barricade, but the state law prohibits it. The council said they thought we needed
a way to stop a runaway truck. The mayor said the county are talking about
coming down the Erickson Dugway and on to 5th West. Bruce said if we put something
up that is against code we cound have a law suit if someone hit it. The mayor
said they had already decided they were going to extend 2nd West and that would
be the ideal alternative. If the county would join in with the city, we could
get the funding a lot faster. Glen ask if the school district shouldn't have
some responsibility. The mayor said he thought we needed to put 3 or 4
big bolders almost immediately. The council decided they should get the State
Highway Safety Engineers in Rigby about the problem and let them tell us what
they would suggest.
ARBOR DAY
Mayor Porter reported on Arbor Day. He told the council that the Steiner Ditch
was under construction and we are going to have to buy pipe. Cleanup day would
be on Satruday, May 7, the scouts will be working. The city would haul bulk
trash all of h1ay.
A motion was made by Nile Boyle and seconded by Nyle Fullmer to pay the bills.

18, 1988, at the City Hall.
Present were the following:

A motion was made by Nyle Fullmer and seconded by Darlene Blackburn to approve the
minutes. All Aye
UTAH POWER AND LIGHT/SERVICE TO STEINER DITCH
Mayor Porter introduced a resolution to approve an agreement with Utah Power &
Light for service to the Steiner Ditch Pump to show we will pay for the power
and authorize them to put the power in. Nyle Fullmer made a motion to pass the
resolution, seconded by Bruce Sutherland. All Aye

WESTMARK CREDIT UNION REQUESTING EXIT & ENTER SIGNS ON CITY RIGHT-A-WAY
Westmark Credit Union is constructing a buidling on the corner of 2nd North and
2nd East. They are requesting permission to put Exit and Enter signs on the
city right-a-way. The signs will be 30 inches square and 3 feet high. Bruce
Sutherland wants to move on it he did not think it would have to go before the Planning
Zoning. The restriction on the sign isn't with the property, it is a city right-
a-way. Nyle Fullmer was concerned if it would cause an obstruction. At 3 feet
high, it would not obstruct the view, and it would be about 3 feet back from the
curb. A motion was made by Nyle Fullmer and seconded by Nile Boyle to give them
a variance to put an Exit and Enter sign on the City right-a-way. All Aye

THANKING YOUTH C='~TER STUDENTS FOR PAINTING OVER GRAFFITO FOR THE CITY
Last Friday in Rexburg we had 11 students from the Youth Center painted over the
graffito that had been written all over the walls, and put another coat of paint
where the city employees had painted one coat. The mayor ask the Council to pass
a resloution to sent them to thank them for the job they did. The mayor
had ask them if they would paint the restroom at Smith Park. A motion was made
by Darlene Blackblurn seconded by Nyle Fullmer to pass this resolution. All Aye
STRIP STREET GOING UP TO OLD HOSPITAL FOR A 4 LANE ROAD
Bruce Sutherland told the council that the Safety Committee had not met.
The mayor said it was his understanding that on Pain Street going up to
the old Hospital, there was no objection to go ahead and strip that street for
a 4 lane road. They want to start doing it next week. The council said there
would be no problem.
GARAGE & SEMINARY BUILDING IN COMPLIANCE-NO NEED FOR VARIANCE
Glen Pond reported on the Planning & Zoning. They reviewed a garage for Steven
Terry and the Seminary Building. After reviewing both of these requests they
found that they would be in compliance with the zoning ordinance and would not need
a variance.
DEPARTMENT OF HEALTH & WELFARE ADVISE PEOPLE OF DANGER OF LEAD IN WATER
The mayor told the council we had received a letter from the Dapretment of Health
and Welffare Division of Enviormnental. Anew rule has been made by the Federal
EPA regarding drinking water. Starting in June three issues of the paper we need
to advise people of the danger of lead in water, and what they should do. Delynn
gave the mayor a report from our water tests. We have to have our water tested
for minerals every three years. The last test that was held for the City of Rexburg
that was sent was March 5, 1987, the next test will be three years from then..
Our water tests are way below the minumum.
Lead EPA Min. .05 per 1000 Rexburg's is .001
Mercury is .002
Nitrate is 1.38
IDAHO DEPT. OF WATER RESOURSES/REGISTER WATER WITH STATE TO PRESERVE IT
Everyone is getting letters from Idaho Department of Water Resources. You have
to register your water with theState to preserve it. Anyone that lives in the city
and gets their water from the water system, doesn't have to worry about
it because Mary will register all the water rights in the Teton River and all the
domestic wells we have and all the irrigation wells. Nile Boyle ask if the Golf
Course decided to drill a well rather than fo to the canal company, how would we get
a permit? Mary told him to apply with the Department of Water Recourses. Mary told
him to apply with the Department of Water Resources. Mary was instructed to get
a permit for a well at the Golf Course.
THE STUDENT HOUSING HAVE ASK FOR AN ORDINANCE
The student housing .have ask for an ordinance. Mary has drawn up an ordinance to give
to them to go over for any suggestions or additions. She read it to the council.
The council discussed the parking for the apartments. The mayor read questions the
student housing office had mailed him explaining the answers. (copy on file)
PLUMBING ORDINANCE READY
Mary has the Plumbing Ordinance ready, but we need to have the Plumbing Board and
Delynn review it.

EVALUATE AIRPORT STUDY
The mayor said he has the evaluation of the Airport Study. He would give it to
Nyle Fullmer so he can set up a meeting. with the County Commissioher and review it.
COMPLAINT ABOUT VACANT LOT
Nile Boyle told the council he had a complaint from Trent Walker about the vacant
lot across from Lincoln School The council discussed the problem. It is a
large lot, neighbots throw their tree limbs and grass on the lot, the weeds
grow and it can't be mowed because of the holes and junk on the-lot. The city has
burned the lot before and the neighbors complained. It is a large undeveloped area.
The lot would need heavy equipment to smooth it out and the city does not have the
equipment or time.
TABERNACLE DOORS UNLOCKED-FIRE HAZARD
Gordon Tychsen from the Fire Department was at the meeting. He has a letter from
E.T. Thompson with regard to the Tabernacle. He had attended a Junior High Schoo l
Band Concert in the Tabernacle. He tried to open the back doors, and to his aston-
ishment they were locked. If there had been afire a tragedy would have resulted.
Gordon Tychsen said all the doors should be unlocked for a program. The council
thought we need to leave a key with the firemen and have them make sure the building
is unlocked.
NO "FOR SALE" SIGNS IN CARS IN PARKIfdG LOTS AROUND TOWN
Bruce Casper reminded the council that a few months ago we ask the city attorney
to draw up an ordinance so people couldn't put cars on parking lots around town
with For Sale signs in them in order to sell them. Bruce Sutherland told P1ary
the City of Orem Utah has this kind of an ordinance.
CARS SITTING ON JOHNSON CORNER LOT
The council discussed the Johnson Corner and what we can do about the cars sitting
on that lot. We need to at least move them back. The mayor said he had ask the
engineers to go out there and mark the right-a-way but they have not done it yet.
There might not be room for a sidewalk. The mayor said he would talk to the
engineer again.
A motion was made by Nile Boyle to pay the bills and seconded by Bruce Casper.

EXECUTIVE SESSION REQUESTED-PROPERTY FOR RIGHT-A-WAYS
A motion was made by Nyle Fullmer for the council to go into an exective session
to discuss purchase of property for right-a-ways for the 2nd East project. Seconded
by Darlene Blackburn. All Aye
