Richard came up vaith another 50,000. TREE COMMITTEE Sander Larson reported that Jim Long would be willing to serve on the Tree Committee. NEW GARBAGE TRUCKS Darlene Blackburn reported that she had gone fora ride in the New Garbage Truck with Vern Winters. She reported that he is doing a good job in that department. A motion was made by Nile Boyle and seconede by Darlene Blackburn to pay the bills. All Aye LAW SUIT Oid ROAD AND BRIDGE WAS SENT TO THE SUPREME COURT The mayor reproted that the law suit on the Road and Bridge has been sent to the Supreme Court. MINUTES OF THE CITY COUNCIL MEETING May 20, 1987 State of Idaho) County of Madison( City of Rexburg) A meeting of the City Council for the City of Rexburg, Madison County held May 20, 1987, at the City Hall. Those Present: Mayor: John C Porter Councilman: Sander Larson Glen Pond Nile Boyle Bruce Casper Bruce Sutherland Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley „ City Clerk Richard Horner, Treasurer A motion made by Sander Larson and seconded by Darlene Blackburn to approve the minutes. All Aye APPACHE DRIVE iNf`tcF~lebs er of Apache Drive was at the meeting to ask about the light he requested and also street repairs. The mayor told him that we had approved the light, we are just trying to get all of the lights that we are going to have put in and have the Power Company do it all at one time. Mitch was concerned about the deterioration of Apache. He said it could have been repaired with a lot less money 30 days ago than it can now. His concern is why isn't it being re- paired and is just patching the answer. If you don't get started on it, the cost will be more each day that you don't get started on it, the cost will be more each day that you don't start fixing it. There are 45 children that live on that street and it is dangerous the amount of cars parked on the street and other cars dodging the big holes. He would like some action taken on this street. The mayor told him that Bruce Sutherland and Farrell Davidson went upp there and checked the street, the problem is we don't have enough money to re-do the street. The mayor told Farrell that as soon as .the hot mix plant gets in operation to get it reparied, The mayor said it waa already to go as soon as the storm lets up. Mitch. said they had been up there and jackhammered out the bad spots, but he was disappointed that no one has been up and swept it up, it is a terrible mess, The mayor said he would find out tomorrow. Mitch said if your're going to come up and fix the street and it will be a while, he suggested that they come and clean up the big chunks of rock and clean the mess out in the gutters. INTERSECTION ON THE CORNER OF CENTER AND 1ST NORTH A group of citizens were at the meeting to talk about the intersection on the corner of Center and 1st North by the Library. STOP SIGN Clarence Mower- We need a stop sign at that crossing real bad. There is going to be someone killed up there on that crossing if there isn't something done. We need council a petition (on file). Ray Hill- I'm in favor of the 4-way stop. George Madson- Something needs to be odne, there is a lot of old people crossing and kids crossing to go to the library. Bruce Sutherland- The Safety Committee discussed and they are concerned. They have ask Blari Siepert to have the Police Department do a traffic count. Miriam Lynn- How about a green light with buttons for crossing? The mayor told her it would be too costly. Gerland Squires- I walk downtown a lot and when I cross the street I have to wait about 15 minutes. Bruce Sutherland said the Traffic Council felt there was a problem and after they get the report from Chief Siepert they wanted the council to review it, they would make a recom- mendation. Glen Pond- He felt that we had created our own problem allowing the library to be built out too far. Bruce Sutherland said another problem is there is more North and South traffic with the shopping center. Mayor Porter said he was in favor of a 4-way stop. George Madson said there is 2 or 3 times a day when there is heavy traffic. Zola Kohl- I will not take my life in my hands to patronize the downtown businesses by crossing that street. Clarence Mower- He suggested that we use 2nd North as a through street instead of 1st North. The mayor told him that that street has a lot of problems too. He told the group that the council would take action on it. SELLING AT GAMES IN THE PARKS The mayor told the council that he had a lot of people and organizations that want to s-ell hot dogs and things at the ballgames in the parks. He thought we needed to make some rules and regulations so we would know how to pay a fee. If they register we can control it so there isn't two groups at the same time. Bruce Casper thought they should have a big enough comittee so they can police the grounds after and clean up the mess. If they use the building at community park, they needed to sign up for the building and pay a fee for the use of the electricity, but not charge a fee for the other parks and allow those only during ballgames and register at the City Hall. The fee decided to charge for the building at community regulations for groups using the park would be $15.00 a week. We would make up a contract with the rules and regulations for groups using the park for that purpose. SAFETY COMMITTEE Bruce Sutherland reported on the safety committee and the things they discussed. (1) They discussed the sidewalk ordinance and felt it was a good ordinance to adopt. (2) They met with the people about the stop sign at' the corner of 1st North and Center. It was the feeling that there should be a 4 way stop put in. They had called Blair Siepert to do a traffic count and make a recommendation. (3) Proposal to close 1st East between Third and Fourth South, they endorsed that with the recommendation that they have parallel parking instead of diagnal, on Viking Drive. (4) Traffic flow on Birch Ave, it is dangerous and they have recommended a speed dip on Birch. They will have the Chief of Police make a study as to where the speed dip be located. A motion was made by 6ruce Sutherland and. seconded by Glen Pond to put a speed dip on Birch. All Aye LID ON A SIDEWALK Glen Pond ask Bruce Sutherland about the sidewalks on that street that they had talked about. Bruce said there wasn't enough people that wanted to go on an LID to get a sidewalk. SANDER CARSON REPORTED ON THE TREE COMMISSION Sander Larson reported on the Tree Commission. 1. It is felt that there should be developed a master plan regarding tree planting in the city. A review of the city will be made as to where trees are needed. 2. Suggestion for planting would possibly be along streets that could help soften the impact from commercial zones and residential neighborhoods. 3. Certain businesses could bennefit from trees planted where the type of business sometimes stands out in the surrounding setting. 4. Help with the overall planning of trees to be used on the 2nd East street im- provement project next summer. 5. Establish a suggested tree list which would be helpful to neighborhoods in establishing trees on the street. 6. A budget should be established for these projects. The master plan could suggest how much to do each year. Perhaps the city could join in with suggested projects to share the costs with the neighborhoods. STEINER DITCH Mayor Porter reported on the Steiner ditch. The city dug the ditch in the city right-a-way, moved the headgate from the old ditch into the new ditch. After the ditch was dug, we opened the headgate and it worked. We had one problem, right where the ditch was to be dug was a telephone cable so we had to be careful. We put a culvert in so the neighbor could get into his field and we will put one more culvert in. TRANSPORTATION DEPARTMENT We have three things from the Transportation Department. (1) We have a contract with the state to come in and inspect all of the bridges inthe city. They were in Rexburg and sent the report. All of our bridges are alright with a few exceptions that need to be fixed. One of them the signing was backwards, they found some deteriation of the bridge decks where there have been some checks. We will put some asphault in the cracks. (2) We got a letter from the Rigby Office and they have money available to reparr~ the Railroad Crossings. They will repair three of them: 1. The one on Main Street, 2. South 5th West, 3. West 2nd North. We may have to pay 10% of the cost. They are coming in to take care of that. (3) At their last meeting the Highway Board reviewed all the urban projects for 1988. They have our project on those they reviewed Main to 14th South, the 2nd East project. They have set aside $1,182,000 that is our share and they will provide up to $1,900,000 and that will start in 1988. WATER RESOURCES We received a paper from Water Resources.. There is a story telling about when the gasoline crunch was on one of the gas companies charged too much money for gas. There was a law suit and the company lost, it was Exxon Oil, so they had to turn over os much money to the state of Idaho. They are using that money to make loans to cities, counties, and school districts to make improvements that would save heating costs. They will loan the money at 3% for 5 years. The mayor wrote to them and suggested that they come up and look at the Police Department. CITY DOING WORK FOR PRIVATE INDIVIDUALS The mayor said he had received a letter from a concerned contractor. He complained that the city was doing some work for private individuals, he thought that was un- fair. We have cleaned up some lots and charged them and fixed some chuck holes in private parking lots and changed them. The mayor suggested that we write a letter to the contractors in Rexburg and have a meeting and go over all these things and get suggestions from them. COMPUTOR BIDS Richard Horner told the council that he had put a summary of the computor bids in the packet. (copy attached) The bids were opened last Tuesday and Richard I i and the mayor had gone over them. Richard explained the bids to the council. The low bidder on the financing was Idaho Fri.st National; ~t 8.16% APR; Processing fee: .25% or $89.85; Payments 5 years @ $731.39 per month. Authorized Signer: John C Porter, Mayor. A motion was made by Nile Boyle and seconded by Bruce Sutherland that we excepted the bid as presented by Richard Horner. All Aye INSURANCE FOR THE SLIDE The council discussed the insurance for the slide. The mayor told them that we have tenatively got insurance for $3800 with the same company that Pocatello has there insurance with. ONLY FIREMEN RIDE IN THE FIRE TRUCK The mayor discussed with the council that from time to time when there is a parade or for the arrival of Santa Claus the firemen are ask to use the fire truck. Sometimes they have had some little kids on it. They are concerned about the insurance coverage. The mayor told Rex Larson to talk to the insurance company about it. The insurance company said we should come up with the things we would allow the firemen to use the truck for. Rex and the Mayor felt that if it was used for this type of things they should just allow firemen to ride on the truck unless they had a special guest that was authorized to ride. CURBSIDE LITTER RECIPTICALS The mayor told the council that we need somemore curbside litter recipticals. We need to replace some. ORDINANCE READY TO CLOSE STREET The mayor told the council that we have the ordinance ready to close the street of lst East Between 3rd and 4th South. The council discussed that if we were ready. The council stated that they wanted something in writing that the college would give us an easement for 9th South. ORDINANCE 675 AN ORDINANCE VACATING AND CLOSING ALL OF THAT PORTION OF FIRST EAST STREET BETWEEN THIRD AND FOURTH SOUTH STREETS IN THE CITY OR REXBURG, IDAHO, AND DIRECTING THAT THE VACATED PROPERTY BE CONVEYED TO THE ADJOINING PROPERTY OWNERS. A motion was made by Councilwoman Darlene Blackburn and seconded by Councilman Sander Larson that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 675. Those Voting Aye: Ordinance 675 was then placed before the a voting for final Passage of the Ordinance, and seconded by Darlene Balckburn that the a motion to ammend the previous motion and that the college give the city an easement South, seconded by Darlene Blackburn. Porter, Mayor The council discussed the corners of 2nd West and 4th South and the corner across from the Fantastic Inn. Lt is a disgrace and something has to be done, Bruce Sutherland said he thought we needed to pass an ordinance not allowing wrecked cars like that on the lots. A motion was made by Sander Larson and seconded by Glen Pond to pay the bills. All Aye SCOUT TROUP A group of scouts were at the meeting. FIREWORKS PERMITS Mayor Porter read applications for Fireworks permits. 1. Lynn and Sherrie Webster at Broulims Parking lot. A motion was made by Bruce Casper and seconded by Nile Boyle. All Aye 2. Don and Brenda Pollard at the Maverick Store. The mayor had told them that we did not allow any fireworks to be sold where there was a gas pump. She tole him that some cities would allow htem 50 feet from a pump and some would allow them 100 feet from a pump. Gordon Tychsen, the fire inspector, was opposed 'f or any fire works where gasoline is-sold. Last year we had a fireworks stand explode. Nile Boyle made a motion that we would approve the license if it was located where there is not any gasoline sold. All Aye SEWER PROJECT The mayor told the council that the precious Tuesday night we had a bid opening of the :sewer projects that was going to be done this summer. The engineers estimate was $420,210. The low bid was by H & K Contractors for $297,398. The highest bid was $565,382. The state who is paying 75% of the cost have requested that we have to have a resolution saying we bid it and did everything leagally, and authorize the mayor to sign all documents. RESOLUTION A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF REXBURG, IDAHO AUTHORIZING THE MAYOR TO SIGN ALL APPLICATIONS, GRANT AGREEMENTS AND AMENDMENTS,AND OTHER DOC- UMENTS RELATING TO WASTEWATER FACILITIES PLANNING AND CONSTRUCTION GRANTS. A motion was made by Bruce Sutherland and seconded by Sander Larson except the bid and adopt the resolution.
