If it is right that we are not actually taking care of the d~,a,monds, they are, then I think we should check on it. He said the girls turned the $2 per player over to the city and the others couldn't do it. Bruce Suther- land ask if there was any contract signed last year, Bruce Casper said no but there will be this year.. Nile Boyle said he didn't think we could go back and collect. He thought that the football was different. The council decided that Bruce and Richard go ahead with the new policy but not collect on the old bills. RE: EAGLE PROJECT Bruce Casper said he had a boy that wanted to get his Eagle project and ask if he could replace the boards in the dugouts. The council agreed that he go ahead. Nile Boyle made a motion to pay the bills seconded by Bruce Casper. All Aye. RE: SEWER LINE FROM 2ND W TO 3RD W ~~layor Porter said there is a block in Rexburg has no sewer line, from 2nd W to 3rd W, in the block where American Oil Company and goes through where the Cureton Property is on 3rd West. Those people have agreed to pay their share, and they will have to pay to hook on. We have a bid on it. Wayne Parkinson was the low bidder at $1860, and the highest bidder is $4645. We are putting a water line on North 5th West where Beesley's are building a home, the high bid was $3857 and the low bid was $870. There will be more cost on the sewer line because we have to get the basement throught that black, and get a survey through there. Adjournment. John Mayor r~ ~~ ~. Those Present: Mayor: John C Porter Councilman: Bruce Sutherland Bruce Casper Glen Pond Nile Boyle Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by PJile Boyle and seconded by Darlene Blackburn to approve the minutes. RE: REQUEST FOR VARIANCE TO PUT A ONE OPERATOR BEAUTY SHOP Sheryl ~~loulton was at the meeting to request a variance to put a one operator beauty shop, with no signs, no advertising in the home at that address. The zoning is Residential. The Planning & Zoning reviewed it and made a recommendation that it be approved to be given a variance. We had the building inspector take a petition around to everyone within 300 feet of the property. Some people weren't home, there weren't any objections. ;nary Smith said we would have to issue a Special Use Permit and have a special hearing. A motion was made by Nile Boyle and seconded by Bruce Sutherland that we have a hearing for a special use permit to allow the beauty shop. All Aye. The hearing would be set for ~1ay 6, 1987. RE: WENDELL WOODHOUSE REQUEST FOR A CATERING SERVICE Wendell Woodhouse was at the meeting to request setting up a catering service in Rexburg. His son has a catering service in Idaho Falls, he takes it around to the schools and sells sandwichs. He said he had talked to Mr. Pederson at the Junior High, and he has no objection to us selling to the kids. He had also talked to Mr. Hill in the school District and he said it was okay, as long as we found somplace to park. We coundn't park on school property. He had not found a place to set up the business. They would set up a little 10 X 12 kitchen which would not be open to the public. We would make the food in the kitchen and disperse it to the catering truck. It would be an inspected kitchen. The Mayor told them the only problem he could see was parking on the streets. We would only be stopped for 20 or 30 minutes. He said they would clean up the wrappers before they leave the area. In Idaho Falls, they park on the street and sell off the sidewalk. The ~1ayor told him he would have to figure out the parking areas he wanted to use, and the time and park in a parallel parking place.. Glen Pond told him the kitchen would have to be set up in a Commercial Zone. He was told that he needed to pick out the spots he wanted to park and give that information to the city hall before the next council meeting for approval. The council would check into the ordinance they have in Idaho Falls governing this type of business. RE: RESTORING CAROSEL AT PORTER PARK Pat Burton was at the meeting to represent a group of ladies who are interested in restoring the carousel. They thought it would be a good Idaho Centennial project. We talked to Shane Anderson, whose family restored it once before. We would like to restore it with wooden horses, it possibly will cost $3000 each. The mayor said the reason that the city bought fiberglass horses, was because the wooden horses got broken so easy. The mayor told her there is a national carousel organization, and they have this one listed. There is a salesman that comes up to Anderson Lumber, who is a member of the national carousel organization. He said they are touring this area this summer and this would be a stop for them. firs. Burton said she thought if we could involve the whole city in restoring it there would be a difference, the way it was taken care of. Last year we completely rebuilt the drive shaft. firs. Burton said they would like to know ~if they have the city council's support and if there would be a place they could work on the equip- ment. They need to see what parts are around and get a target price. The mayor told her we would be glad to .have them do this, and possibl~;~ they could get volunteers to fund it this summer, they could take z the money for the restoration. The mayor suggested that they take one horse off at a time. The council said ~,€~ey would give them their support. RE: BEER LICEfJSE REQUEST o~ayor Porter read a request fora Beer license for Glynns °'larket, manager Larry Robb, for bottled and canned beer. A motion was made by Glen Pond and seconded by Darlene Blackburi to approve the beer license. All Aye. RE: PLAfJfJIfJG AfJD ZONING f~1EETING, fJEW ZONIhJG ORDINANCE The mayor reported on the P Tanning & Zoning meeting. They discussed the problems we had with the new zoning ordinance, that came out in the public hearings. ,after they discussed the various problems they decided to take the old ordinance, and take parts out of the two new ordinances, the Arlo Nelson Ordinance and the Greg Newkirk OrdinancG~ and combine the three. We need to establish one more commercial zone and a professional zone. The set V~acks will be the same as in the ordiancne we have now. In the areas where there is a consensus of everyone wanting a change of the zone, we could make that change at one hearing. After that if anyone wants a change we will have to go through the hearing process. RE: CITY CLEAfJ-UP The mayor said we have been making an effort to clean up lots around town while we have some time. Across the street form the 3rd Ward church we have cleaned up that lot nice. We have been calling people about their lots. We have ahd some requests from people about a house and trailer house on West 2nd North between 3rd and 4th West. The mayor said he tried to get in .touch with the owner that day to get him to clean it up, but could not find him. He would get in touch with him the next day. LJe are going to get tough with people and amke an effort to get thim to clean their lots up. The mayor told the city attorney that he would like her to make somekind of a form that lets them know that if they don't clean them up themselves, or let the city of in and pay them for it, we will do it and put the costs on the tax roll. We try to get people to comply and a lot of people do, consistant and any lots that are not in compliance get tough about it. RE: CITY IPJSURAfJCE CARRIER TELLING EP1PLOYEES fJOT TO LET THEIR FAf~1ILIES RIDE CITY VEHICLES We had a letter from our Insurance Carrier telling us that the employees cannot have their families riding in city vehichles. We have made copies of this letter for all employees. We also have this rule in our city policy and procedure manual. RE: CONSTITUTIONAL BI-CENTENNIAL We have been trying to get some programs going for the 100th Anniversary of the State of Idaho and also for the Constitution Bi-Centennial. He had clipped out a new article in the Wallstreet Journal that tells about the things they are doing around the country. RE: SIDEWALK DISPLAY ORDINANCE The mayor told the city attorney that we need to finish the Sidewalk Display Ordinance. When it is finished, Bruce Sutherland and his committee can look over it. RE: IfJSTALLING WATER LINES AT THE GOLF COURSE The mayor told the council that we are installing water lines to the golf courses. RE: SEWER If~1PROVEP1ENT PROJECTS The mayor reminded the council that we have a grant from the State Environmentalist Agency which is a part of the Health and Welfare. They had agreed to fund three sewer improvements projects. We still have money in the TEDRO Fund which cna, ve used for sewer improvement projects, so we will have our share of the money. RE: PARK STREET DITCH ruce ut er an reported on the Park Street Ditch. We are getting ready to lay that pipe all the way aloud clear over to the corner. They have some problems with culvert that goes under Park Street. It looks like it has collapsed. The engineers are looking at it to see if they need to tear up the street and put in a new culvert. The mayor reported that when Farrell came in and talked to him about it, to go the full distance would cost about $25,000 our share would be $5000 or $6000. He had Farrell take the engineers down to where the state moved the canal. He thinks that if we put a concrete box in there and a pump, ~~~e can pump the water from there into the Steiner ditch at that point, and we can do away with. that old ditch. If they cover the whole ditch, it would cost each property owner about $1000. Sander Larson talked to the people and ask them if they would be willing to pay so much a month on their water bill to cover the cost of the electricity for pumping. It would cost about $10,000 for the project and pump. Farrell was going to go down and told to Mr. Steiner. RE: STREETS TO BE REPAIRED Bruce Sutherland reported on the streets that need to be reparied. RE: SCOUTS AT THE MEETING Several -glroups of scouts were at the meeting, Troup 301, Troup 216, Troup 218. A motion was made to pay the bills by Nile Boyle and seconded by Bruce Casper. All Aye. ORDINANCE N0. 673 AN ORDINANCE REPRALING SECTION II,III,IV AND V OF ORDINANCE N0. 653 AND ADOPTING THE UNIFORi'~ PLUMBING CODE, DOPYRIGHTED BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND ~~ECHAiVICAL OFFIL'IALS, 1985 EDITION, FOR THE CITY OF REXBURG, IDAHO; REQUIRING COPIES OF SIAD CODE TO BE DOPT IN THE OFFICE OF THE CITY CLERK: PROVIDING FOR A PENALTY OFR THE VIOLATION OF THIS ORDINANCE AND FOR SEVERABILTTY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by Councilman Nile Boyle and seconded by Bruce Sutherland that the rules requiring an ordinance of a general and permanent nature to be read on ahree occasions be dispensed with and that said ordinacne be numbered 673. The mayor then called for the voting for final passage for the ordinance, and the motion was made by Glen Pond and seconded by Nile Boyle that ordinance 673 be passed. Those Voting Aye: Bruce Sutherland Bruce Casper Glen Pond Nile Boyle Darlene Blackburn Those Voting Nay: None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance, and that said Ordinance was duly and regularly passed.
