MINUTES OF THE CITY COUNCIL MEETING
April 15, 1987

A meeting of the City Council for the City of Rexburg, Madison County, held April
15, 1987, at the City Hall.

A motion was made by Sander Larson and seconded by Bruce Sutherland to approve
the minutes. All Aye.
LAURIES MUNCHIES
the council discussed Laurie's Munchies business license. He had given a des-
cription of places he would park his truck. The business location he is considering
for his kitchen is at 30 North 2nd East where Party Pizza was. It is a lunch wagon,
he will sell sandwichs out of his van. The mayor told the council to think about
it and be ready to make a decision at the next council meeting.
COVERItdG DITCH AT PARK STREET
A group from Park Street was at the meeting to discuss covering covering the ditch.
The Mayor gave a report on it. Farrell met with Dale Steiner, and he is favorable
to have the ditch closed and pump the water out of the canal. We are in the process
of getting an estimate on just how much it will cost to put in a pump and cement
catch basin. They have something similar to that out at the Twin Lakes Golf Course,
and the cost of that was approximatley $8000. The engineer thinks the cost will be
about the same down on Park Street. The cities cost of putting in the culvert would
probably be alot more than that. The cost to the people, if you wanted to put a culvert
along the entire ditch would cost $21,000. The only thing Mr. Steiner is concerned
about is the cost of the power. The mayor suggested that everyone along that street,
rather than be taxed with a Local Improvement District to put the culvert through, would,
during the summer monthes be assessed on their water bill and extra dollar each month.
That would pay the power bill for the pumping and the city would pay part. The mayor
told them that thecity would install and purchase the pump. Everyone would participate
in the cost of pumping only during the summer months. A motion was made by Sander
Larson and seconded by Nile Boyle to close the ditch and pump the water out of the
canal. All Aye.
HAULING GARBAGE
The mayor said we have had a lot of people calling up and thanking us for hauling
limbs and extra garbage. He suggested that some of the costs that are in pretty
bad shape and we need to go in with a grader, backhoe and loader and haul rocks
and the stuff off. But if we charge $50 and hour for the loader and $40 an hour
for the backhoe it will run into a lot of money. Pocatello and some of the other cities
have set a maximum charge. He said he would like to set $100 as a charge and we would
go in and clean them up. It would be a one time thing and then we can go in during
the summer and mow it and keep it up. If they don't want us to do it and won't do it
themselves, we can go in and declare it a nuisance. Most people cannot afford anymore
than the $100. The council agreed to it.
ABANDONED HOUSE WEST OF BROULIMS
Sander Larson ask about the abandon house West of Broulims. The mayor told him that
Richard Smith & Don Rasmussen bought it and were going to remodel it, but they abandon
their plan. It is a Historical monument, any work done on it would be a tax write
off. We will get the property cleaned up.
CITY TREE COMMISSION
Sander Larson recommened that we establish a city tree commission. We get someone like
Jim Long and other interested parties help in the spring to promote in trees that
are planted to beautify the city. They could be placed around businesses that don't
blend in with the neighborhood. It would upgrade the entire community. There are
ordinances for trees that other cities use. Every spring they look at it and make
Suggestions to the city council. The mayor said he had a book put out by the State
Horticulture. The head of that from Moscow called and said that ~~~hen we do 2nd East
they will have a committee come in and give us some suggestions about the type of
trees to plant. Sander Larson said there are a lot of things we could do with the
area arouncz the river to beautify it.
1~1AYOR SUG~aESTED GERALD TAYLOR TO SERVE 01~! THE AIRPORT BOARD
The mayor told the council that we have not appointed anyone to replace Art Porter
after he resigned. He said he would like to suggest the name of Gerald Taylor to
serve on the Airport Board. A motion was made by Nile Boyle and seconded by Darlene
Blackburn.. All Aye.
REWURK THE ZONING ORDINANCE
The mayor said at the last meeting of the Planning & Zoning we decided to reworl; the
zoning ordinance. The committee. to do it is Mary Smith, the mayor, Chuck Porter and
Jim Keller. He said he had been spending a lot of time on it going over the old
ordinance of Arlo Nelson's. He thought it fits everything, the setbacks are the
same except if we want to in a new area we can have the business set back to 10 for
example in a Subdivision, if there is any business or commercial areas there. He
had taken it down to Ross Reese and "left a copy with him. They had gone through it
in a hurry and Ross thought it would serve very well. The mayor gave the council
a copy of it and ask them to go over it. Ross was concerned in the hearings about
giving a conditional use permit, if the property was sold they could not continue
using it fora business. In Arlo eelson's Ordinance, if it is granted by the council
then it becomes in conformance with the zoning of which a conditional use it permitted.
Glen Pond said he did not know if it would solve the problems. The Planning &
Zoning's original intent was to get the thing re-zoned so they would not have to be
faced with variances all the time. The mayor said at the meeting they decided to
make the changes that would not make any difference and put it on the map. We felt
that no matter how careful we were someone would be in for a variance. We could be
tough and say we have everything the way we wanted.
MAYOR TOLD THE COUNCIL HE HAD MET WITH THE IDAHO ENVIRONMENTAL AGENCY
The mayor told the council they had met with the Idaho Environmental Agenvy. EPA
informed the engineers that there was somemore money available to enlarge the scoop
of our project. We made applications for 5 sewer lines to be improved around the
city. They only granted the money to improve 3 of them. The engineers and the state
discovered that there was one line that had been eliminated that had a serious problem
it went under the school property. The engineers have a way to solve the problem.
The sewer line goes down in the middle of the block by the Washington School, and
they want to run the sewer line down the street that is closed out to f~1ain Street,
from Main street down to 3rd or 4th East under the Railroad track. They will put
a larger sewer line on Main Street and also split this line that they are having
problems with that goes under the school. Richard said we have the money in TEDRO
sewer money for matching funds. They will have the bid ready by the lst of May.
CITY IS BEING SUED BY JEANETTE SMITH
The mayor told the council that the city is being sued by Jeanette Smith, the girl
that was hit on South 2nd East by Brent Hill. The suit is for $300,000. (On file)
A motion was made by Bruce Sutherland and seconded by Darlene Blaceburn to deny the
claim. All Aye. The mayor said we .would turn it over to the insurance company.
VIKING STREET
Sander Larson told the council that the college is nearing theCentennial Celebration.
He would like to request from 2nd East to 2nd West on 4th South to change the name
of the street to Viking Drive, but Mary would have to draw up an ordinance.
REQUEST TO CLOSE 1ST EAST BETWEEN 3RD AND 4TH SOUTH
Sander Larson said he had a proposal from the Campus Police and Campus Planning
to request to close lst East between 3rd South and 4th South. There are 900
students that live along that street, who cross that street each day several times.
There are also many parents dropping off and picking up children from the Child
Development program each day. The mayor said we would have to have a hearing to
close the road. The council could see no problem.

Mary Smith. said she would proceed with the public hearings to change the name of
the street and close the street that Sander had requested.
HISTORY DEPARTMENT AT COLLEGE
The mayor said he had been trying to find out who is the head of the History Depart-
ment at the college. There was a college back in flew Jersey who invited high schools
to come in and hold a constitutional convention. They had the kids go over the con-
stitution to say how they would change it. This would be for the Bi-Centennial of
the constitution. Sander Larson daid he would talk to them about it.
EXON CORPORATION
The Exon Corporation were fined a million dollars for over charging during the gasoline
crunch. Each state got so much money. They are making low interest loans for energy
conservation, with the money. He suggested that we apply for one of these loans for
the Police Department's heating system. We are having a lot of trouble with it. The
council agreed to this.
A motion was amde by Bruce Casper and seconded by Bruce Sutherland to pay the bills.
All Aye.
A motion was made by Glen Pond and seconded by Darlene Blackburn to adjourn. All Aye.

A motion was mady by Nile Boyle and Darlene Blackburn to approve the minutes. All Aye
REQUEST VARIANCE FOR A FENCE
Mr & Mrs Dan Thomas were at the meeting to request a variance for a fence. They have
a corner lot at lst North and 3rd West. He showed pictures of his property. They
requested to build a 4 foot chain link fence. They want to come out 8 feet back from
one side and 7 feet on the other side. Their house is already 7 feet back from the
other houses, they to line up the fence with the other houses going out 7 feet from
his house. Their house is set back 27 feet from the property line and the other houses
set back 20 feet. In the other direction they would like to come out 8 feet from the
house. The problem there is down the other street there is nothing to line up with,
there is no established line. The mayor ecplianed that on a corner lot, on both sides
of the street are counted as the front. The zoning ordinance says you can't build
a fence in front of your house. Mr Thomas would like to put a fence in like we allowed
on Center Street across from the post office. it would be a chain link fence 4 feet
high, and won't be close to the sidewalk. There is plenty of vision for cars. A motion
was made by Darlene Blackburn and seconded by Glen Pond to approve a 4 foot high fence
