A meeting of the city council for the City of Rexburg, Madison County, held November
18, 1987, at the City Hall.
Present were the following:
Mayor: John C Porter
Councilman: Bruce Casper
Glen Pond
Bruce Sutherland
Sander Larson
Nile Boyle
Councilwoman: Darlene Blackburn
A motion eras made by Bruce Casper and seconded by Darlene Balckburn to approve the
minutes. All Aye
The mayor greeted the scouts that were in attendance.
CABLE T.V. REQUEST PUTTIfJG THE DISH ON THE WATER TOWER

Cable T.V. was at the meeting to request putting the dish on the water tower. We
have checked with the engineers and find that there would not be a problem with the
weight of it. Bud Worth of Upper Valley Cable explained what they wanted to do. There
proposal is to mount a microwave on the water tower. This would enable us to bring
in the same signals that Idaho Falls now receives and we will get some more channels.
We are trying to get local advertising on local channels. Glen Pond said he had a
concern about the liability. Mr. Worth said he was sure they could work something
out, they have a standard bond that covers them on things on that Ha tore. Glen said
that he thought Mary should review their liability insurance to make sure we were covered
liability wise, in case something happened. Nile Boyle ask what that would do to the
rates, P1r. Worth said the rates would stay the same. A motion was made by PJile Boyle
and seconded by Bruce Casper to approve it if the liability can be worked out.
Seconded by Bruce Casper. All Aye. Mr. Worth said that in connection with this we also
need to put an underground line from the water tower down to our present connection
which is at the city water tank. The mayor said there would be no problem on that-
but next year we are going to rebuild that street and all the utilities have got
to be installed and in place because for 7 years vae are not going to allow a break in
the street outside of a water leak on some emergency. The mayor told him to po over
it with the engineers so they would know about it and they will ~c~: ~~o~~ a sc-~ of
plans. The mayor told the council that he had cleared it with '~~ `y~~n.
ORDINANCE 689 READ FOR THE THIRD TIME
Mayor Porter read Ordinance 689 for the third reading to vacate two city streets by
Walters Concrete. Today he had contacted f~1rs. Frank Moulton who owns the property
adjacent to the street. She had no abjection. It is a right-a-way but the road has
to be built. The fence is in the middle of the road.
ORDINANCE 680
AN ORDINANCE VACATING AND CLOSING PORTIONS OF THIRD WEST STREET IN BLOCK 7 AND 8
OF THE ORIGINAL REXBURG TOWNSITE AS HEREINAFTER DESCRIBED, SUBJECT TO EXISTING
RIGHT-OF-WAY, EASEMENTS AND FRANCHISE RIGHTS OF ANY LOT OWNER, PUBLIC UTILITY OF
CITY OF REXBURG: PROVIDING THAT ALL OF SAID STREETS REVERT TO THE OWNERS OF THE
ADJACENT REAL ESTATE, ONE-HALF ON EACH SIDE THEREOF; PROVIDING WHEPJ SAID ORDINANCE
SHALL TAKE EFFECT.
Ordinance 680 was placed before the council. The h1ayor then called for the voting
for final passage of the Ordinance, and the motion was made by Sander Larson and
seconded by Darlene Blackburn that ordinance 680 be passed.

The roll showed all councilmen present voting "Aye" carried the P1ayor declared that
the majority of all the members of the. City Council had voted for the passage of said
Ordinance and that said Ordinance was duly and regularly passed. Mayor Porter
declared the, motion carried.
KAY MILLER REQUESTED A SPECIAL USE PERMIT
Miller was ate the council, they have bought a home on 24 East 1st South on the
contingency that we could get a Special Use Permit to put a craft shop in the house.
It would no be one to buy supplies, it would be things you could buy that are already
made. The mayor told her that a petition would have to be sent around to the property
owners within 300 feet of the house. The council okayed taking out a petition.
OFF CAMPUS APARTf~9ENT OWNERS
~Jext on the agenda was the off campus apartment owners.
Ross Farmer acted as spoksman. He handed out handouts to the council and showed
a map< He as for consideration for parking of off campus housing. He showed
a survey of off campus housing. The situation is getting worse instead of better, we
have more and more students bringing cars to school. He questioned the Ordinance
on parking.. The mayor read from the ordinance book- 1 parking place for 2 students
up to and :including 24 and there after 1 parking space for each additional 3 students.
fair. Farmer said they believe that 1 for 2 students is a very conservative requirement.
We should be looking at something less than that like 1 for every 1z students. We
are concerned because we have a proposed unit for 342 students, which based on the
information we have today based on the number of cars, we would probably see something
like 180 cars there. As we understand the unit is proposed to have 126 parking
spaces, which means we will have 50 to 60 cars on the street. He had two plot plans
one for Summerset and one for the proposed development. Summerset this year is
housing men but will change to women next year because they don't have enough parking
for men. In the past Summerset has purchansed parking form the college, but
the college now needs that space and cannot allow Summerset to do that. Summerset has
228 men and they have 150 cars and they have 76 parking places. If you look at the
plot plan for Summerset you will see that Summerset has 81, 675 square feet of space.
The proposed unit is coming in with 340 sutdents about 60 more than Summerset has and
is being build on a little over 68,000 square feet, which is less than that of Summer-
set. There is a serious problem and the location compounds the problem. Our request
to you is that we initiate a process to modify the ordinance to bring it in line with
what we know is the requirement for parking today, and that you not allow new
construction to proceed under the existing ordinance. (Letters, map and petition on
file.) The petition states that the parking ofr the complex being built by Gary Ricks
is grossly inadequate. They petition the council to require 1 parking place for every
2 students.
Jeff Teeples, building inspector for Rexburg, said he went over the plans and as far
as the building code goes, there is no problem. He counted and measured the exact
parking and he has 43,050 square feet for parking. P1aking the parking spaces 9 feet
wide and 20 feet length, including an exit and he has 123 parking spaces and it
calculates out that he needs 118. The house requires 2 additional parking spaces.
Mr. Framer said that the existing ordinance is inadequate. What we need to do is
moderize the ordinance. The mayor said the problem we have is after someone!~~uys
some property and comes in and makes applicaiton for a building permit he did not know
if we can leagally change it in the middle of the stream without them coming in and
suing the city. We cap change the ordinance for the next round if we do it now.
i`1r. Farmer said in terms of the general welfare of the community you need to consider
what impact 60 cars on the street is going to be. The mayor said we are not going
to allow it. He had talked to the police chief, because we are having problems all
over town. Our ordinacne says that they cannot use their front yard. If they have
student housing in a residential zone, they have to have a lawn in front and can't
have the students parking on the lawn, or between the curb and gutter. We have told
the police to go around and put warning notices on them. We hate to ticket those
kids and have their cars towed away and then they have to pay $25 to get their cars
back. We .t-kink that the people that have a student housing unit, and they don't
have enough parking, they have a responsibility to that student. We are going to try
to change the ordinance so if the student housing doesn't provide the adequate
parking, they can be fined just like the student.
Alpine Chalet was in and they have 56 more cars than they have parking spaces for,
even though they are in compliance. The people who own it, came in the other day
and they are concerned about it, They are looking for more parking next to them.
No one had said anything to them, but they recognize the problem, that the kids needed
to have a place to park. There is a parking lot down about 2 block from them and
they are going to try to rent some parking. Our ordinance does say that if you
can find parking within 1000 feet, you have to do that to provide parking. About
one month ago we had some people who coverted a home into student housing, and they
rented parking south of the Standard Journal. The only problem is the students are
not going down there, they are parking all over the lawn. The apartment owner
will have to instruct the students to park in the lots they have arranged for or we
will just have to close them down.
The mayor told the group that Gary Ricks came in and talked to the building inspector
and went over the plans with him to make sure they are in compliance vaith the ordinance
that exists. Then the off Campus Housing hear about the apartment so you come in and
want us to change the ordinance so they have to have more parking. But we can't do
this after it has gone this far.
Bruce Sutherland said he thought that even if we pass an ordinance it would be effective
for every apartment complex. He said we can't single out an individual.
The mayor said several things that need to be done. Landlords need to let the students
know where the parking places are and telling them if they park on the street, tilat
their car will be towed away.
They told them that there is another problem. We have been concerned for quite a while
about the safety in apartments. We have checked with other areas and they charge an
annual fee about $20 per apartment complex and so much an unit $1 or $2, and then every
year there will be an inspection made. Our new building inspector has a license for
safety inspection. That is something we are going to put in a new ordinance. Every
year there will be an inspection made.
A property owner that owns Carriage House, Cameo and Sargent Arms, said he has as
much parking as the ordinance stated when these was built and if he was forced to
have more parking he would have to park in the street. He said the people that
are building apartments now can change. He co~plained about not being able to
get cars towed out of his lot that don't belong there.
Jeff Teeples said that before any building anywhere, he would set down with the
builder and discuss the plans of the building, and make sure he is in compliance and
in return gave him back his corrected plans on the house and office building that
he is going to build. They have met with me and complied with the city ordinances.
Shirley Hill complained that her property is next to the tennis court and can never
get out of her driveway because her driveway is blocked when there is a college
activity. The mayor told her when her driveway is blocked, whe could call the police
and have the car towed away. f~1rs. Hill told the council said she had called the police
many times and they will never tow the car away. She complianed that with another
complex, it would be worse. She complianed that they park in her driveway, what
should she do. The mayor told her to sign a complaint. All the apartments owners
complained that after signing a complaint, it takes too long to get any action.
R1erth Kidd complained that 1st West is a bottle neck. If the P & Z knew that there
is a problem, why didn't you ask someone on campus what is the ratio on parking.
That ordinance is 20 years old and is out dated. Every year there is a~~~ increase
in parking.
The mayor said that after this apartment is built and there is more cars than they
can take care of them they have got to find parking for them.
Dean Ricks was ask his reaction. He said in all the apartments they had built
they had always supplied the parking, and we will take care of it again. He said
for those who are crying about they having boys, they would change to girls and they
would be unhappy. Dean said they have complied with the ordinance and the zoning
and done all the leg work that needed to be done.
h1ary Smith said if you pass a new zoning ordinance, it would apply from then on but
it couldn't be rectroactive.
Bruce Casper suggested that the city put up no parking signs on the Hills side of the
street.
The mayor told the group that all apartment owners are going to have to get their
parking lots oiled and we will have to enforce it.
The council said that they would talk to the police about checking that driveways
are not blocked.
BEER LICENCES
f~ayor Porter read a beer licese renewal for Albertsons.
A motion was made by Nile Boyle and seconded by Glen Pond to approve the license.
All voting aye, except Bruce Casper and he abstained.

REQUEST FOR A 4 WAY STOP ON 4TH AND CENTER
Mayor Porter read a request from Ricks College fora 4 way stop on 4th South and
Center. The police have checked it and think it is okay.
THEO FULLh1ER REQUESTED A 4 WAY STOP BE PUT ON 1ST SOUTH AND CENTER
Theo Fullmer requested that a 4 way stop be put in on lst South and Center, because
of the many accidents. The traffic committee will discuss these at the next meeting.
A motion was made by Bruce Casper and seconded by Bruce Sutiherland to pay the bills.

A motion was made by Nile Boyle and seconded by Bruce Casper to approve the
minutes. All Aye.
KAY MILLER REQUESTED A SPECIAL USE PERMIT TO OPERATE CRAFT SHOP
Kay Miller was to the meeting to request a Special Use Permit to allow her to operate
a craft shop at 24 East 1st South. We circulated a petition in that area to everyone
within 300 feet. There was no objections. It is an area that is close to the post
office, and on the other side of the street is commercial businesses. The council
agreed to go ahead with publishing fora public hearing.
LIGHT INSTALLED ON 5TH WEST AND MAIN STREET
Mayor Porter said he contacted that State Highway Department to see when they
would get that light installed, on 5th West and h1ain Street. The hardware
for the lights, the contractor has not been able to secure yet. However he has
assured the highway department that the hardware had been shipped and he would
receive it by December 7 and they would be up here working either the 7th or the
8th.
SAFETY COMMITTEE

Bruce Sutherland reported on,thl Safety Committee, and their recommendations.
1. 4-Way Stop at Center and Viking Drive. They recommended to approve a 4-Way
Stop there for 1 year and in that recommendation to suggest to study the .feasibility
of enhancing the pedestrian flow. One suggestion was an elevated walk. Second
they suggested that in the winter, if the snow gets extremely deep, they should rather
than just scouping the snow up on the medium, that they should consider hauling it
along that area. Third they should run a careful study as to how the 4-Way stop
will effect the flow of traffic. They suggested putting it in as soon as possilbe,
and moderate it for a year.
