council discussed it and thought they needed to work with the driver of the AEC bus
and find a better spot to pick up the people that ride the bus. Mayor Porter said
he would talk to them. Sander Larson said there is a problem with big trucks park-
ing along that street. The mayor said he had talked to the police and they were
suppose to take care of i t.
RE: FEMA LOAN
Mayor Porter said that a Representative from Senator Mc Clure's office was in the
office to talk to him about the FEMA loan. They got all the information to take
back and go to work on it.
RE: PAVING AND PATCHING
Sander Larson discussed the alley on 2nd East behind Steve Terry's home. It will
be a period of time before we pave 2nd East and it is in the plan to pave that
a-ley at that time, the mayor told the council. He suggested that we pave it now,
it is only 300 feet and should not cost too much. The council agreed. H & K is
coming in to do some patching and could do it then.
RE: IRRIGATION PIPE BLEW OUT
The mayor said up on Shoshone where Bill Turnball lives, there was a blow out on one
of the irrigation pipes and it really cut the road. It was just a gravel road. Mary
Lee Sellers has been up there to try to get the people to sign a petitiQnto go on a
LID but she could not make much headway. The mayor said he thought we should go up
and put a lot of gravel on it.
RE: REPAIRS
The council discussed several spots around the city that need to be reppired.
RE: EXPERIENCE RATING DECREASED
Mayor Porter read a letter from State Insurance Fund stating that our Experience
rating had gone down and our rates have gone up because of the number of accidents
our employees have. We use to get a refund but we don't anymore. Our losses have
been higher than average. The mayor suggested that each councilman talk to their
department about safety and make sure they are aware of it and then we could have
some safety meetings. He suggested we get someone from Utah Power & Light, Ricks
College, Art Porter Printing and Louisiana Pacific to talk about safety.
RE: NEW T.V. ORDINANCE READY
Mary Smith told the council that she had the new T.V. Ordinance ready, she had
made the necessary changes. She told the council that we have to publish it
once and wait 30 days after the first publication before we pass the ordination.
A motion was made by Glen Pond and seconded by Jim Morris to pay the bills. All Aye
Morgan Garner asked the clerk to ckeck on the Perry trailer, and tell him their 60
days was up and they would have to move it.

On 8-~3'-85 at 1:20 P.M. I made personal contact with Mrs.
Elden Perry at 306 South 3rd West in reference tc their trailer
home bin; moved because of zoning ~.~iolations.
Mrs. Perry i^dicated that she tho~.ight they had been given 9~
da,s tc move their trailer b~~t I advised her that it was my ~_~nder-
standing that the council had allowed them 60 days, but should she
ha~re question, feel free to contact .a member of the council or City
Hall. Mrs. Perry also stated that they were in the process of buying
a hcme but hadn't closed the deal as cf yet.

Mayor Porter:
I personally made contact with Mr. Jay Hepworth of Tri State
tiro on 8-22-85 at 1:00 P.M. and discussed the problem of his bus-
ine:s wing the Richmond lot for commercial use.
Mr. Hepworth was advised that the City Council had ruled at
the Council meeting on the night cf 8-21-85 that he aas in violation
of the City zoni^g code and would be requeGted to dis-continue anj
further use of the property for commercial purposes. Mr. Hepworth
commented to writer that he was aware that Mr._Davenport had complai^ed
to the City Council concerning the lot in question, and that he, Mr.
Hepworth, was waiting for a decision fro... the City Council so that
he cculd notify Mr. Richmond in dissolving his lease o.. the property.
Mr. Hepworth appeared to be very unc+erstanding but was advised
by writer should he have f:.~rther questions, he sho~~ld make contact
with the Pexburg City Planning Commission for more information.

A motion was made by Councilman Morgan Garner and seconded by Councilman Jim Morris
that the rules requiring an ordinance of a general and permanent nature to be read
on three occasions be dispensed with and that said ordinance be numbered.

permanent Assistant Pilice Chief, and Captain. He asked Blair Siepert if he would
like to say anything. He said he did recommend that Sgt. Archibald be appointed a full
time Captain, and that be effective for budget purposes October 1; but would like the
rank to be effective immediately. The mayor told Blair that the council had talked
about the salary part of it and he thought that he should go over it with the Police
committee. A motion was made by Morgan Garner and seconded by Nile Boyle that Lynn
Archibald be made permanent Assistant Chief and Captain. All Aye
RE: REQUESTED DAY CARE CENTER
Rhoda Lea them was at the council to request having a day care center at 172 East 2nd
South to be called Wee. Ca re Day Care. The city clerk had given her all the rules and
regulations for a day care center and the mayor asked her if she could comnl,y. Mrs.
Leatham said they use to have boys housing so there u~as parking for 5 cars and there
is a big play area fenced in the back yard. The mayor said that zoning is such so it
can be allowed. The mayor said we only give a business license, the state gives a day
care license. A motion was made by Morgan Garner and seconded by Darlene Blackburn
to approve the business license. All Aye.
RE: RESOLUTION READ CONCERNING GENERAL CITY ELECTION.

RE: SUMMER. EVENT FOR REXBURG
Bob Smith, representing the Chamber of Commerce to give a presentation. For a number
years the Ricks College American Folk dancers have been traveling to Europe, they have
represented America well in a number of fold dance festivals. The thought occured to
several of them that the same king of thing could occur in Rexburg. Most college towns
have a summer event, and we have looked for something to do here. The chamber formed
a committee in May to study the proposal. The chamber felt it was something the wanted
to pursue. He handed out a copy of the Festival Advisory Board/Dance Festival Committee
and the Tentative Schedule. He said when they were in Europe they were housed either
in schools or with families. They would like to host the dance teams in homes. The
dancers would be here about 15 days, and there would be about 90 performers coming in.
He said they are trying to raise funds, and are looking for someone to underwrite the
grogram. We estimate it will cost about $50,000. We hope to recover that amount from
sales performances and other various ways. There is money available in the form of
grants. The mayor said that he thought it would be an exciting thing to get going, and
that he and the city council would do anything they could to support it and help. They
would also help to raise the money.
RE: DATE CHANGE ON HARVEST PROMOTION
Brad Liljenquest was at the meeting representing the Downtown Merchants Association.
He made a request to change the date of the Harvest Promotion from Oct. 17 & 18 to
Saturday Oct. 19, because they decided they needed the daylight hours. The council
felt there was no problem.
RE: PARKING PROBLEM DISCUSSED
Mayor Porter iscusse the parking problem on 5th West and Main. He said he still had
not got in touch with the AEC bus driver yet. He had got some calls from concerned
citizens requesting an overpass walkway. In checking with the engineers he found it
would cost about $180,000. There are some people that are getting out some petitions
to send to the Highway Department requesting a stop light. He had had the police
watching and making arrests on that road.
RE: BID OPENING ON SANDER SPREADER
The mayor told the council that we had the bid opening for the Sand Spreader. The low
bidder was Tesco Williams. A motion was made by Nile Boyle and seconded by Sander
Larson to accent the low bid. All Aye.
RE: STREET IMPROVEMENTS
The council discussed the street improvements and reviewed the costs by H & K.
RE: MEETING WITH COMMISSIONERS
The mayor told the council that there was a meeting with the commissioners on Monday,
September 9, 1985, at 3:30 PM.
RE: FLOOD INSURANCE
The mayor told the council that there is a survey being made by FEMA on Flood Insurance.
An engineering firm in Boise has the contact. They have been in Rexburg going over the
boundaries of our flood plain. They propose to call everything within the city Class B.
They said they couldn't find anywhere that the water would be over 6 to 8 inches deep in
the areas that are marked as the flood plain. By classifying it as Class B there would
be no restrictions on building in any area in the flood plain, and you can still get
cheap insurance. The mayor told them to go ahead with it.
RE: TRAFFIC PROBLEMS

3rd East, with traffic coming and going to the high school. Morgan Garner said he
thought the traffic was bad on 3rd East and 1st North. The council felt that the
Safety Committee should check it out and report back.
RE: DISCUSSION OF MAYOR'S SALARY

was, and stated that they did not think it was enough. The city clerk stated that she
thought it was a full time job, and that i9~yor Porter was on the job nearly full time.
The council thought it should be looked at another year to make the position of mayor
full time or think about a city manager.
