A meeting of the City Council for the City of Rexburg, Madison County, held February
19, 1937, at the City Hall.
Present were the following:.
Mayor: John C Porter
Councilman: Nile Boyle

Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A motion was made by Bruce Sutherland and seconded by Nile Boyle to approve the
minutes. All Aye.
RE: RESOLUTIOPJ TO APPROVE INVESTING OF SURPLUS MOPJEY
The mayor told the council that we have a reso ution that we have to approve,
which gives us the right to invest in any surplus money in the areas that we can
get the most interest. We want to establish an account with Edward D. Jones &
Company. Mary Smith reviewed the resolution. A motion was made by Glen Pond and
seconded by Bruce Casper to pass the resolution. (Copy attached)

SOUTH 2ND EAST PROJECT
The mayor told the council that since the last meeting, we have had some developments
on the 2nd East project. We received a letter from the state telling us that every-
thing had been approved, and we were to notify the engineers to preceed with
the planning and the design. Since then Le Roy Meyer of the District Office in
Rigby met with the mayor last Thursday and said they had completed the traffic
count at the intersection and main and 2nd East by the Courthouse and they had
determined and placed at that intersection. In the letter he stated that the
problem is how to finance the signal. He ask if the mayor and city council would
consider using 95% Urban funds to finance the signal, the remaining 5% would be split
50-50 with the state since 2 legs of the intersection are City and
2 legs are State. This would put the city in more of a deficit with urban funds when
the 2nd East Street project is built but it would get the signal funded and
installed. They would try to attach the signal to the 2nd East Street project.
Estimated cost of the signal and related work is $30,000. The State would design
the signal part of the project. The mayor said it would be 1938 before we could
have the light installed, and we could have this as one of the first parts of the
project, so we would get that done early in the spring. A motion was made by Nile Boyle
and seconded by Bruce Casper to concur in the proposal and the signal lights
be a part of the 2nd East Project. All Aye.
TERRY CARDWELL WANTS TO GET A BUSINESS LICEPJSE
The ilayor told the council that there is a fellow, Terry Cardwell, from Hibbard that
wants to get a business license to start delivering ice cream around the city
with a pony drawn cart. He would go around like the snow cone truck. The council
felt that there wasn't a problem, but the safety committee should review it. Bruce
Sutherland, councilman over the safety committee said he did not see any problem with
it as long as he pulls over the curb to stop. They should show us some liability
insurance and clean up after the pony. With this stipulations the council approved the
license.
COPIPLAINTS ABOUT GARBAGE
The mayor said we have had some complaints, after the garbage cans that have been
emptied on the garbage route, we would like the people to go out and bring the cans
into the back of the house, if they leave them out on the curb it is unsightly.
Sometimes people leave them out for three or four days and the wind blows them over
and it is unsightly. The mayor said we should make an effort after the garbage is
emptied, they need to be brought back in.

RE: UPDATE IN THE FIRE CODE, BUILDING CODE, AND ELECTRICAL CODE
Mayor Porter said there has been un update in the Fire Code, Building Code, and
Electrical Code.
RE: ORDINANCE 670 ADOPTING UNIFORM BUILDING CODE
The City Attorney read the ofdinances.
Ordinance 670 adopting the Uniform building code 19135

A motion was made by Councilman Nile Boyle and seconded by Bruce Sutherland that the
rules requiring an ordinance of a general and permanent nature to be read on three
occasions be dispensed with and that said ordinance by numbered 670.

INCLUSION OF APPEPJDICES; REQUIRING COPIES OF
SAID CODE TO BE DEPT IN THE OFFICE OF THE CITY
CLERK; ALSO PROVINDING FOR A PENALTY FOR SEVERABILITY;
AND REPEALING ALL ORDINANCES PARTS OF ORDINANCES
IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE
DATE OF THIS ORDINANCE.

Ordinance 670 was then placed before the council. The mayor then called for
the boting for final passage of the Ordinacne, and the motion was made by Bruce Sutherland
and seconded by Glen Pond that ordinacne be passed.

The roll showed councilmen present voting "Aye" carried, the Mayor declared that
the majority of all the members of the city council had voted for the passage of

RE: ORDINANCE 671 ADOPTING NATIONAL ELECTRICAL CODE
Ordinacne 671 was then placed before the council. Adopting the national Electrical
Code 1987
AN ORDINANCE REPEALING SECTION II OF ORDINANCE
N0. 655 OF THE CITY OF REXBURG, IDAHO, AND
ADOPTING THE NATIONAL ELECTRICAL CODE, 1987,
COPYRIGHTED BY THE NATIONAL FIRE PROTECTION
ASSOCIATION, INC. FOR THE CITY OF REXBURG,
IDAHO; REQUIRING COPIES OF SAID CODE TO BE
KEPT IN THE OFFICE OF THE CITY CLERK;
PROVIDING FOR THE PEiJALTY FOR THE VIOLATION OF
THIS ORDINANCE AND FOR SEVERABILITY; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
A motion requiring an ordinance of general and permanent nature of be read on three
occasions be dispensed with and that said ordinance be numbered 671.

RE: STREET PROJECTS
The said thing we have got to start working on now is the street projects for this
summer. Bruce Sutherland said he ~~~ould get with Farrell and check all the streets for
needed repairs.
RE: ~~1AYOR PORTER IN BOISE
Mayor Porter reported that he had been over in Boise for two days and met with the
Legislation for Cities. He explained all of the bills that were discussed pertaining
to the Cities.
Scout Troup 212 was at the meeting.
RE: STREET LIGHTS PUT ON GE~~IINI
A lady was at the meeii:ng from Gemini requesting street lights be put on Gemini and
Apache. The council discussed some other needs for street lights. The mayor said he
would get with Utah Power and Light and have them start working on them. He told the

council to make a list of all the lights that need to be put in. He would also ask
the police to make a list.
A motion was made by Nile Boyle and seconded by Glen Pond to pay the bills. All Aye.

RE: ROTARY CLUB REQUEST TO BUILD A GAZEBO AT SMITH PARK

It would be a little bit bigger than a regular Gazebo. (Showing a drowing of it). They
want to get it all done so when the dance festival is here they can use it. They will
build it near the dike, so people can sit on the dike to vratch the program. The only
problem is they will have to be sure of put it so it doesn't interfer with the sprinkling
line. The council agreed that it would be okay.
RE: PARKING LOT LIGHTS
an er arson:repor e that at the zoning hearing at the Kennedy School, when we left the
meeting the parking lot is dark, there are no lights. You could hardly find your car after
the meeting was over because it was so pitch black outside in the parking lot. It would
not be safe for children, who go to programs of activities at the school at night. Glen
said he would think that the school could put a couple of lights on the outside of the buildinc
The mayor said we have some lights that need to go in but he was waiting to get a list
of all of the lights that we need. One needs of go on Apache. one by Rainbow Park, and
one on Gemini. The mayor said he would get it all ready and ask Nile to talk to the School
Board.
RE: SPRItJG CLEAN-UP

would have a committee that would go around,

RE: PUBLIC SERVICE CAMPAIGN
At tnG same time, the State of Idaho is launching a ;program too. !a'e have a letter frori
there stateing that the Idaho Transportation Department is launching a statewide "Idaho
is Too Great to Litter" campaign in the spring of 1987. It will be the largest public
service campaign in Idaho's history. They want the City of P.exburg to participate. (copy
