HIGH SCHOOL Sander Larson discussed the unloading zone at Washington School and Madison Jr. High. Cars drop of Jr. High students and instead of turning left they turn right and nearly hit the children getting off the buses. The Safety Committee needs to check it out for a solution. The street belongs to the city. It was suggested that we put a police officer there and ticket the people. The mayor said that we do not have enough policemen to cover that. It was suggested that the chain be put up to keep cars from going out on the north. The council felt that we should talk to Mel Dickerson again and see if they were going to go ahead with the project they proposed last year to make new bus parking and make the street area into a play area. A motion was made by Nile Boyle and seconded by Bruce Casper to approve the bills. All Aye Mayor Porter stated that the council needed to go into a closed meeting to discuss a personnel matter. A motion was made by Bruce Casper and seconded by Nile Boyle to dismiss into a closed session for a personnel matter. Those Present: Mayor: John C Porter Councilman: Glen Pond fJiie Boyle Sander Larson Bruce Sutherland Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the minutes. A11 Aye. SOCCER LESSOfJS TAUGHT IN PORTER PARK Oscar Bustos was at the meeting. He is going to Ricks College and is a professional soccer player. He wants to have a soccer school and use the fields at Porter Park to teach the class for three weeks. The lessons would be every day from 9:00 A.h1, to 2:00 P.P~1. from June. 22 to July 10. He has talked to Vaughn Jenkins and it is okay with him, the city soccer doesn't start until after Mr. Bustos finishes. Jack Van Houten said it would be okay witJi him if they moved from one field to an- other so he could do the mowing and watering. He is going to use a video camera so he can show the players their progress. The mayor suggested that we charge $2 per student for the use of the park. He is charging $30 a week for each player. He ask about using the swimming pool to register the students. The mayor told him he would have to work it out with Vaughn. The council agreed that it would be okay to allow him to use the park for soccer lessons. i~ FIREWORK PERMITS Mayor Porter read applications for fireworks permits. Osco Drug Kings A motion was made by Sander Larson and seconded by Darlene Blackburn to approve the fireworks permits. All Aye 4 WAY STOP SIGN AT CORNER OF CENTER AND 1ST NORTH The mayor read a letter from the residents of Village Community Gardens in appreciation of the new 4 way stop sign on the corner of Center and 1st North. Sander Larson suggested that it would be a good idea to paint on the East and West side of the road "STOP AHEAD" so people would be warned before they get to the stop sign. The council agreed it would be a good idea. PEOPLE HOLDING BEER LICENSES SELLING WINE COOLERS The mayor told the council that all the people holding beer licenses in the city are now selling wine coolers. We have a letter from the Department of Law Enforcement: "It is the opinion of the Alcohol Beverage Control Division that a retailer holding only a beer license may sell items labeled as wine coolers if the alcohol content by volume does not exceed 5.06% alcohol." These are on sale at the stores that have beer. GOLF COURSE BUYING A LAWNMOWER The Golf Course is buying a Jacobsen's Greens King IV lawn mower. In order for them to buy this they want to put it on a contract, and we need to pass a resolution saying it is okay, they can buy it under the same law that the City of Rexburg can buy it. We will be buying it and the golf course will be paying for it. A motion was made to pass a resolution by Nile Boyle to purchase a Jacobsen's Greens King IV lawn mower for $8552.16 on a contract with payments of $235.35 and the down payments being $855.22, the balance to be financed would be $7746.94 with a document fee of $50.00, and 36 monthly payments at an interest rate of 5.9%, seconded by Glen Pond. Those Voting Aye: Glen Pond Nile Boyle Sander Larson Bruce Sutherland Darlene Blackburn 1 Those Voting Nay: SEWER PROJECT None The mayor said they had a meeting with H & K Contractors at the Engineers office to to over the schedule of work to be done on the sewer project. They are ready to start on July 6, and as they do each one of the projects they will finish it up. ,They expect to be all finished and cleaned up by July 18. The areas that will have an impact on travel around Ricks College because of the first ones they will do. They will also have a full time inspector. Contractors attending the meeti:n~ were: Dean Ricks, Charles Zollinger, and Wayne Parkinson. LETTER OF COMPLAINT Mayor Porter explained we received a letter not signed complaining about a few things that the city had done. He told them the city tries to not interfer with anyones private business. There was a complaint about patching the parking lot at the Huskey Service Stateion, on other time we parched a hole in the Post Office driveway. The problem they have is there is a small break in there parking lot, to have someone come in and fix it costs as much to haul the hot mix from Idaho Falls as it does to do the whole job if somone has the min. None of the jobs were very big. We were paid $350 from the Huskey Service Station, so we haven't charged very much. When Dean Ricks tore up all the blacktop to build his apartment complex, he gave us the black- top, which we have stored and that is what we are using to patch with. In return, he had a break in one of his student housing parking lots and we have agreed to patch that for him in return for the blacktop we got from him. I suggest that any contractor that is in that business and needs to. patch a parking lot that they get in touch with City Hall and the city could haul the hot mix up for us and reimburse the city or if they want to haul it up and haul some for the city. WEED MOWING AND LOT CLEANING They also complained about weed mowing and lot cleaning. We would like someone else to take that over, because we don't have the time. ~J LETTER OF COMPLAINT- WORK DONE FOR THE CHIEF OF POLICE Another complaint in the letter was, we did some work for the Chief of Police What happened was we were looking for some top soil, and he said he wanted to widen his fishing pond and we could have the top soil if we would come and get it. I told Farrell Davidson to take a truck out and get the top soil. He hadn't been out there 10 minutes and the phone started to ring. We won't do that again. Another thing is the state law gives us a $10,000 limit that we can make equipment purchases without bidding. We can also do $5,000 worth of work without bidding. When purchasing anything over $100 or if we do any sewer or water lines we get bids even if it is under the $5000. We do try of not interfer with private business. If private contractors come in and do work for us, we hace to insist that they have Workmans Compensation, a IRS fJumber, and a City License. Dean Ricks- I think we elected the officials and if they can save us tax money by getting top soil from Blair Siepert or taking blacktop to fix pot holes, and fixing a small pot hole in a parking lot. I think it is a small contractor that objects to that. Charles Zollinger- I don't think the city should be doing anything for private individuals unless they do it for everyone. The city should not be in business. I don't think they should have been Bitting top soil from Blari Siepert, I don't think they were getting top soil out of the bottom of the pond. As far as the asphalt was concerned, they should not patch for provate individuals. Mayor Porter told them that when somone wants their sidewalk replaced, we allow them 20¢ a square foot and then they pay the rest. Sometimes we need the broken concrete and we pick it up and haul it. Wayne Parkinson- There isn't that much work going on around here, so anytime the city does a job it takes money from the contractors. They told him that we would be more careful. Wayne complained that he had to buy a business license but there are a lot of contractors that come in from out of town that don't have to buy a license. There are a lot of capable contractors in Rexburg, He suggested that it would help if the city could divide some of the big jobs between local contractors it would help, even if it cost 5% more it would be better to go to local oontractors. The mayor told him that we could not do that. ORDINANCE Mary Smith read the sidewalk ordinance. ORDINANCE 676 AN ORDINANCE TO PROb10TE THE GENERAL HEALTH AND SAFETY OF ALL PERSONS TRAVELING OVER OR UPON OR OTHERWISE USING THE PUBLIC SIDEWALKS WITHIN THE CITY OF REXBURG, IDAHO, TO INSURE FREE AND UNRESTRICTED ACCESS OF THE PUBLIC TO THE PUBLIC SIDEWALKS AND THOROUGHFARES, RESIDENCES AND BUILDINGS ABUTTIPJG THE SAME; PROVIDING FOR EXCEPTIONS AND THE INDEh1NIFICATION OF THE CITY FROM ALL LIABILITY BY REASON OF THE USE OF SUCH EXCEPTIONS; PROVIDING FOR A PENALTY FORA PENALTY FOR THE VIOLATIONS OF THE PROVISIONS OF THIS ORDINANCE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN SAID ORDINANCE SHALL BECOME EFFECTIVE. The council discussed the ordinance. A motion was made by Councilman Sander Larson and seconded by Councilman Nile Boyle that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 676. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Nile Boyle and seconded by Glen Pond that ordinance 676 be passed. Those Voting Aye: Those Voting Nay: The roll showed all councilmen present majority of all the members of the city ordinance, and that said ordinance was the motion carried. P1ayor Porter declared Mayor Porter said we would send a letter and a copy of the ordinance to all the businesses. He would have the police tell all the people that have "A Frame" and other signs onihe sidewalk that they are in violation.. The mayor told the council that when they had met with the commissioners they told him that Nellis Garner had been paying the city $1000 a month too much on fine money. They want the money back. She has been paying this to us for 10 years. A motion was made by Bruce Sutherland and seconded by Sander Larson to pay the bills. A motion was made by Bruce Sutherland and seconded by Darlene Blaceburn to approve the minutes. All Aye. SIDEWALK ORDINANCE/LIABILITY INSURANCE The mayor told the council that after we passed the Sidewalk Ordinance we mailed out letters telling the merchants what we had done and told them they had to be to council tonight to make application and submit copy of their liability insurance. We have quite a lot of inquiries about sidewalk sales, and if they had to have insurance for them. The mayor read the applications with their insurance that we have received Coast to Coast, Wayne and Marlenes, and Kings. A motion was made by Glen Pond and seconded by Bruce Casper to approve above named businesses to have sidewalk displays. All Aye. PETITION FOR A FENCE IN FRONT OF A DAYCARE CENTER At the last meeting Laura Carroll brought in a petition for a fence in her front yard for a day care center, we gave out approval if no one objected when we sent a petition around to the neighbors within 300 feet.
