A motion was made by Bruce Sutherland and seconded by
Darlene Blackburn to approve the minutes. All Aye.
RE: BUDGET-PROPERTY TAX BILL
Richard Horner presented the budget. He told the council that the
overall property tax bill was going to go down $11,500. There is an
increase in the states sales tax. About everything is pretty much the
same. He then went over the expenditures. As they discussed the
Economic Development, the amount had been increased to $15,000. $5,000
of it is the loan that we had given to the dance festival a while ago.
They suggested that on the mayors reception that they hold every year,
to take care of the expenses they would credit that against the
repayment of that $5,000. Money had been put in the Planning & Zoning
so we can finish the Zoning Book next year. In the street fund Highway
Users fee is going up which will give us an increase. That made it
possible budget $143,000 next year in street repairs over and above 2nd
East.
RE: STREET REPAIRS/DUST
Mayor Porter told the council that we now have bids for all those
street repairs. It comes to $14,000. The council okayed for them to
go ahead. We have had a lot of complaints on dust this summer in
alleys and the one area on Third North. The Forest Service have been
putting a Chloride solution on all of their campgrounds and it works
really good. The people who are doing it are up here now and Farrell
has arranged for them to start on Monday doing ours. On the south end
of 2nd East we will put the chloride on it to settle the dust.
RE: FEMA LOAN
Nile Boyle ask about the FEMA Loan. Mayor Porter told him that Mc
Clure will be here Monday and they are suppose to have the bill already
so we can give it to him.
RE: BUDGET-BENEFITS
Richard told the council the grand total of the of the budget is
$2,897,200. Mayor Porter said another thing we need to do during the
year is to put the money in for the sick leave at termination. We
will pay when they retire but we haven't the percentage. We will do it
sometime during the year before anyone retire.
Mayor Porter told the council that on the 401 K plan we took the money
that we were saving from Social Security Fund with
the 401 K plan and cafeteria plan and used that money as a matching
fund for those people who elected to us the 401 K plan. He proposed
that we make it a flat 2~ matching. Richard said what we do now is we
match 50 cents on the dollar. So an employee would have to put in 4~
and the city would put in Z~ and that is in the budget now.
A motion was made by Glen Pond and seconded by Nile Boyle to approve
the tentative budget and set a hearing for September 7, All Aye.
RE: PUBLIC HEARING FOR ZONE CHANGE

Publie Hearing 8:00 P. M. for Zone Change an South end of 4th West by
Gaylen Gneiting at 309 South 5th West. The request is to have the
zoning changed from R3 to Commercial. It would be on the East side of
the street. The mayor told the group that they had circulated a
petition in that neighborhood and had a notice in the paper and posted
a notice at the old Kingdom Hall. The man who had bought that old
Kingdom Hall was in the office and challenged us because he said it was
already commercial and he had understood when he bought it that it was
commercial, but on our zoning map it is R3. So he told the mayor that
he wanted the zoning changed to commercial as well as Mr Gneiting.
Glennis Nedrow: She said she lives right across from the property
owned by Gneitings. She said she did not want an apartment house going
in there and having the zoning changed. Mayor Porter told her they can
build an apartment. building without changing the zone. R3 will allow
an apartment house. The mayor told her that Mr Gneiting did not tell
us what he was going to do. Mrs Nedrow said about 6 weeks ago Mr Brown
came around it was on a Sunday morning just as she was leaving for
church. He said he had a petition for us to sign. I noticed that
about everyone on the street had signed it. I knew that it was R3 and
he explained it to me that it was R3 and the petition was for us to
sign it to leave it to R3, and to clean it up and clean up the Straton
property. So everyone that she knows of was in favor of it. She had
gone around to the people on the street and ask them if they wanted it
changed to commercial and none of them did and they signed a paper
(which she gave the city clerk on file) saying that none of them wanted
it changed to commercial. Mayor Porter read the petition. (attached)
Mrs Nedrow said that is not what Mr Brown told them. Several of people
from that area was at the meeting and she referred to them saying they
were under the same impression. Nyle Fullmer ask her if her concern
was that Mr Gneiting would put up an apartment and told her he could do
that with the zone that is there now. She said that was her concern.
Dan Nedrow said that was not the paper that they signed and he was
there. He said what ever signature the city had had been copied off
from another one because there was no names of any people on that list
when she signed it. The mayor told her that her signature was not on
the petition. The mayor questioned that if there was another petition
that Mr Brown had not turned in.
Nile Boyle said Jerome, Sundie, and Scott Barrick had signed it, he ask
Jerome how he had understood it. Jerome said he miss interpreted it he
thought it was a different piece of property owned by the Chapples.
The mayor said we did take a different petition around about 6 weeks
ago to change the Chapple property from Commercial. The mayor ask if
they would be against changing the Stranton and Kingdom Hall to
commercial. Mrs Nedrow said she thought they should leave all that
street residential because there is some nice houses and some nice
yards down there and they all try to keep them up. She thought we
should keep business area in business area and residential in
residential. Danny Nedrow said the only eyesore on that street is
across the road. He ask if there is anything they could do to stop an
apartment complex? The council told him the only thing he could do is
change the zoning to Rl but they would have to get the property
owner's approval. Danny said if he wants that commercial then
something else besides an apartment complex is going in there. Nile
Fullmer said he is guessing that he is trying to open up his options.
Everything else on that side of the street is already commercial so it
shouldn't make that much difference. Danny Nedrow said 3/4 of that
street is retired people and no more kids. Opening it up to commercial
could open it up to a lot more than that. It is a busy enough street.
as it is without people racing up and down the street anymore. The
mayor said on the west side of the street is as commercial as you can
get it, they have a lot of people working in it. Glennis said it was
down on the other side of the canal so it was a little farther away.
And we found out about it after it was done.
Nyle Fullmer said if it was misrepresented then we need to get another
petition circulated. Glen Pond said what he thought is that we just
start over with it. If Gneitings want to start over with. it that is
the way we need to go, and we need to get someone from the police
department to take the petition around. Glen said he thought that
Gneitings would withdraw their request.

Virginia Collier said that the Stranton Property had been sold quite
awhile ago. Danny Nedrow ask how the business Check Stop could be in
Kingdom Hall when it was not zoned for commercial. The mayor said he
thought it was commercial. Danny said then he should be shut down.
The mayor said yes he should be shut down. Glen Pond said in lieu of
what has gone on lets just re-do it if Gneitings want to do it.
Jerome Barrick said he didn't know how they could build an apartment
complex anyway, because they would not have enough room unless they
plan on getting over on his property and that is what they are trying
to do. They haven't got a building permit and we don't know what they
plan to do.
Danny Nedrow ask if there was no way they could stop an apartment in
coming in. The mayor said he would have to come to the Planning Board
an show what he is going to do and there has to be a certain amount of
space according to how many apartments he is going to have. He also has
to have off street parking and 2 parking spaces for every apartment and
also has to get a building permit. He has to do all those things
before he can build.
Danny Nedrow said there is a difference between single housing and
married housing. He said he does not appreciate them building an
apartment complex next to my mother if it is a bunch of boys. Because
I am 30 miles away from her, and there are a lot of widows down that
street, and there is a lot things going on now days.
Jerome Barrick ask about the street that was suppose to go through that
property that they have been paying half on the taxes. The mayor told
him that street had been abandoned. Each property owner got to take
half of it. Jerome said they had put a bridge abutment across the
canal. Danny Nedrow said he thought there had to be a permit for
that. The mayor said he has a right to put a bridge across the canal
but they would have to get permission from the canal company.
RE: SMALL PLANE NOISE PROBLEM
The council ask the people if the air plane noise from the small planes
was bothering them. They all said they did not find them a problem.
The mayor went out with John Chapple who is representing the model air
plane flyers and we went to several different places (1) a lot the
city owns down by the city shop it is good place but they are still in
the flight pattern. (2) there is some property east of Walters Concert
where 2nd west dead ends on 2nd west. Walters owns that property but
they were going to see if they would let them use it. (3) they went up
on Rexburg bench and there is a triangle by the reservoir and I think
the city owns it, that would be OK. (4) farther up on 14th south on
the Erickson road there is some property that is not being farmed, they
are going to try to find out who owns it and see if they can use it.
They should be able to find a place and move out from where they are.
RE: REPLACING WATER LINE ON 3RD EAST
The mayor told the council that we are replacing the water line on 3rd
East where the Stake Center is. It has a 1 lj2 inch line on one side
of the street and it just is not large enough. We are going to replace
it with a 6 inch line.
The dust retardant is going to be put on Monday. There have been some
people that have called up because they are concerned about that
chloride if it would kill the vegetation. The people that is spreading
it claim it is a fertilizer and does not. kill vegetation. We do have
to clean the alleys out so if there is anything planted in the alleys
we will take it out.
RE: STEINER DITCH
The Steiner Ditch was discussed again.
RE: SENATOR MCCLURE LUNCHEON FOR FARMERS
ON Monday at Smith Park, Sen Mc Clure is having a Brown Bag Lunch for
the farmers. Glen Pond said the city crews need to edge along the
curb, the weeds are growing up over the curb and it does not look very
good..

BUDGET FOR FISCAL YEAR 1988-89
CITY OF REXBURG, IDAHO
Notice is hereby given that the City Council of the City of Rexburg, Idaho, will
hold a public hearing for the consideration of the proposed budget for the
period October 1, 1988-September 30, 1989, pursuant to the provisions of Section
50-1002, I.C., said hearing to be held at City Hall, Rexburg, Idaho, at 7:30
p.m., on September 7, 1988. At said hearing all interested persons may appear and
show cause, if any they have, why said proposed budget should not be adopted.

I, Rose Bagley, City Clerk of the City of Rexburg, Idaho, do hereby certify that
the above is a true and correct statement of the proposed expenditures and
revenues for fiscal year 1988-1989, all of which have been tentatively approved
and entered at length in the Journal of Proceedings. I further certify that the
City of Rexburg, Idaho, did give notice for said hearing with notice having been
published at least seven working days prior to the adoption of the budget by the
City Council. Citizens are invited to attend the budget hearing on September 7,
1988, at 7:30 p.m., and have the right to provide written or oral comments
concerning the entire City Budget. A copy of the proposed City Budget in detail
is available at City Hall for inspection during regular office hours, 8:00 a.m.
to 4:00 p.m.

Galen and Verna Kneiting, owners of property on South 5th West (the Stratton
and Kingdom Aall property) have requested that the zoning be changed from
Residential 3 to Commercial. All property surrounding this lot is now zoned
Commercial. A map is attached to this petition showing the location of the
property owned by the Kneitings which they desire to have re-zoned. Will
you indicate whether you approve or disapprove.

RE: NURSING HOME
The Mayor said the project sponsored by the city the "Nursing Home" has
made the state proud of our project. A representative from the HUD
will be here Sept 16 to inspect the project.
A motion was made by Glen Pond and seconded by Bruce to approve the
bills. All Aye
