HomeMy WebLinkAbout1986.02.05 CITY COUNCIL MINUTES`1'i RE: INEL PARK CARS AT CONVENIENCE STORE The Mayor reported that Dr. Reneau has suggested that the INEL people park their cars on a lot at h%s convenience store just west of Rexburg. Blair had talked to the fel- low from INEL about it and he thought it would be a good idea and will fix a map and have them park there. He suggested that we might possibly have to put no parking signs up on that street, as an alternative or Sander Larson suggested that we at least put up 2 hour parking signs. RE: REORGANIZATLON OF COMMITTEES The Mayor told the council that we needed to get the committees organized, especially the safety committee. Some of the other committees might need to be reorganized. RE: PLANS COMPLETE FOR AMERICAN NURSING HO"IE PEOPLE The mayor reported that the American Nursing Home people have their plans completed and are sending the plans for review. They are planning on ground breaking in March. RE: DETAILS ON INSURANCE THROUGH THE AIC The mayor told the council that Gary Archibald called and said he should know about what the insurance company would do in about a week. The mayor was going to Boise and would meet with Bud Blaine on Friday about the insurance through the AIC, and go over it with him. RE: COMPLAINTS ABOUT SNOW REMOVAL Bruce Sutherland said he had had a call from a lady on West Main complaining about the snow removal between the railroad crossing and 4th West. He suggested that in the City Hall they make a list of people with snow removal equipment who would be available to plow out private driveways. The mayor suggested that some scout trou!~s would like to earn money by shoveling driveways. A motion was made by Nile Boyle and seconded by Sander Larson to pay the bills.. All Aye. A11 Aye . RE: APPROVA~TAX ANTICIPATTnN_NnrF The mayor told the council that we need to approve a Tax Anticipation Note for $200,000. A motion was made by Nile Boyle and seconded by Bruce Sutherland to pass a resolution to approve a tax anticipation note for the city to borrow $200,000 and authorize the mayor to enter into the negotiations. RE: NEW MEMBER OF AIRPORT BOARD ayor or er o~council that Blaine Hall, chairman of Airport Board, had a recom- mended Dave Furniss, who works at Farmers Equipment and has an airplane and helps at the airport, to be a new member of the Airport Board. The members who are on the board now are Art Porter, Kent Jolley, and Blaine Ferguson. A motion was made by Glen Pond and seconded by Bruce Casper to approve Dave Furniss to be appointed to the Airport Board. All Aye. The mayor welcomed a group of scouts to the council, Troup 301. City Attorney, Mary Smith told the council that one of the scouts was her grandson. RE: DISCUSSION OF GREEN RIVER ORDINANCE oe omney was a e mee Ong o iscuss the enforcement of the Green River Ordinance. The mayor explained that in each packet for the council was a copy of a memo, (copy attached) with the clarification-and interpretation of the Green River Ordinance pro- vided by the City Attorney. Mr. Romney said he got involved with this in September. They own the Millhollow Frozen Yogurt, and it came to their attention that there was another merchant who was selling door to door primarily to student housing. He thought that it seemed that it was in violation of the Green River Ordinance. He had contact- ed the police department, but it has been .four months now and the situation has become more complicated. He felt that there were two things necessary (1) was a clarification of what the ordinance and (2) a vigorous enforcement of the ordinance. The memo that was handed out seems to be a step in the right direction of the clarification of what the ordinance means. The second step of the enforcement is yet to take place. He felt that it should be enforced that a merchant or peddler should not call on a resident in their private home or apartment without calling them to make an appointment prior and making arrangements to stop at their home to sell or discuss selling their wares. These people have contacted that apartments well in advance and then just continue to call on the apartments time after time with their product no matter who lives there. Monday evening he had received reports that the merchant just stopped at the apartments and said do you want to buy any of our stuff. In the prior months there had been a number of complaints filed with the police, none of which had proven fruitfu]. He felt that three things. needed to be done. (1) the individual who is involved needs to be aware of the interpretation. (2) there needs to be a clear understanding on the part of the police as to what the meaning of the Ordinance is. (3) need to have vigorous enforcement. The mayor told him that we don't have any problem with a transit, because when someone reports a transit to the police they go out and stop it. The problem we have is with local people. We have scouts or school kids going around selling things and then some local people go out and there is a fine line. In this particular case he thought the police should notify these people and tell them they are in violation. Sander Larson stated that he thought Mr. Romney had a just concern, and that there is definately a difference with a scout or school group and in a local business. He said there had been incidents when a police officer has been called to a situation and have observed what was happening and have not taken any action. It could have been because it was not clear. If they are in violation of that action, it needs to cease. Bruce Sutherland said he did not think there was any reason to go to a home without contact- ing the people first by telephone, and then if there is a problem they are in violation. The mayor thought we needed to go down and tell the people that they are in violation in writing and then if they are caught doing the same thing, it is a different matter and we can take action. RE• REPORT ON SAFETY COMMITTEE (ORDINANCE 497)_ Bruce Sutherland reported on the Safety Committee refering to ordinance 497. When the organization of the safety committee was organized in 1968, the membership was made up of 10 members. He thought that 7 members would be enough. After discussion, it was felt by the council that the ordinance should be amended with a councilman, the police chief or a representative of the police department, the public works director, and four citizens and other advisory members on the committee. Mary Smith was asked to amend ordinance 497. .,~~ a The mayor said when he went over to Boise last week he stopped at the Highway Department. The lady that was over.the state highway safety committee said she would get some pam- olets on safety that they have and send them to us. RE: REPORT ON LLABILITY INSURANCE e mayor repor e on t e ,a , ,ty Insurance. When the mayor was in Boise, he talked to Bud Blaine and Bill Jerackie. Bud Blaine gave him a letter of what the insurance would be. "They have the ,backup insurance, with a company in Florida, and it has been approved by the state insurance commission. ~We received from Valley View Sewer District $15,750 for sewer hookuas for all the lots. RE: DISCUSSION OF LOAN AND TRUST FUND e mayor to t e counc, tat the representative from Americare was in the city hall today talking to ECIPDA to negotiate the loan for $970,000. They are ready to go. They have bank financing. As soon as they start, which will be in March, they. will start paying interest which is paid every month. We need to set up some kind of a trust fund so interest is paid on it so the fund remains in tact. He said it wasn't going to be easy to get any federal grants from now on. If we can keep that fund all the time, we will have almost as good as revenue sharing. They plan to have it in operation in a year, they would like to have it going by December. We will have to bid the water line to the nursing home. The mayor discussed the personel manual, which had been mailed to each councilman and ask if they would go over it and come to some special meeting to discuss it. The first meeting would be at 7:00 a.m. Monday. RE: EXPLANATION OF QUESTIONNAIRES FOR BUSINESSES e ynn E Strom a an a out some ~A questionnaires to all the businesses. Mayor Porter explained it to the council. RE: SPRING PROJECTS e mayor to t e council that when spring comes we need to start working on projects. Each councilman needs to meet with the Department Head that he is in charge of and go over all the needed projects. RE: ECONOMIC DEVELOPMENT STUDY OF COMMUNITY ayor Porter said he had got a letter from Arthur Young about doing a study of Economic Development in the community. They are going to do a study in St. Anthony. He asked the council if they. were interested. They thought he could present it to us and tell us how much it would cost and we could go from there. RE: COMPLAINTS ABOUT ALLEY BY COLLEGE SQUARE Darlene Blackburn said she had had a complaint about the alley by College Square on College Avenue. RE: DISCUSSION OF PARKING The council discusses again the parking of the cars of the people who ride the INEL bus. A motion was made by Nile Boyle and seconded by Darlene Blackburn to pay the bills. A request or invitation means that the person, merchant or business entity has previously asked, verbally or in writing, for express permission to solicit or deliver their wares or goods to the individual at his private residence. If there is a dwelling in which there is more than one occupant, if one person extends the invitation or makes a request, then the solicitor would be permitted to call upon the individual making the request.
