4-WAY STOP SIGN ON VIKING DRIVE
Bruce Casper discussed the 4-way stop sign on Viking Drive. We need to have a
safety study on that.
A motion was made by Glen Pond to approve the bills, seconded by Bruce Casper.

MINUTES OF THE CITY COUNCIL MEETING
March 2, 1988

A meeting of the City Council for the City of Rexburg, Madison County, held March 2,
1988, at the City Hall.
Those Present: Mayor: John C Porter
Councilman: Bruce Sutherland
Glen Pond
Nyle Fullmer

Also Present: Rose Bagley, City Clerk
Richard Horner, Treasurer
Mayor Porter told the council that Mary Smith was excused because of illness, and
Darlene Blackburn was excused because she was out of town.
A motion was made by Nyle Fullmer and seconded by Glen Pond to approve the minutes.

LEONARD LENNING REQUESTED A BUSINESS LICENSE FOR MOBILE LUNCH TRUCK
Leonard Lenning was at the meeting to request a business license for a mobile lunch
truck. At the present he has a catering truck in Idaho Falls. He said he wanted to
have two trucks in Rexburg. Ther operation is clean. They operate at the curb or at the
business or the school. They would have hot food and cold sandwichs. They stay about 15
minutes at a stop. They would clean up all the litter. Nyle never had a need for it in
the past. He did have liability insurance on the truck. The council felt that there
would be no problem, he would need to come to the council to let them know where he planned
on parking. The mayor told him we would check with the different places that the catering
truck that we had issued a license last year had stopped to see if they felt okay .
about it and let him know at the next meeting.
SCOUTS
The mayor acknowledged the scouts that were at the meeting, from the 14th and 12th
wards.
SAFETY COMMITTEE ABOUT TURNING ACROSS THE DOUBLE LINE
Bruce Sutherland told the council that the Safety Committee did not meet at their
regular meeting. The mayor said he talked to the Chief of Police about the problem
we have with the turning across the double line at the Junior High School and by the
courthouse, and they think we should leave it like it is, because if we change the

markers we become liable. Bruce Sutherland said in order to change it, it would
take out I5 parking places that are really used. Blair said he would recommend that
we leave it like it is, because under the state law they can cross the double line
but they do it at their own risk. The mayor suggested that the police have an
office down there ti direct traffic during the morning when it was difficult to turn.
Blair was sending a recommendation to the committee.
TRAFFIC LIGHT TO BE INSTALLED AT THE CORNER OF EAST MAIN AND 2ND EAST
The mayor told the council that last Monday one of the State engineers came in
the office with the plans for the traffic light to be installed at 'the corner
of East Main and 2nd East. He wanted to go over them to see if the mayor
thought they would be okay, then they would try to finish them up and try to
get the funding for this summer. There is two trees on the courthouse lawn.
One of the trees would have to be removed. They would put the controls where
the one tree is. The trees are in our right-a-way byt the mayor felt that it
would be a good idea if we contracted the commissioners to get their okay on
the plans. The only one he could get in touch with was Bruce Webster, Bruce and
the engineer went up to the courthouse and went over the plans. Bruce told
the mayor there was no problem, to go ahead and take the tree out. There will
be one parking place next to Terrell Arnold's home that will have to be eliminated,
and one out in front of the courthouse to have the controls like the plans. By
the Art Porter building they will have to take out four parking places, so there
can be two lanes of traffic.
APPRAISALS COMPLETED ON 2ND EAST- SENT TO THE STATE TRANSPORTATION DEPARTMENT
The appraiser has completed the appraisal on the two parcels of property on
2nd East. His report has to go into the State Transportation Department in
Boise. The will look it over and see if they think he has the right figure..
As soon as they approve that we can start negotiation with the two owners.
By the end of March we will have everything taken care of. Tomorrow we are
getting the deeds on another piece of property that is being donated to us.
THE TELEPHONE COP~PANY WANTS TO IfJSTALL A LINE WHILE ROAD IS TORN UP
The telephone company is anxious to get. the street done as soon as possible.
They are bringing the first five optic lines. They 'nave run a line from
Boise to Pocatello and the next will be from Pocatello up to Rexburg. They
want to install it while the road is torn up. Under the specifications we
have given all the utilities, after the road is built they will not be able
tear the road up for 7 years.
COUNTY-CITY RADIO BUILDING

The mayor said he talked to Bruce Webster abut the county-city radio building.
We are still havrrig problems with the county repeater over-riding the fire
department's signals and also the street department radio. They have problems
because there are areas in the county that they are not reaching. They
want to move their own radio. He wondered if we could up our offer of $500
plus the radio tower that use to be on the City Hall. It is my suggestion that
we go another $250, which would make it $750 plus the radio tower. The council
agreed to this.
APARTMENT INSPECTION
The mayor told the council that we have started the apartment inspection. We
have not arrived at the charge yet. The apartment owners would like another
two weeks to come up with what they think is a fair price for inspection.
Glen Pond suggested that we charge on an hourly basis, because the apartment
owners can make it so it is easy to go in the inspect it or they can make it
difficult so it takes a lot of time. The inspection is going pretty good. They
notify the apartment owner that they are going to be there, and ask that he is
there or one of his representatives. The give him a little time to get things
cleaned up before they go over to inspect. Glen Pond ask about the Cottages
Apartments and when they were going to clean up the property. The mayor told
him that is the inspection they are doing and have told him it will have to be
done.
REf~OVAL OF THE STEINER DITCH
While the mayor was meeting with Bruce Webster, he reviewed the plans we had for the
removal of the Steiner Ditch. We are covering the ditch. Bruce will bring it up
with the county commissioners. John Millar will ruff out a plan sous soon as
the weather gets good we can go ahead on the ditch.

COLLEGE SECURITY AND CITY OF REXBURG POLICE DEPARTMENT
Ricks College and the Police Department have been reviewing the agreement that we have
with the college security and the city of Rexburg, so when ever there is an emergency
or they are needed, the college security can help the .police. It has been quite a
while since the agreement has been reviewed and they felt there were some things that
had been added that they no linger needed and there was a question about liability.
Tom Leman and Blair went over the agreement and made the changes they thought were
needed. Tom took it down to Mary Smith and she went over it and made some changes.'
Now the college attorney is going to go over it. The mayor gave the copies to Bruce
Casper and ask him if the police committee would go over it.
EXECUTIVE SESSION TO DISCUSS THE LAW SUIT
They mayor stated that the council needed to go into an executive session to discuss
the law suit..
A motion was made by Bruce Sutherland and seconded by fdile Boyle to pay the bills.

fy1ayor Porter was excused because he was out of town.
REQUEST FOR HAiNDICAPPED PARKING IN FRONT OF OFFICE ON 22 COLLEGE AVENUE
Hank Ashbey, Physical Therapist, was at the meeting to request Handicapped Parkding
in front of his office at 22 College Aveune. He told the council that the parking is
not the best. There is a two hour parking on the street. The people that have
apartments are wise to the parking. They park there at night, from 6:00 P.M. to
8:00 A.M. and the officers don't come back to check the parking until 10:00 A.f~1.
It is not very difficult to look out the window and get the route of the officer that
checks cars. The cars are usually okay until noon. It is difficult to get the people
in and out of my business who are handicapped. The officer is quite lenient and the
people take advantage of it. Glen Pond said the downtown section is probably the only
section that doesn't have Handicapped Parking. We should grant the Handicapped Parking
and have the~Safety Committee look at other streets in the downtown area. A motion
was made by Glen Pond and seconded by Bruce Sutherland to grant the Handicapped Parking.
