the signal. That is the one the council prefer. The reason we think it is the best one,
if we can get in by the start of school next year. A motion was made by Nile Boyle
to expect the third proposal to install the signal at the corner of 5th West and Hgh-
way 33 and authorize the mayor to enter into a agreement with the state Glen Pond ask
the mayor if we have budgeted for those funds? The mayor told him that we are meeting
with school and the county and getting them to share the cost, and we do have the bal-
ance of the money. All the council votig aye.
Sander Larson thanked Mr. Meyers and Mr. Gillespie from the Highway Department for
their help and cooperation.
We have had a request for Charles Zollinger, he has a shop and warehouse in the center
of block 22, at 152 North Center. It is under a grandfather clause. He would like
to enlarge it, so he can put some of his equipment in the building. We have taken
a petition around to the property owners. There was no one opposing it. I suggest
that we give him a variance. A motion was made by Nile Boyle and seconded by Bruce
Sutherland to grant Charles Zollinger a variance to enlarge his building. All Aye.
Mayor Porter told the council that Jeffrey Bell who was in to the meeting two weeks
ago asking fora business license to rent appliances, has another proposal. He has
moved to another place, it is on the boundry of commercil and residential on South
4th West. He talked to Chuck Frost about it and Chuck told him to come to the council.
Chuck did tell him because it was on the boarder and he would not have any traffic only
a telephone sercive, it would probably be okay. The council discussed. The council
made a decision to turn it back to the Planning & Zoning.
Mayor Porter announced the Zoning Meetings and ask the council to make an effort
to be there. Glen Pond said he would appreciate as many as possible to be there.

The Mayor reminded the council that two weeks ago we approved getting a Tax Anticipation
Note, for $330,000. We will borrow that until August. The low bid was 6125% from First
Security Bank. A motion was interduced by Nile Boyle and seconded by Darlene Blackburn.

Mayor Porter discussed the Hearings on the new Zoning. Yesterday Chuck Frost called
Rose and told her he ha.d met with Ross geese and gone over all of Ross's complaints
on it. One thing he was concerned about was the set back on commercial property is 10
feet, and anything on .Main Street doesn't comply. So everyone would be in noncompliance,
but they would have been that way in the old ordinance on off street parking. I think
if we changed the zoning, on Main Street so that they were operating as .commercial bus-
inesses in a zone that wasn't commercial then Ross's,eomplaints would be valid. He .
felt we should put a paragraph in the zoning ordinance explaining all those businesses who
couldn't comply. They could be grandfathered in then they would be in complicance.
RE: HOSPITAL BUFFER ZONE
Glen Pond said Darwin Wolford called him and he is still concerned about the buffer
zone for the hospital. The mayor told him that Mr. Steiner had come in and talked
to Rose and.. picked up an ordinance and zoning. map, and said he would do anything they
could.
RE: TAX ANTICIPATION NOTE
After we passed the resolution last week, to pass the tax anticipation note to First
Security, we found out that we could get a lower rate of interest at Idaho First,
also that there wouldn't be so many restrictions on how to .use the money. We are paying
the money back to First Securtty, and getting the tax anticipation note from .Idaho First.
Their interest rate is 5.8 and First Secruity's was 6.25. We will have to pass another
resolution. Mary Smith read the resolution from the city to borrow $176,000 from Idaho
First National Bank at 5.8% interest and it matures August 1, 1987. Glen Pond introduced
the Resolution and moved that it be adopted, seconded by Darlene Blackburn. All Aye.
RE: INSPECTORS NOT IN COMPLIANCE
The mayor told the council that we have had some problems in the last month, when
inspectors go out to inspect businesses, they are not in compliance. The Pizza
Place on Carlson Ave. Is not in compliance with their oven. They just opened the business
up and we didn't know anything about it, and he did his own wiring.. .When we found out
about it, the inspectors went over and found some violations, and gave him a certain time to
get them corrected, and if he didn't they would have to close him down. Rose told the
council that Tom Matthews had called her last night and he had just checked it again and
the Pizza Place had not done anything to correct the problem, and also Bogarts' sign is
not in compliance and they connot turn it on or it could cause afire. The mayor said
we are going to get tough, and close them down. They are not only dangering their
business but also the buildings on both sides. We will send the police over and tell
them we are. closing them down.
RE: MC DONALDS SIGN
The mayor said we have had a request for a sign from Mc Donalds fora 100 foot sign in
the air. This confused us, because we don't have anything in the sign ordinance, it
doesn't say anything about height. They said they have one in Idaho Falls building depart-
ment, he says the height of the Mc Donalds sign in Idaho Falls is only 60 feet high.
He told the mayor that Idaho Falls have their own sign ordinance ,° they ammended it in 1931.
The highest they can have a sign in Idaho Falls is 60 feet. He is going to send the city a
copy of the ordinance. We can look it over and see if we want to adopt it. If they do
have a sign 100 feet high, they will have to have a flashing light for air travel. The
cost of the sign will be $34,000. Sander Larson said he thought it would be out of place.
RE: REQUEST FOR CITY TO PAY PART OF IMPOUND FINE
Yesterday I had a fellow in the office from Island Park, his son was picked up by the
State Police for a burglary that had taken place in Rexburg. He was picked up in
Blackfoot and brought to Rexburg and held in jail. They impounded his car in Blackfoot,
the towing fee to take it to the impound lot down there was $25.00. It has been in the
impound for 28 days at $3.00 a day. The father wasn't complaining about anything
except the impound fee. When he heard about it, he came down here because he had an
interest in this car. He wanted them to release it so he could get the car out of
impound. They said no, it was part of the evidence and would not let him get it out.
After a couple of weeks and the costs were piling up. He started checking around and
tried to find how he could get it released. Finally he went to Judge Moss, and told him
about it. Mary Smith said she didn't think we should pay part of it. Nile Boyle
said he didn't think we should either. Sander Larson, said he disagreed, (1) if
you are holding it as evidence, you are holding it and also charging for it at the same
time, (2) if your holding it, that is your responsibility, (3) if all you are doing is
impounding it, then that is his responsibility, but where the father wanted to take it
out and was not permitted to take it then you penalized him another way too, beacuse
the car could have been removed, but the police force would not allow it. The judge
over ruled it was not the fault of the father. The mayor said he wanted to talk to Blair
and get the thing worked out. Sander suggested that the father pay $50.00 and we pay
$34.00. The mayor said he would check with Blair and see it there was a rule on it.
RE: The mayor told the council that we have been trying to get the employees to hold
down. the a.cci,dents. Lt has been a 1Qt better. We got a refund on our premium of $23,000.
The other day they gave us a State Insurance Fund Award of Merit for safety and a letter.
This was for 1985. The premium is also down this year $5000.
RE: UNEMPLOYMENT TO DON FOWLER
We are still paying unemployment to Don Fowler.
RE: STUDENT HOUSING ON 2ND EAST
The mayor told the council that at one of the hearings we had, someone brought up
that there was someone planning some student housing on 2nd East. It is just south
of the armory. It is zoned R3, so there isn't any problem with it. The people are
developing the Sherwood Hills, which is zoned R1. From Harvard Avenue over to 2nd
East is zoned R3, and they want to put student housing on 2nd East. Mrs. Kidd has
found out about it and she is stirring up .the neighborhood. The student housing
organization meeting, but I don't know how we can stop them if it is zoned correct.
The council agreed.
RE: NEW ZONING ORDINANCE
The mayor said there is a member of things that have to be changed in the new zoning
ordinance. The set back they have in R1 is 35 feet, had that is alright with a
city that has a 60 foot right-a-way for their streets, but we have 100 foot street.
We will have to leave that like that set back is on the old one. We need a section in
there on student housing. They have ignored the Professional Plaza, and the way that
it is zoned. Glen Pond said they didn't open it to everything, and it was all by hearing.
The mayor said it should be Professional Offices only. Mary Smith said the idea was
when they zoned it that way was to keep out the neighborhood stores. The agreement
was with the surrounding property owners, so she did not think it could be changed.
That was the condition that they all withdrew their objections. The mayor said it might
be a good idea to have a professional area. Mary said that was the original agreement.
There was a lot of problems and neighborhood discussion, that is why they reached that
agreement and made it Professional only.
RE: MEETING WITH THE COUNTY COMMISSIONERS
Mayor Porter said they talked to Doyle Walker about having a meeting with the County
Commissioners, which will be in February. Since then the mayor talked to Bonneville
County, they have a meeting with the city every quarter to discuss problems, which is
a good idea.
RE: COST OF PRISIONER CARE
The council discussed the problem of the cost of prisioner care, and how it has raised
to $25 a day. The council also discussed consolidating the Sheriff and the City Police
departments.
RE: DIEGO AT BLOCKS.

RE: CARS PARKED ON VACANT LOTS
Sander Larson ask again about the cars parked on vacant lots with "For Sale" signs on
them. The council also discussed the wrecked cars on the curb on the corner across
from Erickson Pontiac. Sander said we need to act on it and pass an ordinance to
whatever needs to be done to make our city look more attractive: Mary Smith suggested
that there be a stipulation put in the new zoning ordinance addressing that issue.
The mayor said if they are parked on city property we can have the police have them move
them, and he will again have the police check it.
RE: COMPLAINTS ON SPRAYING PLANES
Bruce Casper said he had a lot of people complaining about the spraying planes flying
too low over the houses. Mayor Porter said he had complained to the FFA. Regular
planes have a pattern to fly, but the Airport people say that spraying planes have
no pattern. Mary suggested taking it up with the Aeronautics. The mayor suggested
that when we have the meeting with the commissioners, we talk about lengthening the
Airport. We could then get the planes that use the airport to pay a landing fee, then
we could have someone there all the time to watch it.
A motion was made by Darlene Blackburn and seconded by Sander Larson to pay the bills.
