A meeting of the City Council for the City of Rexburg, Madison County, held July 2,
1986, at the City HaTI.

RE: UTILITY DEPOSITS

RE: COMPUTER PROGRAMS
Richard Horner told the council that since we got on our computer, we have been build-
ing a set of programs for our use and we have taken some of the programmer's programs
and adjusted those as well. Now we have a pretty good set of programs. The programmer
himself would like to market those programs to other cities and counties and businesses.
They suggested that we go into some kind of royalty agreement with them. We have about
one half equity in the programs and have invested about $32,000 of Richard's time and
the programmer's expense. What we are tentatively looking at is setting up an agree-
ment where they will market it and we will help as far as if someone has questions and
so forth.. We would. take 20% of the sales until we recapture our costs in the programs
and. after that it would drop down 5% and if they sold over a million dollars, it would
drop down 12%. Richard said he also suggested if they would cad us out right now at
our cost or even 75% of our cost (.$20,000 or $25,000), we would probably take that and
they could own the program. The council discussed it. The council agreed to let the
mayor and Richard work out a deal with the programmers.
RE: SEWER. LIFT CONTROL
The mayor told the council that we had a problem with the sewer lift control out at
the main control by the golf course on Highway 33. The canal company turned the water
in and backed it up and the pressure was enough to make the water get inside the lift
station and flooded it so they have had to go down and do considerable repair work.
De Lynn thinks while we're doing that, we should move all the controls up on the upper
level because it never floods up there. The wiring and all the switches are in the
lower level. When it floods it puts everything out and stops it from working. It
would cost about $6000 to move it up to the upper level. The mayor said he would
recommend that we do that but wanted to get the council's okay. In talking to Richard,
we have a depreciation fund in the water department to take care of it so we do have
the money. The council authorized the mayor to go ahead and take care of it. De Lynn
thinks that because there is so much moisture at the lower level, the switches and
contact points have to be changed often because they rust out.
RE: STREET BIDS
The mayor told the council that the street bids for the three street repair projects
were ready. The request for bids will be published on the 8th of July. The ones that
they cannot do immediately we can hold up. The bid opening will be on the 23rd.
UTILITY DEPOSIT RESOLUTION
BE IT RESOLVED THAT RESIDENTIAL UTILITY DEPOSITS BE INCREASED
TO $35.00 AND BUSINESS UTILITY DEPOSITS BE BASED ON THE UTILITY
CHARGES FOR THE FIRST TWO 'MONTHS OF PRIOR USAGE. IF NO PRIOR
USAAGE ON AN ESTIMATED A*iOUNT DETERMINED FROM SIMILAR BUSINESS
USAGE.
A motion was made by Nile Boyle to introduce The Resolution,
Darlene Blackburn seconded the motion.

RE: SAFETY COUNCIL BOARD
Bruce Sutherland told the council that the Safety Council Board i;s-operdtng nQU~.
They asked him to have them check out the stop-signs at the Railroad crossings. The
council discussed the street painting and striping on 4th East.
RE: REVIEW OF ZND EAST STREET
On the review on 2nd East Street, the mayor stated that we can't do anything on that
because we haven't got the hearing minutes back. He stated that when we were in Boise,
we discussed this with some of the highway people that are located there. They sug-
gested that maybe it could be reduced to 46', and what we wanted to do is get the
people that were here the other night at the hearing and see what they could do for
it. They told us that they would do their best to get the Federal Bureau of roads to
agree to that. They had tried a number of times to get it down to 44' but 46' is as
narrow as they can go. When the mayor got back from Boise they got the eng ineers to
draw a temporary plan for 46'. The thing we talked about is to narrow the sidewalk
from 6' to 4' and move the sidewalk toward the homes by one foot. By doing that we
would be able to have 6 feet of grass between the curb and the sidewalk, as a buffer.
There would be some trees that would still have to go. It would be 6' wider than
2nd South; we would be widening it three feet on each side more than 2nd South. We
would like to get your ideas to see if you would go along with it. If we don't do
that section there they won`t go along with the project at all, it has to be from
the Court House to Erickson Road or nothing.
Al Forbus was at the meeting and stated that he did not know why anything needed to
be done on that road. Anything you are going to do to those two blocks is going to
spoil the ecology. He does not live on that street; but his daughter, who is handi-
capped, crosses that street to go to the library. If that street is widened it would
make it further for her to walk. The mayor told him he is sympathetic with him but
if we are going to do anything to that street we have to widen it. We can't repair
that street any more. Nile Boyle told him that we would not get any federal funds to
build a new street if we do not do the whole .street now. The people from 4th South
to the Erickson Road have got to have a street. Al Forbus thought they should be
taxed for it rather than widen the street down lower. The mayor said that 75% of
the people said there should be a compromise. Mr. Forbus said the oeople do want
an improvement but to the curb and gutter. The mayor said if we want to get 95% of
the money to rebuild the road, put the curbs in, new sidewalks and then go clear to
the Erickson Road we have got to widen that and the minimum is 3 feet on each side.
Randy Porter was at the meeting and said he could ]ive with slight widening. No
one that lives along the street wants. it widened past the trees. He thought that
people want improvements done but only to curbs and gutters. People are not object-
ing to having to drive along the street. The mayor said that if nothing is done
there will be people that don't live on that street that will want it done. A street
in the city is for everyone not just for the ones that live on it. We are talking
about a street up there, that in a year or so the surface is going to go; we can't
just put a half sole over it like we are doing around town in other places. We have
three projects now that we talked about that are going to bid, and they are going to
cost us over $110,000 to just put a half sole on for three half blocks. We haven't
got the money to do the complete job. Here is our chance to get two miles of road
built and it will hardly cost the city anything, because the people on the south end
are going to pay for their curbs and gutters. It will cost the city about $50,000
to do the whole thing, if a compromise can be made. Randy said that they would like
to be involved in the compromise. Nile Boyle told him that if we meet with the high-
way department on a compromise, we would have some of the citizens go down and meet
with them. Randy claimed-that it will lower the property value if they take the trees
out. You can't bring the property value back up by replanting trees. You cannot
widen the street 3' on every side and not take out the trees.
Stan Brown asked why they wanted to widen the sidewalk. A lot of people would like
to be shown the middle of the road and how it would be when it was widened, and how
it will effect the property. The mayor told him if he would take the curb and measure
from curb to curb you would get the center of the street and measure back to your side
of the street. Nile Boyle told him that if the residents left it and the city did it
without this federal help that the property owners would pay curb and gutter and side-
walk; the city would not pay that. Glen Pond told him that the funds are there to
fix that street now. I don't know how funds will be in the future to fix that part-
icular street.
The mayor told them that this has not come up in this administration. When Henry
Shirley was mayor that street was designated as an urban street, when that was done
there were public hearings held.
Randy Porter said he didn't think we needed a four lane road to serve Rexburg Heights.
He suggested that we widen 2nd West.
Sander Larson said he had appreciated listening to the points of view. There isn't
thing we can do until. we get the report back from the state, and until we get a
~omoromise where~we can srt and-talk about-the facts that have been brought out. We
can sit and listen to some things that are emotional and very narrow from the point
of view of that they might say are absolutely absurd. What we need to do is to hang
in there until we get the report, review it and look at the alternatives and try to
come to a compromise that will make sense for everybody and hope people would have
enough confidence in the city council that at one time they elected into office that
we will try to be rational in the decision we make. Everything is fine as long as
all we have to do is pay the bills and make a few minor decisions, but every once in
awhile we come to a real problem to make a decision, and then everyone questions logic,
maturity and the sensibility. He said he sat in the audience at the hearing and heard
a lot of people say,"Don`t we get any say in this thing?". He thought, "Yes, I guess
you did because you voted for us at one time, and here we are in a very lonely posi-
tion with these kinds of situations". He said he agreed; he was opposed to a 4 lane
road, a 3 lane would be better.

RE: SIDEWALK SALE
Mayor said that Brad Liljenquist came in to talk to him about the merchants having a
sidewalk sale with the Lion's Breakfast. The mayor told him it would be okay for this
special occasion. The mayor said we have a problem with transients coming in and set-
ting up on the sidewalks during the merchants' sidewalk sales. The council decided
that we would charge $75.00 a day for a business license for transients when there is
a special promotion.
RE: WOODEN FENCE ON PARK STREET PARK
The mayor discussed the wooden fence on Park Street Park; it is leaning. Jack Van Houten
said the posts are all rotten.. He thinks the best thing to do is to put up a chain
link fence. Nile Boyle suggested that we do look at it and discuss it at the next
meeting.
RE: MAYOR. AND COUNCILMEN RIDING IN 4TH OF JULY PARADE
Bruce Sutherland said the parade committee wanted to give a special invitation to the
Mayor and. Council to ride in the parade on the 4th.
RE: FREE POOL TICKETS FOR INTERNATIONAL DANCERS
The mayor told the council that on August 16 or 20 they will have a free day for the
International Dancers. They wondered if we could give a free ticket to the dancers
on Saturday, August 16th, for the pool. On Saturday it won't be open in the morning
so they could let them go in free of charge that morning.
RE: SIDEWALK DISPLAYS
Bruce Sutherland said they have been having meetings on the sidewalk displays. Most
businesses want displays, about 60 - 40.
