November 5, 1986
A special closed door council meeting was held following the regular council
meeting on November 5, 1986.
Mary Smith reported on the Law Suit with Madison County. The decision was ruled
for the County. It was put in the paper before we had even received a copy of the
decision. Mary called the judge up and told him it had been an unfortunate thing
that he had handled it that way. She told him that Judge Burton had always sent a
clerk around to hand deliver the decision. He apologized and said he regretted it
was handled that way. He explained what happened. Nellis took a copy to Gordon
Thatcher and he took it to the newspaper. We feel that the judge's decision is
wrong and we are going to file Friday a motion to alter, and have him reconsider
this judgement and then we plan to appeal it.
The mayor read the agreement for the audit from Rudd & Company for $7500. The
council agreed that it was okay to start on the audit.
The council discussed the police system in Burley and the combination of the city
and county police departments.
Sander Larson discussed if we should continue the law suit or try to work with the
new commissioners. Sander asked why the county went to another attorney when they
have an attorney on a retainer, which means that we as taxpayers have to pay for
that.
Nile Boyle discussed the e-nployee Christmas Party. Rose had asked him if the council
would put the party on this year. The council decided to put on a nice dinner at the
expense of the city. They decided to have the party at the college and Rose was
asked to price out a nice dinner and set the day and time.

Dear Council:
The Traffic Safety Committee endorses the recommendation of Police
Chief Siepert pertaining to the removal of the railroad stop signs
at the following locations.
1. Northbound stop sign at the railroad crossing
located at the intersection of 4th South and
5th West.
2. Eastbound and Westbound stop signs at railroad
crossing located between 3rd and 4th West and
2nd South.
Enclosed is Chief Siepert's recommendation and photographs of the
proposed areas for sign removals.

RESOLUTION N0.
BY THE COUNCIL:
A RESOLUTION ESTABLISHING POLICY FOR THE USE OF SAFETY BELTS IN CITY-OWNED
VEHICLES AND ENCOURAGING THE USE OF SUCH RESTRAINTS BY CITY EMPLOYEES IN
THEIR PRIVATE VEHICLES DURING OFF-DUTY TIME; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Idaho Legislature has enacted a mandatory seat belt law;
and
WHEREAS, 255 people died in Idaho traffic accidents in 1985, including
235 occupants of vehicles in which 205 of the victims were not using safety
restraints; and
WHEREAS, there were 4 fatalities and 220 injuries in Madison County
traffic accidents in 1985, with none of those killed wearing safety
restraints; and
WHEREAS, each employee fatality or injury costs the City of Rexburg
thousands of dollars in wages, property damage, medical expenses, insurance
costs and physical and rehabilitation benefits; and
WHEREAS, Idaho data shows safety belts can dramatically reduce the
number of deaths and injuries in vehicle accidents; and
WHEREAS, employee safety is high priority of the Mayor and Council.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF REXBURG, IDAHO:
Section 1. That use of safety belts in all city vehicles so equipped
shall be mandatory.
Section 2. That all city employees are also urged to use safety belts
in their private vehicles during non-work hours.
Section 3. That this Resolution shall be in full force and effect
immediately upon its adoption and approval.
ADOPTED by the Council of the City of Rexburg, Idaho this 19th day
of November, 1986.

RE: REPORT ON PLANNING AND ZONING PtEETING
Glen Pond reported on the Planning 4~ Zoning ~ioeting. They had reviewed the project
on 1st East, an apartment complex: They were instructed to make ad.iustments on the
parking. They also approved the Zoning P~~ap under the new ordinance.
RE: SCOUT TROOPS IN ATTEiJDAfdCE
Several scouts ~rere at the meeting: Don Brown, Troop 212, Rexburg 12th !~Jard;
Jim Long, Troop 215 ~ 206; J.D. Hancock, Troop 305, 5th Ward; and Troop 217, 17th
Ward.
RE: REPORT ON NURSING HOME
Mayor Porter reported on the Nursing Home. They had started blasting on the sight
and leveling it off. The papers have been signed and recorded.
RE: 2('JD EAST STREET PROJECT
The council discussed the 2nd East Street. Bruce and John had rne~t with the State
and Federal Highvray Departments. tJe also had two people that live on that street
at the meeting. eJe came up with a 46' street, with parking on each side, witE~ a
buffer section of grass 5 feet and a 4 foot wide sidewalk. The state agreed to
it, but Federal has to look it over and agree on it.
Everyone we have met with on the street will go along with it. They took a traffic
count on the 1st block where the traffic was heavier than up higher on 1st South.
In fact, it was 25% heavier. With 'the heavy traffic count on than street by the
Courth~~use corner, we might be able 'to gat a light installed.
RE: POSSIBILITY OF LIGHT ON 5TH WEST- AfJD i~iAIN
Glen Pond asked about 5th West and Main, and if we are going to get a light in
there. Bruce Sutherland said the Safety Comrittee had a meeting to discuss it,
we are about 81% chance. If the city can raise the money to put the light in it
will be okay-with the state. We need to take another traffic count and need 670
more cars per hour to go through.
RE: SIDEWALK ADVERTIZING
Members of the Chamber of Commerce were at the meeting. LaVar Wilmott, President,
handed out and reviewed a proposal. They are in favor of using the sidewalk for
advertising. (copy attached) It is his recommendation as Chamber President to
have sidewalk sales. The council discussed the proposal. He also handed out a
survey made with the merchants and public. (attached) Mayor Porter said that
besides having liability insurance they have to have something to show that the
City cannot become part of the suit. Under the law now they can sue everyone.
The mayor said we would study it over and draw up an ordinance. Bruce Sutherland
said he thought there needed to be something in there for the length of time dur-
ing the day when the goods can be left on the sidewalk.
Ken Benfield explained that his insurance has the city on their insurance for
1 million dollars liability at no cost to the city.
RE: STATE SEAT BELT 0`~DINArJCE
The mayor said the state had contacted us about the state seat belt ordinance. They
have some things they want us to do. They want us to pass a resolution saying that
all riders in the city vehicles obey the law and be sure they wear seat belts. There
are some stickers they want us to put on the vehicles and there are sorne pamp!~lets
they want us to put in the office. They would like us to cooperate with this. The
mayor turned it over to Bruce Sutherland to give to the Safety Committee for their
recommen?atir~n.
RE: HEATING SYSTEM AT POLICE DEPARTMENT
The mayor explained to the council that we have been having a lot of problems with
the heating system at the Police Department. The heating units that are in there
now are not very eff=icient. What is proposed is a new system of heating that you
can put gas heaters, with a gas unit up on the chimney, when you turn on the thermo-
stat the blower glows the air out through the building. At the Diet Center where
they make th~~ mills, they have this kind of heat and save over 50% on their heating
bill. In three years it will pay for itself. You don't need to put it all in at
once. YurA can ;:a~; s<=ctions in at a time. The total cost would be approximately
$10,000. The cost of heating that building is more than we pay to heat the City
Hall any: Fire Station together.

RE: EMPLOYEES WORKING VETERAN'S DAY INSTEAD OF FRIDAY AFTER THANKSGIVING
f~layor Porter told the council that in our Personnel Manual it states that the
employees get November 11th, Veteran's Day, as a holiday. The employees are
proposing that they work on Veteran's Day and take the Friday after Thanksgiving off.
The mayor explained that we would just shift that holiday and not give an extra
holiday. They would still have nine holidays. Bruce Sutherland said the only
problem would be with garbage pickup, and that would have to be worked out. The
~~mayor told them that the City really does not have as many holidays as some other
public entities.. We may have to pay overtime to the garbage department. A motion
was made by Nile Boyle and seconded by Bruce Sutherland in lieu of Veteran's holiday
we give the employees the Friday after Thanksgiving off this year and review it next
year. All Aye.
RE: SOLICITING
The mayor told the council we have been having complaints from some businessmen that
there is a lot of solicitation going on in the city in the business area as well as
the residential. It is getting to be a problem. When you are operating a business,
it is a public place and you can't really keep people out. He suggested that they
put up a "NO SOLICITING" sign. He thought we should do it at the City Hall. Bruce
Sutherland said we maybe should work through the Chamber of Commerce.
RE: JIM LONG TO DRAW UP TREE ORDINANCE
Jim Long was at the meeting with some scouts. He works with the Horticulture Land-
scape Department at Ricks College. The mayor explained to him about the 2nd East
project that all the trees will have to go. After we take the trees out, we would
like to plant trees back that are of the same kind on each street. f~lr. Long told
the council that most cities have tree ordinances. He would be happy to help draw
up a tree ordinance. The mayor told him the city would appreciate it if he would
take that assignment and help draw up an ordinance.
RE: CITY TREASURER Ef~IPOWERED TO INVEST °~ONEY
A motion was made by Glen Pond and seconded by Bruce Casper to adopt a resolution
that the City Treasurer be directed and empowered to invest money. (copy attached)

ember 19, 1986, at the City Hall.
A motion was made by Bruce Casper and seconded by Nile Boyle to approve the bills.

The Chamber of Commerce appointed a committee to study the
sidwalk advertising issue. Mitch lYebster chaired this committee
ti along with a farmer, a housewife, a businessman, a doctor
and an attorney.
All businesses on Main Street were contacted and asked the
following questions in a survey:
1. Do you favor advertising on Main Street?
Why or why not?
2. Do you have insurance? '
3. Do you favor sidewalk sales? `
The results of that survey were:
1. 60°~ favored advertising...
Reasoning:
A, if it Were kept control of
B. if it would add to the atmosphere -
C. if it increases store trade
D. if some guidelines were established .
40°I~ were not in favor of sidewalk advertising
Reasoning:
A, It gives a small town appearance.
B. It causes accidents.
2. 75~ of the businesses have insurance to cover any
accidents.
A. In contacting an insurance company, we were
informed that all businesses should have insurance
to cover this.
3. 100°,b of Main Street businesses favor organized
sidewalk sales.

y Main Street Sidewalk Advertising Proposal:
The Chamber of Commerce is in favor of the sidewalk advertisng
on Main Street with the following guidelines:
1. All businesses setting items out to advertise must have ,
liability insurance to cover any possible accidents.
2. No A-frame signs will be allowed for advertising purposes
on D4ain Street. `
3. No tables or chairs will be allowed on the sidewalk area
for the purpose of eating or resting.
4. Merchandise to advertise can be out only 4 feet from `
the store and Can run the length of the store. Items ~ ~,
need to be secured to the store.
5. Sidewalk sales are to be allowed if they are kept
within these same guidelines.

city money in his hands not then necessary for City expenses, in
any investment designated in Section 50-1013 Idaho Code, first
having secured the approval of the Mayor and the City Council
