RE: SUMMER, EVENT FOR REXBURG
Bob Smith, representing the Chamber of Commerce to give a presentation. For a number
years the Ricks College American Folk dancers have been traveling to Europe, they have
represented America well in a number of fold dance festivals. The thought occured to
several of them that the same king of thing could occur in Rexburg. Most college towns
have a summer event, and we have looked for something to do here. The chamber formed
a committee in May to study the proposal. The chamber felt it was something the wanted
to pursue. He handed out a copy of the Festival Advisory Board/Dance Festival Committee
and the Tentative Schedule. He said when they were in Europe they were housed either
in schools or with families. They would like to host the dance teams in homes. The
dancers would be here about 15 days, and there would be about 90 performers coming in.
He said they are trying to raise funds, and are looking for someone to underwrite the
grogram. We estimate it will cost about $50,000. We hope to recover that amount from
sales performances and other various ways. There is money available in the form of
grants. The mayor said that he thought it would be an exciting thing to get going, and
that he and the city council would do anything they could to support it and help. They
would also help to raise the money.
RE: DATE CHANGE ON HARVEST PROMOTION
Brad Liljenquest was at the meeting representing the Downtown Merchants Association.
He made a request to change the date of the Harvest Promotion from Oct, 17 & 18 to
Saturday Oct. 19, because they decided they needed the daylight hours. The council
felt there was no problem.
RE: PARKING PROBLEM DISCUSSED
Mayor Porter iscusse the parking problem on 5th West and Main. He said he still had
not got in touch with the AEC bus driver yet. He had got some calls from concerned
citizens requesting an overpass walkway. In checking with the engineers he found it
would cost about $180,000. There are some people that are getting out some petitions
to send to the Highway Department requesting a stop light. He had had the police
watching and making arrests on that road.
RE: BID OPENING ON SANDER SPREADER
The mayor told the council that we had the bid opening for the Sand Spreader. The low
bidder was Tesco Williams. A motion was made by Nile Boyle and seconded by Sander
Larson to accept the low bid. All Aye.
RE: STREET IMPROVEMENTS
The council discussed the street improvements and reviewed the costs by H & K.
RE: MEETING WITH COMMISSIONERS
The mayor told the council that there was a meeting with the commissioners on Monday,
September 9, 1985, at 3:30 PM.
RE: FLOOD INSURANCE
The mayor told the council that there is a survey being made by FEMA on Flood Insurance.
An engineering firm in Boise has the contact. They have been in Rexburg going over the
boundaries of our flood plain. They propose to call everything within the city Class B.
They said they couldn't find anywhere that the water would be over 6 to 8 inches deep in
the areas that are marked as the flood plain. By classifying it as Class B there would
be no restrictions on building in any area in the flood plain, and you can still get
cheap insurance. The mayor told them to go ahead with it.
RE: TRAFFIC PROBLEMS

3rd East, with traffic coming and going to the high school. Morgan Garner said he
thought the traffic was bad on 3rd East and 1st North. The council felt that the
Safety Committee should check it out and report back,
RE: DISCUSSION OF MAYOR'S SALARY

was, and stated that they did not think it was enough. The city clerk stated that she
thought it was a full time job, and that il~yor Porter was on the job nearly full time.
The council thought it should be looked at another year to make the position of mayor
full time or think about a city manager.
A motion was made by Sander Larson and seconded by Darlene Blackburn to pay the bills.

A meeting of the City Council for the City of Rexburg, held October 2, 1985, at the
City Hall.
Present were the following:

A motion was made by Sander Larson and seconded by Darlene Blackburn to approve the
minutes. All Aye.
RE: PURCHASE OF POLICE CAR
e mayor iscusse a ease purchase of a police car. The city Attorney, Mary Smith,
had checked it over and said it was okay. We are in the process of getting the insur-
ance binder. It is for a 1985 Chevrolet Impala four-door sedan, $13,047. Sander Larson
introduced a resolution approving the purchase of the car (copy attached) seconded by
Nile Boyle.

RE: MEETING IN BOISE
e mayor sai e a ended a meeting Friday in Boise for the Association of Idaho Cit-
ies and they went over the various things they had to do for their Legislative pro-
gram for the Legislature in January.
(1) One thing they are interested in is an introduction of legislation that will take
care of some of the frivolous law suits the cities, counties, state and school dis-
tricts has, anyone that is suing will have to post a bond and they will know that if
they loose the case then the court will make them pay reasonable attorney fees, not
only their own but also those for the city, or county, who ever they are suing.
(2) The counties and the cities plan to increase the state revenue sharing r~oney. If
there is an increase in the sales tax of 1%, they get 4 of it just as they do now.That
would partially replace the revenue sharing money that we are losing from the federal
government.
(3) To return the property tax to the old formula instead of the way it is now.
(_4) Whenever there is an increase in the assessed valuation of the city your property
tax levy can go up, to take in that new valuation.
RE: HEARING IN IDAHO FALLS

Falls, the governors budget hearing, they will also discuss liability insurance, and
additional state. revenue sharing.
RE: REVISION OF STATE TAX SYSTEM
There are a numbe~° o mem ers o the house that have formed a committee that is working
on a "Idaho Recovery Act" of 1986. It is to revise the tax system for the state of
Idaho, held Oct. 28.
RE: LEGISLATIVE DINNER
e loin egis a eve inner for Cities and Counties will be held November 19, in
Idaho Falls.
They are thinking of amending the division of liquor store profits so that everyone
shares in the loss or increase.
RE: INSURANCE PLANS FOR COUNTY AND CITY
The counties and the cities are working on an insurance plan for themselves. We will
have to put up so much money and then they will have to find someone to give them re-
assurance. If the legislation comes through on the bonding for people that bring
suits against the city, it will make Idaho a better place for insurance companies to
operate.

RE: MAYOR REVIEWD PROJECTS
The mayor reviewed the projects that are underway in the city and some of them have
been completed. H & K is in town ti~~orking on them.

Sink hole at Sunset Circle
Street on Center Street
At the two pumphouses, one at Porter Park and one at Smith Park, the roof has been
leaking, those two roofs will be repaired and it will cost $2250.
RE: REPAIR WITH GUTTER AND CURB ON SHOSHONE
e city is pu ing out ~~e cur an gut er on Shoshone, and before the new is put
in, the city is going to compact it and put material on it that will make it expand
so it won't wash out again. We will also do it by the Stake Center, and they will
pay for the driveway repair.
RE: FAIR LABORS STANDARDS COMPLIANCE REPORT
Richard Horner gave the Fair Labors Standards Compliance Report. Everyone will be
out on a timesheet. The police is a little different, they are on a 160 hr week
and 28 day pay scale, with a limit of 171 hours with straight time pay, excess of
that we pay them overtime. The fire department will be changed to a 27 day pay cycle,
everything over 204 hours will be overtime, they are working out a few details with
the fire department. The wafer department, sewer & street will be starting their
work week on Saturday, so by Monday morning they will know how much weekend overtime
they will have. Everyone except the Police & Fire is overtime after a 40 hour week.
Unauthorized overtime could be a problem, if an employee keens track of it over a
long period of time, the employee has to sign the time card stating the hours are cor-
rect. We have some city employees that are doing contract labor for the city and most
of them probably won't be able to do that. If they work at any other position besides
their regular job, it is considered overtime, unless they are getting paid enough to
cover time and a half. There will be a problem with the janitor work and the street
painting. Gordon Tychsen does cement work for the city but he contracts that work
all over town so their would not be a problem.

The mayor said there might be a few problems. The standby time with the water de-
partment has been worked out. We are going to install a radio at the dispatch and
the one on call will to{;e a hand held radio where ever they go, but they will have
four hours for checking the reservoirs and pumps and we will give them Z day off. 'rJe
still have got to decide how to compensate them for holidays.
RE: MAYOR DI CU SE BREAKS
-T e ~ aya~~a~~a~a~~ talked to the departments about the breaks, they wi 11 be
15 minutes from the time they start their break, including leaving and returning. l~Je
have told them to take a thermos with hot coffee or pop. If .they use a city car for
breaks they need to all use the same one. It is giving an opportunity to tighten up
on some procedures.
RE: CITY VEHICLES
It wi e considered as taxable income to use a city vehicle at a rate of $3.00 per
day, or they can use a prorated lease value. This all has to be back dated to Jan-
uary 1. The council discussed the employees taking the city vehicles home, and felt
that the only ones that should is the ones on call. Sander Larson stated that he
felt that our repair bills would go down if the usage of city vehicles was cut down
by employees not taking them home.
RE: SICK LE~1 Ed
.e mayor sal we are working on the personel manual to define the sick leave. Sick
leave will be used only for the employee. If the spouse has surgery, or has a baby,
or a child has surgery, the employee can have that day off as sick leave on that one
day only.
RE: EOUESTED 4 Y STOP
Tn a menu es o~ e ast meeting there was a request fora 4 way stop at 2nd North
and 3rd East and the mayor hadn't told the police about it until the other day. They
will get it done and report at the next meeting.
The mayor told the council that they each have a copy of the new Rexburg Zoning Ordin-
ance and asked each of them to study it.
RE PAR NG DISCU SED
TFe par i~ a~n and 5th West by the Kennedy School was again discussed. Chief
Siepert had talked to Harold Stoddard the bus driver and they are checking into
parking at the Railroad Depo. If they do they would like us to keep the snow plowed
on that street.
A motion was made by Glen Pond and seconded by Nile Boyle to approve the bills. All

A regular meeting of the City Council of the City of
Rexburg, Madison County, Idaho, was held on Wednesday, the 2nd
day of October, 1985, at the hour of 7:30 p.m. at the City
Hall., Rexburg, Idaho, being the regular meeting place of said
Council, at which meeting there were present and answering roll
call, the following, who constituted a quorum:

Also Present: City Clerk, Rose Bagley
City Attorney, Mary Smith
Thereupon the following proceedings, among others,
were duly had and taken:
Councilman ,~~~ ,~, ,~.~.,~~~__.~, introduced the following
Resolution in writing and moved its adoption:
WHEREAS, it is necessary for the City Council of
Rexburg, Idaho, to purchase a new car for the use of the Police
Department. That the purchase of such a car would be for the
best interests of the City of Rexburg, Idaho; and
WHEREAS, the City Council, after calling for bids,
received a bid in the amount of $13,047.00 as the purchase
price for a 1985 Chevrolet Impala four-door sedan, Serial No.
1G1BL6969FY195545; and
WHEREAS, the City of Rexburg has no funds available
with which to purchase said car and has received an offer from
the First Security Bank of Idaho, N.A., wherein and whereby the

said bank has offered to loan the City $13,047.00 with which to
purchase the above described 1985 Chevrolet Impala, such loan
to be paid in thirty-six installments of $403.58 per month
beginning October 20, 1985, and continuing on the 20th day of
each month thereafter until final payment is due, with interest
at the rate of 7.125 per annum. That said First Security Bank
has submitted to the City Council of the City of Rexburg,
Idaho, an Equipment Finance Agreement wherein and whereby the
said First Security Bank agrees to finance the purchase of said
automobile and secure the repayment of the loan with Security
Agreement to be executed by the purchaser, the City of Rexburg,
Idaho, and the lender, the First Security Bank of Idaho, N.A.
NOW, THEREFORE, be it ordained by the Mayor and the
Council of the City of Rexburg, Idaho, as follows:
That the City of Rexburg, Idaho, borrow from the
First Security Bank of Idaho, N.A., Rexburg Office, Rexburg,
Idaho, the sum of $13,047.00 with which to purchase said 1985
Chevrolet Impala four-door sedan heretofore described and that
the City repay said loan in thirty-six monthly installments of
$403.58 each beginning October 20, 1985, and continuing on the
20th day of each month thereafter until final payment is due,
with interest at the rate of 7.125$ per annum. That the Mayor
and Clerk be authorized and directed to make, execute and
deliver to said First Security Bank all of the necessary
instruments, together with an Equipment Finance Statement
wherein and whereby the First Security Bank of Idaho, Rexburg
Office, Rexburg, Idaho, retains a security interest in said
1985 Chevrolet Impala.

said resolution and, on being put to a vote, was unanimously
carried by the affirmative vote of all councilmen present, the
