A meeting of the City Council for the City of Rexburg, Madison County, held
September 24, 1986, at the City Hall.
Present were the following:
Mayor: John C. Porter
Councilman: Bruce Sutherland

A motion was made by .Darlene 6lackburn and seconded by Nile Boyle to approve the
minutes. All Aye.
RE: LID REQUEST
The mayor read a petition from property owners on Shoshone Avenue, Dee Sellers, Greg
Sellers and Vance Forsgren. They would like to have that street put on a local Improv-
ment District for the purpose of paving the street, putting in curbs, gutters and side-
walks. There is one man that is opposed to it, Bill Turnbull, he is trying to sell his
home. The mayor said if we do 2nd East Street we will have an LID for the curb, gutter
and sidewalk on South 2nd East. The school district contacted the mayor, they have
been bussing the students from Millhollot Meadow Trailer Court to Adams School. The
state has checked it out and that is in the city limits so they cannot bus them any more.
They want to get a sidewalk from Millhollow Meadows to Adams School. The council dis-
cussed how to bring the sidewalk from Millhollow Meadows, possibly through the high
school grounds.
RE: DO~lALD HAIR COMPLAINS ABOUT VACANT LOT AND ORDINAP~CE 379
Donald Hair was at the meeting. He wanted to talk about Ordinance 379, referring to
the property next to him that is a nuisance when declared by the police or the fire
department. Some time ago he was in City Hall to complain and. Farrell Davidson called
the owner in Idaho Falls, I. Cramer, about the .lot next to his property on the corner
of East 1st South and Harvard. Two weeks later nothing was done and he got hold of
Rex Larson to come and look at it. Two. hours later Farrell was up there with a work
crew and partially cleaned it up. Either we comply with the ordinance or we don't.
They cut the weeds and removed trash but left the weeds. When he asked Farrell if
they were going to take them away, he said, "No way, we don't do that". As I b^ead it,
the city was a subcontractor for the owner, they were not doing it for the city, as
such, they was an agent and did not comply with the ordinance. They mayor told him we
do not have the equipment. He said the lot is next to him and it looks bad. The
mayor told him that if we could find a way to settle this problem, we would be the
most grateful city council in the world. He said he could care less about that, he
only cared about the lot next to him. He asked if the city is going to clean it or
are they going to hire someone to clean the lot up. The mayor told him we were not
going to do it. Mr. Hair asked Mary Smith where he .should go from here, she told him
to consult his own attorney. Donald Hair discussed the problem at length, expressing
his concern about the one lot next to him, stating that the city was not complying to
the ordinance. The mayor told him all the city does is mow .the lots. If it is so bad,
we take them into court, but the city would be in court all the time. Mr. Hair com-
plained about the cement being dumped on the lot. The mayor told him we had talked
to the cement people and told them to quit dur~~ping on lots and the city crews had spent
time cleaning cement from vacant lots so they could mow them.
RE: WATER SAFETY SYSTEM
The mayor discussed the water safety system the council had approved previously. The
equipment is all here and is being installed.
RE: TIME OF DAY
The council discussed the equipment for the Time of Day. Glen Pond said the electrician
is supposed to put the timers on, and then we can switch any time.

RE: REVOLVING LOAN FUND
The mayor reported on the revolving loan fund, he said as far as he knew they were
about ready to go on it. There should be some activity by the 1st of October.
RE: STATE CENTENNIAL COMMITTEE
We got a letter from the State asking that we set up a State Centennial Committee in
cooperation with ..the County for the State Centennial. They are holding a meeting in
Idaho Falls. Dave Crowder is on the State Centennial Commission.
RE: BI-CENTENNIAL ON THE U.S. CONSTITUTION
We also have a letter from the Committee on the Bi-Centennial on the United States
Constitution. They would like us to be designated as a Bi-Centennial City, and get
an application in for that. They will then designate several Bi-Centennial Cities.
around the nation. It will be September 19, 1987. The mayor said he would send in
the application. We will have to have a Bi-Centennial program.
RE: 2ND EAST ST. PROJECT
The mayor reported that he had talked to the engineers about Second East. They are
in the process of now making another count. They have a new engineer in charge of it.
He said he was inclined to think, if we have not heard from them in a few days, we
should get in touch with John Sessions, who is chairman of the House Transportation
Committee, and John Ohman, who is chairman of the Nighway Board, and get them to put
the pressure on the highway department at the meeting so we can get this thing resolved.
RE: EAGLE SCOUT PROJECT
The mayor received a letter from Scott McCurdy, who is getting his citizenship for an
Eagle Scout. He is concerned about the people not stopping for school busses.
RE: STATE LIABILITY INSURANCE COMMITTEE
There has been a committee formed in the state 'to work on Liability Insurance. Donna
Scott is on the committee and she will be here to meet with us.
RE: SEWER PROJECT
We have all the information on the ownership on the land on the block where the sewer
line needs to go. The mayor said he would go see the people this week and see if they
would agree to let us put the line in and let them pay it off on their water bill.
RE: ORDINANCE 379
The council discussed Ordinance 379 .and felt that we should review that ordinance and
see if it needed to be amended.
The next council meeting will be held on October 8, because all the councilmen cannot
attend on October 1.
A motion was made by Sander Larson and seconded by Bruce Sutherland to pay the bills.
All Aye.
A motion was made by Nile Boyle and seconded by Bruce Sutherland to adjourn. All Aye.

PETITION
We, the undersigned, being resident property owners
on ~~L.E1~p~-~ __ ~ , Rexburg, Idaho, whose property is
subject to assessment within the proposed Local Ir.-~provement
District, hereby respectfully petition this Honorable Council
for the organization of a Local Improvement District for the
purpose of causing to be constructed, improved, repaired,
graded, paved, repaved, surfaced, resurfaced, curbs, gutters,
streets or sidewalks and that the cost and expense thereof,
with exception of the intersections which shall be paid by the
City, be assessed and paid by the property owners as provided
by the Local Improvement District Code of the State of Idaho.
