MINUTES OF THE CITY COUNCIL P1EETING
January 20, 1988

A meeting of the City Council for the City of Rexubrg, Madison County, held
January 20, 1988, at the City Hall.
Present were the following:
Mayor: John C Porter

Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A meeting was delayed because of lack of a quorm. Bruce Sutherland and Bruce
Casper were out of town anal Darlene Blackburn was delayed because of a death in
the family. Mrs. Blackburn arrived at 7:45 P.M.
A motion was made by Nile Boyle and seconded by Glen Pond to approve the minutes.
CITY OF TETON WOULD LIKE OLD SIREN ON THE WATER DEPARTMENT BUILDING
The City of Teton would like to purchase or have us give them the old siren that
is on the water department building. The mayor had talked' to Rex Larsen and he
is not sure it works. We have a new siren on our new fire building. Glen Pond
said if we sell it to them they might think we have some liability, why not
just give it to them without any guarantee.
SCOUTS AT COUNCIL MEETING
The mayor recognized the scouts. He explained to them how we could not do any
official business at the meeting until we had a quorum.
PROBLEM WITH RADIOS & ANTENNAS THAT ARE HOUSED IN A BUILDING BY THE WATER TOWER
The mayor told the councilthat last night they had met with the county commissioners
and Teton Communications to discuss the problems with the radios, and the antennas
that are housed in a building up by the water tower. We and discussed having ~:ie
county move their repeater to another area so it would make the other antennas
function better. The county had considered moving theirs until they found out ~it;
was going to cost them between $4700 and $5000. The man from Teton Communications
said that the antennas are now even. He felt that if we would raise one of them
higher, and each one a little lower than the other is they are not even they would
work better. There is a peice of equipment we could put over ours to shield it
from the other antennas. That would probably solve the .city problem. Nile
Boyle said he thought we should go ahead and do those things and try them out.
The mayor said the sheild would be about $400. Nile Boyle moved that we go ahead
with the radio equipment. Seconded by Darlene Blackburn. All Aye
PELICAN DANCE CLUB RESERVES 3 PARKING SPACES IN FRONT OF BUSINESS
Cliff Brady representing the Pelican Dance Club was at the meeting. On Wednesday
and Thursday nights they have a limousine service and would like the right to
reserve three parking spaces in front of the business from 8:00 P.M. to 12:00
midnight. It is on College Ave in Jim Wood's building. Darlene Blackburn ask
if there was parking in the back, he told her there was. Nile Boyle said there
should not be any problem iwth that at that time of Night. A motion was made by
Darlene Blackburn to approve the reserved parking places. Nyle Fullmer ask how we
could enforce it, would they ticket cars and tow them.- Mr. Brady said he would have
a person just inside the door at the counter that could watch the parking spots.
The mayor said we could sign it. Motion seconded by Nyle Fullmer. All Aye
RAQUETBALL CLUB WOULD LIKE TO ACCOMIDATE CITY EMPLOYEES
The manager of the Raquetball Club would like to enter into somekind of an
agreement with the city for a nominal fee to the city employees, and maybe
match the payment to use the Raquetball Club. The mayor felt there would
be some value to provide an exercise facility for city empoyees so .they
would stay healthy. The police want to buy more gymnasium equipment and
that would eliminate that expense. We would have to work out the fee. Nyle
Fullmer said he thought we should pursue it and find out what kind of numbers they
are looking at and pool the employees and see how many are interested. The mayor
ask Nyle Fullmer and Nile Boyle to check on it. Nyle Fullmer ask Rose to send
out a flyer asking the employees if they would be interested.
UNIFORM INSPECTION FOR ALL OFF CAMPUS STUDENT HOUSING
The mayor said he had met with Don Packer today, he is head of the Ricks College
off campus student housing. They are interested for the college to have a uniform
inspection of all the apartments to make sure they have smoke detectors, safety
standards and health standards. They have recently hired a man who~has expertise
in this. The city now has Jeff Teeples as the building inspector who has had
experiecne with this and we have Gordon Tychsen as the fire inspector. They
would like to cooperate with the city and have the inspectors all go at the same
time. Some cities have a flat rate they charge for it they charge a license fee
of $25.00 a year plus $1.00 per apartment. The college would not be interested in
the fee, but it would help us with our building department. He is meeting with the
off campus housing people within the next week and will present it to them,
and get their ideas on what to charge them and get back to me. He felt that if
the city was involved in it, there would be a little bit more authority. The
council felt that it would be a good idea. Mary Smith said she would check on
an ordinance.
,2ND EAST PROJECT PLANS SENT TO STATE HIGHTWAY DEPARTMENT
The mayor said we have the plans for the 2nd East project they have been sent to
the State Highway Department. They have excepted them and have also approved
payment and go ahead and negotiate with a real estate appraiser to appraise the
right-a-ways of which they will pay 95%. We are going ahead with that, and have
received two bids on the appraisal. We are waiting for one more bid. It does
look favorable now. The mayor said he had to be in Bosie tomorrow for a
meeting and will take some information over to the legislators so they can help
us. It will be a beautiful street when it is completed. They are replacing the
trees that they take out with 178 trees. The people will be involved and also
the tree committee in selecting them, The street lights that are there now
will be repalced with metal street poles. If we don't get the whole thing done
this summer we will at least get the south half. Glen Pond ask if they will get
the street light in. The mayor said what he has suggested to the legislators
is if they only do the south half of it this year that they insist on putting
the light on Main and 2nd East.
SANDING ICY STREETS
The mayor said he had had some calls on s~ndi'nge, He had talked to Farrell about
it. We have been. doing a lot of sanding .and have used more sand already this
year than we did all last year. We sand the intersections unless it is where there
is a steep grade, then they run on up the length of the street. From the river
to the courthouse there are a lot of turnins to businesses and parking lots. The
mayor had told Farrell to sand those. The sand doesn't stay on very long.
OFF CAMPUS HOUSING PROJECT
Nyle Fullmer ask about the money that the Off Campus Housing had ask for for their
project and if there was a reason that the city could not sponsor something
like that. Mayor Porter told thim that it was a legal problem. Nyle felt that
we should be able to support them more than just verbal. The mayor told him
that when we were getting the money from the revenue sharing, it gave us some
leadway. At one time there was a suit in the state of Idaho because a city had
ask for tax money for a contribution fora celebration. He ask if promoting tourism
would be different than contributions. The mayor said we gave money to the dance
festival but had to do it as a loan. Nile Boyle suggested that when the money comes
back from the Nursing Home, possibly that money could stay in a fund that we could
sue that way. Nyle Fullmer ask where the money came from that we used to join the
Chamber of Commerce. The mayor said it was like a trade association to promote
membership in sometbing like that. Nile Boyle explained that we could pay dues.
Nyle Fullmer ask if we could pursue it.

JANET CARLSON YARD AND VEHICLE VANDALIZED
Nyle Fullmer. said he had got a call from Janet Carlson. She had her fence run over
and tires slashed. She lives across from Taco Time. The mayor said the only thing
she could do is report it to the police.
A motion was made by Nyle Fullmer and seconded by Darlene Blackburn to pay the bills.

3, 1988, at the City Hall.
Present were the following:

A motion was made by-Nile Boyle and seconded by Bruce Casper to approve the

STATE HIGHWAY DEPARTMENT PROJECT 2ND EAST
Le Roy Meyers form the State Highway Department was at the meeting. P~lr. Meyers
said he had talked to Keith Green, State Highway Administrator in Boise. He said
to tell you to get the project in as quick as you can. On ,:the Urban program, the
projects they have on~.the schedule this year are slow coming in. He said he
would cooperate to get the job done as soon as we can. We are in afoot race,
whoever gets the job in first. The transportation board put the 2nd East project
on the schedule for FY98. The first of June if the other jobs aren't in, he
would do his best to fund it in FY88. Or it would be first on the list, for FY89.
In talking to Clint- it looked like we couldn't open bids until about the 1st
of September of this year, and it would take another month to process the contract.
That would be late to start the project. It would be in good shape to go early
next year. :fie get information back from Boise and there was some concern that Senator
Mark Ricks was concerned about the design on the South end. The mayor said he
talked to him yesterday, and he would like to see it that way, but understood that
it was impossible. His big concern is to get it done. The h1ayor had suggested to
Senator Mark Ricks that vde split the project... The problem we have is we are involved
with LID's that we are going to tie in with the curb and gutter and sidewalk on this
project. They are all set for this summer. We could do the south half this summer and
the other half next summer. Mr. Meyers said he understood the right-a-way process
is taking time. The mayor he talked to Clint, and the one man vrho can be put up in
40 days, his bid is $500 more than the one that can be up here in 60 days. The
mayor had agreed that the city could pay the difference. Clint had checked with them
to see if they could get up here in 30 days, but they would have to check it out,
