P1ayor Porter declared Mayor Porter said we would send a letter and a copy of the ordinance to all the businesses. He would have the police tell all the people that have "A Frame" and other signs onihe sidewalk that they are in violation.. The mayor told the council that when they had met with the commissioners they told him that Nellis Garner had been paying the city $1000 a month too much on fine money. They want the money back. She has been paying this to us for 10 years. A motion was made by Bruce Sutherland and seconded by Sander Larson to pay the bills. Those Present: Mayor: John C Porter Councilman: Nile Boyle Bruce Sutherland Glen Pond Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Mayor Porter announced that Bruce Casper and Sander Larson were out of town and excused from the meeting. A motion was made by Bruce Sutherland and seconded by Darlene Blaceburn to approve the minutes. All Aye. SIDEWALK ORDINANCE/LIABILITY INSURANCE The mayor told the council that after we passed the Sidewalk Ordinance we mailed out letters telling the merchants what we had done and told them they had to be to council tonight to make application and submit copy of their liability insurance. We have quite a lot of inquiries about sidewalk sales, and if they had to have insurance for them. The mayor read the applications with their insurance that we have received Coast to Coast, Wayne and Marlenes, and Kings. A motion was made by Glen Pond and seconded by Bruce Casper to approve above named businesses to have sidewalk displays. All Aye. PETITION FOR A FENCE IN FRONT OF A DAYCARE CENTER At the last meeting Laura Carroll brought in a petition for a fence in her front yard for a day care canter, we gave out approval if no one objected when we sent a petition around to the neighbors within 300 feet. We had no objections. 1 J SPEED BUMP ON BIRCH e mayor o e council that we had a lot of complaints about the speed bump on Birch Street. Nile Boyle said it is a real problem. He had three people call him and say if they put a speed bump on Birch Street, they want one put in front of their house. He said he had driven over it and it was so bad, he had to stop before he. drove throught it. The mayor said he had driven over it and throught it and it was bad. Bruce Sutherland said it really slowed the cars down. Bruce said there is a sign on both sides that says dip, and if they don't see that they won't see the children. Nile said he did not think it should be there. The mayor said he had a man in the City Hall thhat said he was going to sue the city, becuase it knocked his care out of line. STEIiJER DITCH 'fhe mayor said he thought we had heard the last of the Steiner Ditch, bet we had to call the ditch project off. Steiner turned the water in ;the ditci~ to irrigaae his crop. The people in the Parkview addition are trying to get an LID to cover the ditch. 6Je have been working to put in a pump, and put the ditch where it turns on the frontage street put it along the right-a-way over to where Steiners ditch goes under the frontage way. John Millar thinks by installing the pump and digging the ditch, it would cost from $8000 to $10,000. He thought there is still some of the pipe left from the hot well that the county dug. He thinks it is 18' casing, and that it would be alright to use it to cover that ditch with. We won't do anything about it until this fall. We would have a meetii~ng with those people, so they could come in and agree to what we are doing. BILL FROM PHONE COMPANY/H & K CONTRACTORS T e mayor told t e council that we have a bill from the phone company for damaging their lines for $7,144. When H & K put the storm sewer system in about 6 or 7 years ago. On 1st East where the storm sewer comes out of the Seth Wood parking lot up 1st South; when the ®antractor went across that street he ran into a cluster of telephone lines, they lifted them and ran the storm sewer under them. The telephone company had had trouble-with that line and got someone in with a rotto rooter to check it and finally dug it up. The line had cracked. The city should not have any responsibility, the contractor should have cdhled the phone company and the engineer should have inspected it. It has been so long the liability insurance is not in effect. Mary Smith said the statue of limitations has run out. The mayor had turned it over to Fo~rsgren & Perkins to work it out with the telepnone themselves and H & K. A motion was made by Nile Boyle to refuse the claim, seconded by Bruce Sutheland. All Aye. P1ary was instruced to write them a letter. REQUESTS FOR A CAT ORDINANCE ine mayor said there has been a number of requests for the city to adopt a cat ordinance. Mary has several state laws about cats. The council discussed it and decided to think about it. LID GUARENTEE FUND The mayor explained that .under the law we have to maintain a LID Guarentee fund. We have to keep 10% of our outstanding bonds in our guarentee fund. We can transfer that to the general fund. This money is money that is paid by all the tax payers. Ordinance 677 AN ORDINANCE AUTHORIZING THE TREASURER OF THE CITY OF REXBURG, IDAHO, TO PAY $35,000 IN EXCESS FUNDS IN THE LOCAL IMPROVEMENT GUARANTEE FUND TO THE GENERAL FUND OF THE CITY OF REXBURG, IDAHO; PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by Councilwoman Darlene Blackburn and seconded by Bruce Sutherland that the rules requiring an ordinance of general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 677. The mayor then c~l~.led for the voting for final passage of the ordinance, and the motion was made by Nile Boyle and seconded by Glen Pond that ordinance 677 be passed. RE: DEDICATIOPJ CEREMONY FOR THE VOCATION REHABILITATION CENTER The mayor told the council that there would be a dedication ceremony for the Vocation Rehabilitation Center on Friday from 1:30 to 2:30 P.M. RE: PJEW ASSIGNh1ENTS FOR. PLANNING & ZONING BOARD Glen Pond reported on the Planning & Zoning meeting. The board wants to make some new assignments to the Planning & Zoning Board. They recommend that we replace 4 of them now and hold over 4 of them for two years and then in two years replace 4 that are held over and then rotate them every two years. The board will submit some new names to the council for their approval. RE: CLASS PUT ON BY THE IDAHO PLANNING COUNCIL W en we get t e new oar t ere ~s a c ass a is put on by the Idaho Planning Council which would ba good to train the new board. Rod Gilcrest from Idaho Falls would come and teach the class. The city would have to pay his expenses to come to Rexburg and teach the class. The mayor suggested that we invite the real estate people. We will get it organized by this fall. The council agreed that we should go ahead with the class. Glen said a lot of people on the board have been on it for a lot of years and have done a good job. RE: IDAHO CENTENNIAL COUCNIL MEETING The mayor to t e counci tat on u y 31 at the library, the Idaho Centennial Committee will hold a meeting from 9:00 A.M. It will be a breakfast and a reception. They have invited the mayor and council. RE: SPEED BUMP ON BIRCH The counc> >scusse t e speed bump on Birch again. The mayor said he thought it was too deep. Bruce Sutherland ask who decided where to put the bump. The mayor told him Farrell and Blair went up and checked it out and decided where to put it. Bruce Sutherland suggested making it~ a little less deep and also paint it yellow. Nile Boyle said we need to do something and soon. Glen said there is not a street in town that doesn't have speeders. It is too severe and needs fixed. Bruce Sutherland said he would like to see them get and LID to put in sidewalks. RE: COMPLAINTS ABOUT THE STOP PAINTED ON CORNER OF CENTER AND 1ST The counci a a so a comp ian s a ou a way e a een painted on the road at the 4-way stop at the corner of Center and 1st North. The council said it should have been painted in big white letters further back. The council said that the regular painting of the street was not staying on the streets like it should and they wondered why. The mayor told him that all they had to do is contact Jack Van Houten and he will show them how to drive in without breaking the sprinklers. A motion was made by Nile Boyle and seconded by Bruce Sutherland to pay the bills.
