A meeting of the City Council for the City of Rexburg, Madison County, held
September 3, 1986, at the City Hall.
Present were the following:

A motion was made by Bruce Sutherland and seconded by Glen Pond to approve the minutes.

RE: APPROVAL OF BUDGET HEARING
First on the agenda was approval of the budget hearing. No one was at the meeting to
protest the budget. The mayor explained that it was only about $15,000 increase over
last year. We didn't give any cost-of-living increase, we have eliminated some em-
ployees from different departments. We have had trouble making the budget balance
when we have lost about $75,000 in revenue sharing. We will have to increase the
property tax about $50,000 to pay for the increased cost of insurance. Richard Horner
explained that we have had to cut back on the Capital expenditures, except for some in
the Utility Departments, because that money comes from a depreciation fund we accumu-
late from the operation of the sanitation department and water & sewer department. We
use that depreciation money to buy equipment for those departments. A motion was made
by Nile Boyle and seconded by Glen Pond to accept the budget. All Aye.
RE: ORDINANCE 669
Mayor Porter read Ordinance 669, the Annual Appropriation Ordinance, setting up the
amount of money for each department.

ORDINANCE N0. 669
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO,
FOR THE FISCAL YEAR OCTOBER 1, 1986, TO SEPTEMBER 30, 1987, AND APPROPRIATING TO THE
SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE
DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS
MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE
EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1987.
A motion was made by Councilman Glen Pond and seconded by Councilwoman Darlene Black-
burn that the rules requiring an ordinance of a general and permanent nature to be
read on three occasions be dispensed with and that said ordinance be numbered 669.

Ordinance 669 was then placed before the council. The mayor then called for the
voting for final passage of the ordinance, and the motion was made by Nile Boyle
and seconded by Bruce Sutherland that Ordinance 669 be passed.

The roll shoved all councilmen present voting "Aye" carried, the Mayor declared that
the majority of all members of the City Council had voted for the passage of said
Ordinance, and that Ordinance 669 was duly and regularly passed. Mayor Porter declared
the motion carried.
RE: DITCH ON 5TH WEST AND PARK STREET
A group of citizens in the neighborhood of Park Street was at the meeting, Ken
Cadwallader acted as spokesman. He told the council that on Park Street, where the
park is, there is an irrigation ditch. It has two culverts without grates on them.
It is quite a hazard. We have some 200 children in that neighborhood that use that
park, plus Kennedy School is just a little over a block away. Two weeks ago he had
pulled a child out of the ditch, by the culvert, when the ditch was full of water.
They are concerned about the liability and also the loss of a life of a child. We
would like to see a grate installed up by Able Industry (showing map, attached) and
to close the ditch as it goes along 5th West indicated in red on the map.
Mayor Porter asked who took the grates out. fair. Cadwallader said that he saw Dale
Steiner take one of them out. The mayor told them that it is Dale Steiner's ditch.
Mr. Cadwallader said they had talked to Mr. Steiner and he is not against having it
culverted in, but he would like to see it stay clean and have it put in so it would
not fill up with debris, so he couldn't use it. As far as covering the ditch over
with pipe in it, he had no problem with that. Glen Pond said he thought we should
find out how much it would cost to cover the ditch and pursue it, with the school down
there and all the. kids in the neighborhood. The mayor told them we would pursue it
and see what we can do, and try to get it done by irrigation season next year.
Jerry Merrill was at the meeting and asked who was responsible for maintaining the
ditch behind his house on Park Street. Nile Boyle told him that there is nothing in
this area that has more rights than the early water rights, and probably the only
responsibility he has is to let the water run through. Mr. Merrill asked about the
possibility of covering the ditch behind his property if they covered it around the
Park Street Park. He would be willing to pay for the culvert in his back yard. The
mayor told him that maybe we could cover that part of the ditch a little bit each year.
RE: PLANNING & ZONING REPORT
Glen Pond reported on the Planning & Zoning meeting. They talked about complaints on
livestock within the city limits, the crowing rooster, the bleating lambs, chicken
houses that are appearing in several neighborhoods. The Planning & Zoning recommended
that we enforce the zoning, and restrict animals to just household pets.
They have just about completed the new zoning ordinance and will get it updated. After
that is completed we will want to do some reorganization on the Planning & Zoning
Board. Chuck Frost would like to relinquish his duties as chairman and stay on the
board, and we will be seeking some new board members.
The council also approved a double wide trailer to be put on a permanent foundation
just north of Ken's Auto Repair. The lot is 41' X 165' deep, the trailer will have
5' clearance on each side. The trailer will be used for residence. The council okayed

RE: REPORT ON SAFETY BOARD MEETING

Bruce Sutherland reported on the Safety Board meeting. (1) One problem with the inner
city busing of kindergarten children: The buses are stopping on the streets and the

cars are not stopping, they are passing on the left and right of the busses. They
have contacted the school board and would like the city to put up bus stop signs
where the busses are going to be stopping, and also inform the citizens. They have
two people riding on the busses now, one person is just writing down the license
plates of the cars. They had contacted a police officer about it who said it was
hard to issue citations, but we feel they should start issuing citations.
(2) They had discussed the crosswalks at Lincoln School. There are no crosswalks,
and there needs to be some painted with school crossing painted on them. Glen Pond
suggested that there needs to be some sidewalks. They also discussed the crossing
on Main Street and 5th West. When we meet with them on 2nd East we need to pressure
them about a stop light. Glen Pond told him they are taking a traffic count on that
now.
(3) They discussed the students crossing from Junior High to Broulims, and suggested
there be a crosswalk there. Glen Pond said we discussed this last .year and thought
they should go down to the corner to the crosswalk or to the stop light. The crossing
guard is at the corner by the Washington School.
(4) They discussed the crosswalk on 1st North and 2nd West at the Railroad crossing
which is a hazard. The council asked him to have the Safety Board check all the
stop signs at the Railroad crossings.
(5) Another corner that needs some crosswalks is by the courthouse. There is no
crosswalk from the courthouse to Tri-County. They also discussed a four-way stop by
the library..
RE: VACANT LOT
Glen Pond told the council that the home owners by the property east of the hospital
that is now in sagebrush want to plant grass and maintain it, the hospital will supply
some dirt for it. They wondered if the city would give them some water if they supplied
the rest of the work. The council agreed.
RE: RIP-RAPING THE RIVER
The mayor discussed rip-raping the river. The engineers can't get over to do it until
after the lst of November so we will have to p~,y 35%.
RE: SEWER PROJECT ON 1ST NORTH FROM 2ND WEST TO 3RD WEST
The mayor told the council that on 1st North from 2nd West to 3rd West there is no
sewer. De Lynn thought we would have to go out in the street to put it in, but after
checking, he thinks we can go through the middle of the block. Richard suggests that
if we can get those people to sign an agreement that we can take a lean against their
property for the amount of cost, just like a local improvement district, the cost would
probably be $1000 a home, and we wouldn't have to go through the improvement district
process. We would have to go to all the people and get a right-of-way.
A motion was made by Glen Pond and seconded by Bruce Sutherland to pay the bills.
