The Mayor then called for the voting for final passage of the Ordinance, and the motion was made by Nile .Boyle and seconded by Bruce Sutherland that ordinance 678 be passed. BUDGET Richard Horner reviewed the buget and the changes that have been made. The total budget would be $2,693,100. A motion was made by Nile Boyle and seconded by Glen Pond to pass the proposed budget and set the Final Budget Hearing for 7:30 P.M. on September 2, 1987 for the final passage. All Aye The mayor reported that he had met with the contractors this morning and everything is going good. They will be in Monday with the paving equipment nad get it finalized. GARBAGE RATE FOR BUSINESS OFFICES The council discussed the garbage rate for some business offices, with two or three offices in one office that only have 1 bag of garbage. We have been charging $11 for each office for only 1 or 2 bags of garbage. It was decided to only charge $11 for the entire office if they only have 4 bags. <'USING CHEMICALS IN THE PARKS ~ len Pond stated that we need to talk about the people using wrom squirm in the parks. We have had complaints because the chemical that is used, some people are alergic to it and there might be a liability involved. If we let one of it we will have to let all. The council decided that worm collecting in the park is off limits. A motion was made by Sander Larson and seconded by Glen Pond to pay the bills. All Aye Meeting Adjourned. ~- M ohn C. Present were the following: Mayor: John C Porter Councilman: Sander Larson Glen Pond Bruce Casper Nile Boyle Councilwoman: Darlene Blackburn A motion was made by Glen Pond and seconded by Bruce Casper to approve the minutes. All Aye RESOLUTION Mayor Porter read a resolution proclaming the election. ~~~ 1 A RESOLUTION PROCLAIMING A GENERAL CITY ELECTIOP~, TO BE HELD ON NOVEMBER 3, 1987, DESIGNATLNG THE POLLLNG PLACES; DES.IC~NATLNC THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY CLERK TO GIVE NOTICE OF SUCH ELECTION. (copy attached) A motion made by Glen Pond and seconded by Bruce Casper to pass the resolution. All Aye A group of Cub Scouts Troup 212 were at the meeting. EAGLE PROJECT The mayor read a letter form Robert Brown, a scout working on an Eagle Badge. Robert ask about the street light on Main and 5th West. The mayor said the bid had been let, arad the city, county, and school have put up their money. The light should be done by October 1. =SEWER ON 2ND SOUTH When we put the new sewer on 2nd South, because there was so much damage dcne to the curb and gutter on the north side, we installed a new curb and gutter. Ricks College installed curb and gutter on the youth side. There was a driveway leading from 4th-15th Ward Church, on 2nd South. When the new curb,~.and gutter were put in place, we ask the church if they wanted that driveway continued, they had taken part of it out. At that time they decided it would be okay to leave it out, so the curb was put in without any markings. Since then they found out that the caretaker really needs a maker there, because he loads a garbage and things he has to use that curb for. They would like to mark it for no parking for one parking spot. A motion was made by Darlene Blackburn and seconded by Sander Larson that. the church be allowed to paint a NO PARKING for one parking spot by their church. All Aye ELDERS QUORUP~-COMMUNITY GARDEN An Elders Quorum in the Indian Hills on a small corner lot, would like to put a community garden on it. .They will give the vegatables to people that might need some help. They will clean it all up, there are only weeds now. Nile Boyle said it would be better than weeds. Glen Pbnd said he had no problem as long as they maintain it. A motion was made by Nile Boyle and seconded by Gien Pond. A11 Aye BUDGET u ~c Hearing on the Budget. Richard Horner handed out a copy of the budget. The total budget is $2,693,100.00 Richard told the council that we vdere notified today that we might get somemore Revenue Sharing, of about $6,000. When it comes in we may have to re-open the budget. Mayor Porter ask if there was anyone that wanted to protest or comment on the budget. No one was at the meeting to comment on the budget. A motion was made by Nile Boyle and seconded by Glen Pond to except the budget. ANNUAL APPROPRIATION ORDINANCE NUMBER 679 Mayor Porter-read the Annual Appropriation Ordinance Number 679 AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1987, TO SEPTEMBER 30, 1988, AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AfdD ALL OTHER SOURCES, SUCH .SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1988. A motion was made by Councilman Sander Larson and seconded by Glen Pond that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 679. I~ Those Voting Aye: Those Voting Nay: Sander Larson Glen Pond Bruce Casper Nile Boyle Darlene Blackburn None The roll showed all concilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Countil had voted for the passage of said Ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter de- clared that motion carried. EP~ERGY AUDIT AT THE POL~C= E STATION Richard Horner reported on the Energy Pudit, at the Police Station. Utah Power & Light, Water Recourses, and a man from the state that does energy audit on the police station. They found that the thermostates were fighting each other making the system unbalanced. We will receive a letter form them. We are fixing those thermostates and locking them so they can't be changed and won't fight each other. When the results come back fromti~e state they will have some recommendations on financing and loan or grants to do a study on the guilding, and do what ever remodeling is necessary. The mayor said when we get the written audit report, the suggestions they make, we need to do. We cna borrow from the Water Resources a fund they have from Exxon on an over change on gas. The state is making loans available at 3% interest for cities. I would suggest we make application for one of these energy loans and repair the building. SEWER PROJECT We finished the sewer project. We had a grant and they paid 75% of the cost, and with the money we had from the TEDRO fund we paid the balance. We did add to the project. They gave us a good bid on patching the streets, $2.80 a sgyare yard. We added some projects to this. We put a half soul on the street in front of the college on 2nd South because it was torn up so bad. On 1st West, we did part of a block, from Center Street to 1st West. There will be one more sewer project, not under the same grant. They provide the engineering, but we have to pay for the project oursleves. We ahve it in the TEDRO money, and in the sewer reserve fund. REQUEST FOR STREET LIGHTS We have had some requests for street lights, a list of the lights we ahve requested Utah. Power & Light to put in are: On Apache South lst West - Rainbow Apartment Gemini - 582 East 2nd South - By Snow Building The mayor had not designated the places where the going to make a surbey this week and will tell us lights to give the cost light. ELECTRICAL WHOLESALE'S OPEN HOUSE poles should go. The police are where the best place to put the The mayor read an invitation we received form Electrilcal Wholesale, for the council to attend an open .house from 10:00 a.m, to 4:00 p.m. The old building they had, they gave tot he city to move down to the shop to put sand in so it won't freeze. TREE ORDINANCE Sander Larson- In the study of the trees, Jim Long had told Sander that Mary Magowen, who is the chaper president of the Idaho Montana Chapter of American Land Scape Architects, are willing to do a study at no cost on the city. They would recommend , a type of tree ordinance. DISPATCH Sander Larson- In an effort to try to reslove our differences with regards to the dis- patch system. He had written a letter to the commissioners, the mayor and Nile Boyle urging that there be ballot issue so the citizens would get the opportunity to express themsleves in the up coming election.. It is apparent from their response and the comments that have been made, that they feel that really is not necessary, because it would be too late. Sander said he would Like" to make a proposal, inasmuch as the county is set on taking that operation over, that we give serious consideration to the proposal inasmuch as they are going to take over the dispatch,. that they buy our portion out. With ~~~ The mayor said .there are a few other things that we have to cgnsider. When the city and the county entered into an agreement with Law Enforcement Grant, that we .received, the jail and the annex on the courthouse was built, at that time we join the dispatch together and operate it jointly. There wasn't anything in the agreement that said the city .should run it or the county should run it. At that time the city use to have a police department in our building. We moved the police department down there because the grant money was given for the purpose of consolidating as many things as we could to save some money. I think you would have to look into the legal aspects if the city would pull off the agreement. If the county would say to us you get off the system, then I'm sure they would have to pay. The party that says we aren't going to stay on it anymore, I think they loose their rights in the part of the grant that we got some of that equipment for. Sander ask why that had not been discussed prior to this evening. The mayor said he did discuss it one night. Sander said he probably was absent. Sander said he was distressed that one entity could just unilaterally take over another and the other just sits there and says well there is nothing we can do about it. If they are so insistant in taking it over then I guess what we had better do is to make plans to have our own, and those. users will get together and we will go from there. I think it needs to be investigated and we need to check on this business of dividing it up and sharing on the cost. He said one of the commissioners had indicated that they had money ear marked for the dispatch. The mayor said if they kick us off they will have to pay us some money, but if they say we can still use it just like we have been using it, I don't know if we have any say we can still use it just like we have been using it, I don't know if we have any right to ask for the $4,000. Sander said it had better be determined long before October 1. 4Je have not done a thing, we have just talked about it all summer long. We are at the point where they are saying we are taking it over, thank you very much, and I am saying okay you buy us out. That is the proposal I would like to make. The mayor said the council can vote anyway they want, but he thinks there will be some problems with the 911 line. If there is problems with the agreement and it should be investigated. Sander said the whole thing is a problem, and the general public has not seen the whole significance of what is happening.. We might just have to make our won stand and go our own way. The principal users can work togather and have their own dispatch. I would like to investigate that and move in that direction. The mayor ask Richard how much our own dispatch would cost. He said it would cost us another $27,000, total cost would be about $90,000. Tom Lehman- As a user I am interested in something Sander is saying, we would like to make preparations for what ever the eventuality would be and not be caught flat footed, October 1. This group has voted three times that I am aware of to not participate in that agreement. On one occasion to fund it themselves. With all respect Mayor, what side of the issue you are on is very clear, and I suppose that is political loyalty. If there city is going to do nothing and is going to participate in this under the county terms, that would be well to know in advance so the users can make whatever preparation they need to make. If the city is going to continue the service they have provided all along then I guess I would submitt that it isn't the city that is withdrawing. The county has already withdrawn from the agreement. Are you going to submitt to the county? I don't share the mayors confidence in the Sheriff. Mayor Porter reminded him that the agreement says that the dispatch is going to operate just like it is now. Sander Larson said that if it is going to operated like it is now, it will operate with us running it. Sander said he put a proposal before the group, as I stated it, I think we need to investigate the cost of the operation and be sure we have it all lined up. If they are ready to take it over, we need to see what our buy out portion is and see what the possibility is, and come up with our own system. He said he was respectful of the mayors opinion and of the commissioners opinion and he did not want to get info any personality conflict. The principal is far greater that just the issue of yvho runs the dispatch. It will have an impact to this community for years and years i;o come. I think we need to look into it and make preparations if it is feasible<~ ~~ ~© ahead with our own and have the commissioners work with us and buy us out. Nile Boyle said what we are talking about is to examine the actual. facts and i~ they are a reality we go ahead. It would cost the city an additional $27,000. More than one dispatch in Madison County doesn't make sense. He said he has stror~~ feelings like Sander does on the way it was done, and would not be adverse to getting the facts and meeting with the commissioners and sheriff. Mable Smitf~ told the council how the 911 line worked. She said she thought that the Sheriff was pui~'ing up a big bluff. He won't maintain a full dispatch. Bruce Casper said he thought we should check into Sander's proposal and have an early morning council meeting with the facts and make a decision. Nile Boyle ask if they wanted to make it in form of a motion. Sander said he had already made a motion and there. was na seconds., so ~Qmeone else could make their .Qt~-3-:mAtion, The mayor said we did not need a motion to do what Bruce wanted to do< We need to find out if we have 911 and two dispatchs, where the line will go. We need to have Richard check out the cost of setting up our own dispatch.. Bruce Casper said we need to look into the legal ratifications. It was decided to have na early meeting Tuesday morning at 7;00 a.m. At that time we would have all the facts needed and have the County Commissioners there and made a decision, CROSSWALK FROM BROULIMS TO THE JUNIOR HIGH. Bob Pederson from the Junior High was at the meeting to ask of a possibility of having a crosswalk from Broulims to the Junior High. It was decided to turn it over to the Safety Committee to make a decision. Present were the following: h1ayor: John C Porter Councilwoman: Bruce Casper Bruce Sutherland Nile Boyle Glen Pond Councilwoman: Darlene Blackburn Also Present: County Commissioner: Bruce Webster County Commissioner: Dell Barney Rose Bagley, City Clerk Richard Horner, Treasurer The mayor said as he understood it after. the. last .meeting he was to contact the county commissioners. They were in a meeting, so he was able to contact them. Two of them said they would be at this meeting. They told the mayor that they had voted to back the sheriff. CITY COSTS 1~-r~d~lurner reported on costs- The cost on equipment and moving would be about $5,000, the amount that we are to be re-embursed from the sheriff now is $27,000. You have to consider now if it went to a 50-50 split, the minumum savings to us there would be another $7000. The total difference between the two going with the sheriff and having our own would be at least $39,000. Nile Boyle stated that the city taxpayers would pay about 40% additional on what it would cost the county to run their dispatch. So it would cost close to $60,000. RESOLUTION NO. The general city election will be held in and for the City of Rexburg, on the 3rd day of November, 1987, at which time there will be elected three council persons, each of them to serve for a term of four years. Mountain Be]1 said the only way they could do it at this time is to have the line come into one spot, and the logical choice would be Madison County. They would dispat.eh ihE~ c.a.lls just like they are doing the fire department now. DISPATCH Dell Barney- He felt that the whole thing had been blown out of porportion, and feelings have been hurt. We started out on the wrong foot. The sheriff is the chief law enforcement officer in the county. He has responsibilities and liablilties. That is the message the sheriff is trying to get across. I think this thing cound be worked out very simply. I'm in favor of the dispatch staying together. It is wrong to have the city employees in the county office. We need the whole thing under one head. It should stay in the Sheriff's office. Bruce Webster- I agree. We have been busy and trying to conduct business. We tried to come to a solution. My campaign was to make the county law enforcement stronger. We try to look at all the problems. We appreciate that there is city government. There isn't any question that the dispatch system hasn't created some problems in the Sheriff's office. It is unfortunate that all the talk has been in the newspaper. I have been offended with some of the things that have been said in the newspaper. There was a negative attitude intf~e last meeting. In no way were we trying to take over the dispatch. Ther Sheriff felt that that was the best way to solve that problem. We funded it and that is where it stood. We have not dictated what was going to happen over there. I still think it is a good solution to the problem. I think some of the things said in the paper are uncalled for. If I was Lionel Koon, I would not let Mabel Smith work for me for one day because of the things she has said about him. Dell Barney- Bruce I think that is past history, and if it is going to start fresh, it will have to start fresh. If you want to fire someone it will have to go through the progressive discipline. There will have to be good cause or he is next on the line. Bruce said he thought the things that have gone on in the Newspaper is not called for. Dell- If it hadn't been said it would not have been in the paper. Bruce- I think it will work for the city and the county. Nile Boyle- I agree with De]1, it was done so that personalities came into it. It was done quite underhanded. There is no way we can afford two dispatchs in Madison County so I will make the motion to go along with county on a 60-40 basis or have the Advisory Board determine the amount, implement the agreement. The mayor said there is one thing he would like to straighten up. At the meeting last week Tom Lehman said that I was involved in this politically. I couldn't under- stand if I was helping the sheriff because he was a democrat or helping the commissioners because they are republicans. It was hard for me to understand what he was getting at. I do want it on the record the reason I met with sheriff and commissioners was because the council ask me to. Bruce Webster- I have talked to several of the council members who have voiced opposition to it and I have not found any problems, and hung up the phone thinking that is the end of that and the newspaper come out there is problems. Darlene Blackburn seconded the motion made by Nile Boyle. All Aye Mayor Porter read the agreement. Deil Barney stated that there quite a few members on the board and we need to con~ti~~.t~Ce a quorm. Nile Boyle said we just need to have a majority. Richard ask about if any of the dispatchers were fired who would pay the unemployment because it would cost the city a lot of money.
