nile Boyle told him the driveway would be at his expense,
the only part of the driveway that we are going to do is the part that
we tear out. The cost of the driveway would be $22.00 a square yard.
There is 18 homes on the project on Main street. Mr Wagoner ask how
much they would raise the curb and gutter. John Millar told him the
would be raised up about 6 to 8 inches. Mr Wagoner said he did not see
any reason for it. The cost to him for curb and gutter will be $9.50
or about $665.00. John Millar told him they could saw cut the
driveways, they have to have afoot or two to transition to the new
curb and gutter. They would work individually with each property
owner. Mr Wagoner said he did not see why it would benefit him. He
was in opposition.
RE: LID ON 5th SOUTH

John Millar explained this project, half of the street was put in 15
years ago. The curb and gutter is on the Rasmussen property not on the
Alpine Chalet property. The proposal is to finish the street off for
the length of the block, finish the curb and gutter, and a retaining
wall will be required at the Alpine Chalet. The cost approximately $41
a square foot to do the street by the Rasmussen property and by Alpine
Chalet approximately $115 a square foot. Nile Boyle explained that
since the street has never been put in, the city doesn't except any
streets until they have been paved the first time. Since that half has
never been paved, it would be at the property owners expense.
Don Reassessed- I am the co-worker of the property, and our concern is
if we pave it and later on the sewer line goes in and the street gets
torn up again. Nile told him we have to check it out. If the city
made that mistake, it would be at the city's expense to have it torn up
and replaced. Nile said it was requested by the people at Alpine
Chalet. He ask John Millar if it was possible to just do their part
and leave the Rasmussen property off. He said it possibly could be.
Nile said they would get the answers to the questions and meet with Don
sometime. Don said he would put in a provisional protest pending the
out come of the sewer line.
RE: LID ON SHOSHONE

Vance Forsgren- Wanted to thank the mayor and council for going through
the hasle of setting up an LID. He was in favor of of the project.
No opposition to the project on Shoshone.
Roger Hoopes and Marie Hoopes was at the meeting to ask about the 2nd
East project. John Millar explained it, and told them it would cost
$6.00 a square foot.
No protests on the 2nd East project.
RE: HEARING CONTINUED NEXT MEETING
A motion was made by Glen Pond and seconded by Bruce Casper to continue
the hearing at the next council meeting on December 7 at which time a
vote will be taken on the LID. All Aye
RE: TRAILER BOARD
Bruce Casper said he is working on a trailer board.
RE: 4 WAY STOP AT CENTER AND SST SOUTH
Bruce Sutherland said he would have a report on the 4 way stop at
Center and 1st South at the next meeting.
RE: AIRPORT AUDIT
Nyle Fullmer said the Airport board are getting an audit prior to us
getting the airport records.
RE: MOTION TO APPROVE BILLS
A motion was made by Bruce Casper and seconded by Bruce Sutherland to
approve the bills. All Aye
