A meeting of the City Council for the City of Rexburg, Madison County, held October
21, 1987, at the City Ha11.

A motion was made by Bruce Casper and seconded by Bruce Sutherland to approve the
minutes. All. Aye
PLANNING BOARD HAD REQUEST FOR A ZONE CHANGE
The Planning Board had a request for a zone change at 104 South 2nd East by Dana
and Kay Pliller to put a Craft Shop at that address. We sent a petition around with
Edna Villella. (copy of file). Ten objected to the change and eight did not
object, and we received two written letters objecting. Under our ordinance to
give a Special Use Commercial Permit or have a Zone Change, there has to be 80%
of the property owners okay it. There was two more against it than for it.
A motion was made by Nile Boyle and seconded by Glen Pond the petition to
change the zoning of the property at 104 South 2nd East from residental to
commercial be denied. A11 Aye
SERVICE AGREEMENT WITH UTAH POWER APJD LIGHT
The mayor said we have a service agreement from Utah Power and Light for electric
sere~ic~e at the new stop sign at the corner of 5th West and Main. A motion was made
by Darlene Blackburn and seocnded by Glen Pond that the city enter into this agree-
ment with Utah Power and Light and that the mayor be authorized to sign the agreement.

SAFETY COMMITTEE
Bruce Sutherland gave a report on the Safety Committee meeting.
The main item on the agenda was the recommendation by the State of Idaho to replace
the diagonal parking along main street to parallel parking. After we studied
the letter from the state; we found it difficult to decide how they came to some
of the conclusions, such as how diagonal parking was the cause of so many accidents.
In order to help with the safety problem we have the safety committee drafted a
letter to the council with recommendations concerning Main Street.
1. The parking be angle as it now is, that parking should not be changed to parallel.
2. The flashing pedestrian signs be lowered as much as possible and still allow
the flow of truck traffic.
3. A police parking space be located on f~1ain Street to the east of College Avenue
in front of Kings. We would also like to have police parking on both sides of
College Avenue, as it joins main street. (East side of Inkieys and the west side
of Kings.)
There are several things besides the diagonal parking that causes accidnts that need
corrected.. He said the Committe questioned the way the crosswalk is put in.
The crosswalk crosses in a diagonal across the street. After studing it we realized
the reasoning because of College Ave being a street that you can only turn rignt,
but it is also a little bit confusing for the pedestrian. The committee felt if
these suggestions are implemented, it will help as much as changing the parking.

Bruce suggested that there be a break or breaks in the double line instead of
being continuous. The mayor suggested a turning lane. The council discussed the
problems with crossing the double line.

PEDESTRIAN CROSSWALK ~ ~~
Bruce said they also discussed the request for the Junior High School to have
a pedestrain crosswalk.. Theycbcided to deny that request. We are going to ask
the police to enforce the jaywalking around town and in the college area.
The city has no ordinance on jaywali~ing. The committee is going to look into
it and see if the city should adopt an ordinance. I would help for liability
purposes. Many of the committee are concerned that the suggestion that the
parking along 4th South should be changed to parallel had not been odne. The
mayor siad that the diagonal parking is an error in painting. The suggestion
was made when Ricks College asked the council to close lst East. The people
that painted the parking just painted it wrong. Next year when they do the
painting, we vrill have them paint it for parallel parking.
REQUEST STREET LIGHT ON NORTH EAST END OF SUNSET .CIRCLE

On the south part, bf 2nd East street, we had to adjust the right-a-way, because
there is an irrigation circle that would go into the right-a-way, Senator Mark
Ricks, his son Nile the mayor, the state highway people, and the county met
up there on Friday and looked a situation over and came to the agreement that
the Irrigation Circle be moved over 6 feet. We would still maintain the 100
foot right-a-way and give users of the circle an easement for 6 feet over in
the right-a-way, that won't bother a right-a-way and get any water over on the
street, because if it's 100 foot right-a-way and the street is 46 feet wide.
Some of the people up there thought we would take the turn out, and make it
straight. We contacted all of them and some of them were oppose to taking the
bend out and some of them thought it would be a good idea. The mayor said his
opinion is, we are not building a main thoroughfare, we are building a residential
street, that will serve those people that libe in the area. The curve up there
is designed so you can go 40 mph with safety, however, we will post it at 35
mph. Some people think it is a hazard. The engineering of the street will
make it twice as wide. The project was discussed by the council. The mayor
siad he thought we should approve the present alignment and get on with the
project. A motion was made by Bruce Sutherland and seocnded by Glen Pond
that we stay with ath alignment that has been designed and build the road. All

CLAIM FOR A SEWER BACK-UP
The mayor read a claim for a sewer back-up from Mr & Mrs Jerry Sai~uers.
We need to get more information and investigate it further before we can take
any action on it.
GOLF BOARD
Nile Boyle said the Golf Board would like to recommend that Larry Burns be
appointed to fill and finish out the term of office of Joyce Burns,swho is
deceased. Nile Boyle made a motion to that effect, seconded by Bruce Casper.

ORDINANCE 680
h1ayor Porter introduced the Ordinance 680 to close and vacate a street by Walters
Ready Mix. The Mayor read the first reading of Ordinance 680.

AN ORDINANCE VACATING THE COLSING PORTIONS OF THIRD WEST STREET IN BLOCKS 7 AND
8 OR THE ORIGINAL REXBURG TOWNSITE AS HEREINAFTER DESCRIBED, SUBJECT TO EXISTING
RIGHTS-A-WAY, EASEMENTS AND FRANCHISE RIGHTS OF ANY LOT OWNER, PUBLIC UTILITY
OR CITY OF REXBURG; PROBEDING THAT ALL OF SAID STREETS REVERT TO THE OWNERS OF
THE ADJACENT REAL ESTATE, ONE-HALF OF EACH SIDE THEREOF; PROVIDING WHEN SAID
ORDINANCE SHALL TAKE EFFECT.
The seconds reading of the ordinance will be at the next council meeting.
RESOLUTION TO BORROW ON A TAX ANTICIPATION NOTE
Glen Pond introduced a resolution for the city to borrow on Tax Anticipation
Note the amount of $350,000 with the interest rate of 6.49 percent per annum.

The mayor introduced Nile Fullmer and Paul Kotter who attended the council meeting
and are running for councilman at the up coming election.
A motion was made by Bruce Casper and seconded by Glen Pond at approve the bills.

DEADLINE FOR APPLICATIONS FOR RECREATION DIRECTOR-OCTOBER 20,1987
October 20 was the deadline for applications for Recreation Director. We have eight
applications. The Personnell and Park & Recreation Committee will go over the
applications and review them.
A motion was made by Bruce Casper and seconded by Darlene Blackburn to adjourn.
