A meeting of the City Council for the City of Rexburg, Madison County, held March 5, 1986,
at the City Hall .
Present were the following:
President of the Council: Nile Boyle
Councilman: Glen Pond
Bruce Sutherland
Sander Larson
Bruce Casper
Also Present: Rose Bagley,

Attorney
A motion was made by Glen Pond and seconded by Bruce Casper to approve the minutes with
one change on the names on the Traffic Committee. All Aye.
RE: DISCUSSION OF PARKING OF CARS FOR PASSENGERS ON INEL BUS
Glen Stanley and Marvin Gardner representing INEL was at the meeting to discuss the park-
ing of the cars for the people who ride the INEL bus. They asked the council what they
could do to make it better. Nile Boyle told him the thing that the council is concerned
about is the cars parking on 5th West where the kids are walking to school. It causes
a traffic and a safety problem. Sander Larson told them particularly there is a problem
when there is snow piled around the cars and on the road, the children have to go out in-
to the street. Mr. Stanley said they have changed the bus from Rigby, so~it stops by
the City Hall, there is only one bus that stops on 5th W. now. There are now twelve
people catching the bus by the City Hall, they are picking up people at the Railroad
Depot, they were picking up six people at the store down the road. There will now
only be five people catching the bus on 5th West and Park Street, and some of that
would be foot traffic. Sander Larson and Nile Boyle told him they thought that sounded
fine and we would try it. Mr. Stanley suggested that we let it go like this now and
take another look at it next winter.
RE: DAY CARE CENTER. REQUESTED
Billy Hunsaker was at the meeting to request having a Day Care Center at 356 S. 3rd. W..
across from the Third and Ninth Ward Church. She said she is now affiliated with the
Little Academy, but due to the space problems inside and out she had chosen to move to
a different location. There are two separate schools at the Academy, and her group has
between 17 and 30 children. She said there are two driveways for ample parking, she
had a letter from the people who own the adjacent property giving her permission to use
that property for parking. She said they would have a fenced back yard. Glen Pond said
the zoning on that would be R3. She said if she needed more parking they could get
permission from the church. Glen Pond said they would need four parking spots. Mrs.
Hunsaker said .they only have two or three people unloading the kids at a time. Nile
Boyle told her that it looked like she was in compliance with all the city zoning and
other regulations as soon as they get the fence up.
RE: NEW BUSINESS IN HOME
Bonnie Shirley was at the council, she and her husband want to build a home on the
corner of 3rd ,East and 2nd North. The lot is now vacant and is zoned R2. Glen Pond
explained that they would like to sell wedding cakes out of the home. They do want
to put a sign on the home "Bonnie's Cakes", which would be attached to the home or
directly adjacent to the home. Nile Brown took a petition around to all of the
neighbors-within 300 feet of the property and there was no objections from any of
them. Glen Pond said he talked to some of them personally and there is no opposition,
they are happy that something is going to be built there. Glen stated that based on
the findings they would like to request a variance. Mary Smith told them it would
have to be a Conditional Use Permit. If you sell the property you could not transfer

cautioned about the sign, that it would have to be back on the building and of regulation
size. Then Mr. Shirley told the council that they are in the process of selling their.
house and wondered if it would make any difference how soon they started with the Conci-
tional Use Permit. Nile Boyle told him if it went over a year, they would need to come
back and touch base with the council. Mrs. Shirley was told, she would have to get a
business license when she got ready to open the business.
A motion was made by Bruce Sutherland and seconded by Glen Pond that a Conditional Use
Permit be granted to Bonnie Shirley for the home they are building at 2nd North and 3rd
East. All Aye.
Scout troups 215 was at the meeting.
RE: DISCUSSION OF DOG PROBLEM
Bruce Sutherland discussed the dog problem on the East side of the city, on Birch, Mill-
hollow and on 2nd East. Steve Parkinson said he lives on Birch and there is a bad dog
problem. The other day his children and some other children were playing near his home
and there was quite a group of dogs. Two Thompson children tryed to walk home from his
house and one of the. girls was bitten by one of the dogs, so they ran back to his house..
He looked at the bite and told them to try again to go home, and the dogs chased. the
girls again, so he went outside with a 2 x 4 and chased the dogs off. Bruce Sutherland
said he thought that people should be warned and they need to know that there is a lease
law. Nile Boyle said he would make sure the dog catcher was informed.
RE: ORDINANCE 664 READ
Mary Smith read Ordinance 664 creating a Traffic Safety Board.
AN ORDINANCE CREATING A TRAFFIC SAFETY BOARD; PROVIDING FOR ITS MEMBERSHIP SETTING THEIR
TERMS OF OFFICE; PROVIDING FOR THE FILLING OF VACANCIES; PROVLDING FOR ITS MEETINGS AND
DUTIES; PROVIDING FOR HEARINGS AND THE KEEPING OF RECORDS; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES THEREOF IN CONFLICT WITH THIS ORDINANCE; AND PROVIDING FOR THIS ORDIN-
ANCE TO TAKE EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION.
A motion was made by Councilman Sander Larson and seconded by Councilman Glen Pond that
the rules requiring an ordinance of a general and permanent nature to be read on three
occasions be dispensed with and that said ordinance be numbered 664.

Ordinance 664 was then placed before the council. The president of the council then
called for the voting for final passage of the ordinance, and the motion was made by
Glen Pond and seconded by Bruce Casper that ordinance 664 be passed.

The roll showed all councilmen present voting "Aye" carried, the president of the council
declared that the majority of all the members of the city council had voted for the pass-
age of said ordinance, and that said ordinance was duly and regularly passed. The pre-
sident of the council declared the motion carried.
RE: ORDINANCE 665 READ
Mary Smith read ordinance 665 amending and changing zoning ordinance on Block 48.

AN-.ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CLTY OF REXBURG, IDAHO, TO
PROVIDE THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED IN REXBURG, MADISON COUNTY,-IDAHO
BE CHANGED FROM. COMMERCIAL TO R-3 RESIDENTIAL; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
A motion was made by councilman Bruce Capser and seconded by Sander Larson-that the rules
requiring an ordinance of a general permanent nature to be read on three occasions be
dispensed with and that said ordinance be numbered 665.

RE: NEW ZONING ORDINANCE
Glen Pond reported for the Planning Board they have been working on a new zoning ordinance.
We have had some more requests to rezone specific areas, and the Planning & Zoning reco-
mmended that all the requests that come in now be held until we have had the zoning hear-
ings on the new ordinance. In connection with that zoning proposal we have a map that has
been colored in according to which areas of the city would be zoned and how they would be
zoned. It is a colored map and is a lot easier to read than the one we have now. At the
request of Chuck Frost and Jim Keller with the approval of the Planning and Zoning they
have requested that some funds be allocated so they can have the map published in color.
To do a color separation, it may cost around $600 and whatever expense there is in publish-
ing the mpp would be in addition to that, so it could cost about $1500 when we get all the
printing done. Glen had talked to the Mayor, and his feelings were we should go ahead with.

approval to send the money needed. A motion was made by Glen Pond and seconded by Bruce
Sutherland to allocate the funds necessary for the color coating and publishing of the

Jim Keller
Jim Keller from Forsgren Perkins was at the meeting to discuss Collection System Rehabil-
atation, for the sewer system and getting a grant that is available. Jim Keller passed
out worksheets of the problem area in the city. He told the council there is no set amount
for the grant now, what we have to do is justify the dollar amount we request. (worksheet
attached) He explained one reason that it is so expensive is it is so deep, 17 feet deep
in some places.
