RE: WELL ON DAVIS PROPERTY
They also discussed the well we have on the Davis property. The council decided
the city should run a fesiability study on the well to see if the city could use
i t.
Mayor Porter announced that the council was going to a closed session to discuss
a piece of property.
A motion was made by Morgan Garner and seconded by Darlene Blackburn to pay the
bills. All Aye

A meeting of the City Council for the City of Rexburg, Madison County, held August
7, 1985, at the City Hall.

A motion was made by Darlene Blackburn and seconded by Nile Boyle to approve the
minutes. All Aye
RE: OUTDOOR DANCE AT WIZARD PARKING LOT
Ron Lindley was at the meeting to again request having an outdoor dance at the
Wizard parking lot. He gave the council a letter informing of the dance and the
control signed by him, the owner of the property and neighbors. He requested
the dance to be held on September 2 from 8:00 PM to 11:00 PM and on September 3
from 8:00 PM to 10:30 PM. He said he would guarantee no loudness and problems
with the dance.
RE: OUTDOOR DANCE AT THE POD'S PARKING LOT

Gene Statham representing POD's was at the meeting to request having outdoor dances
in their parking lot. They wanted to know what they would have to do to be able
to hold outdoor dances. They would not allow any drinking of beer outside and would
keep it under control. They would like to have one a week or one a month. They
would have a tape and a disc jockey and would like to hold it until 11:00 PM or
12 Midnight. The mayor told them they would have to have a petition taken around
the neighborhood to get their okay because it is right next to a residential
neighborhood.
RE: ORDINANCE WITH RULES AND GUIDELINES
Nile Boyle said he thought we needed an ordinance with rules and guidlines on the
location and time. There was a discussion by the council. A motion was made by
Glen Pond and seconded by Darlene Blackburn to disapprove the dance to be held out-
doors, based on the control factor using the city police on off hours.

RE: COMPLAINTS ON PAST OUTDOOR DANCES
The mayor explained that we have had too many complaints in the past on outdoor
dances and in looking up the minutes of previous councils we found that there
had been a resolution passed against outdoor dances.
RE: WATER RESOURCE BOARD MEETING
The mayor told the council that last Friday night there was a meeting in Pocatello
for the Water Resource Board, and he went down there to present our case for a grant
to replace 5 sewer interceptor lines to the city. They had approved the grant for
this year and because of some other areas that they thought needed it worse they
posponed arse for one year. They did have our application set up for April 1985 and
now it it April 1986. The mayor had presented some more evidence the fact that
the Department of Health had forced us to allow Rexburg Heights to hook onto our
system and it goes through one of those lines that need to be replaced. The mayor
was sure we would have a good chance of getting that work started. He told the
council that Rexburg Heights had had low water pressure and the mayor, DeLynn and
the engineers had been up there to check it out and found that there is a problem
with a pressure regulator valve. We will have to fix it because it doesn't open
up like it should.
RE: PUBLIC HEARING TO CHANGE ZONING
8:00 PM a Public Hearing was held to change the zoning for property owned by Dr.
Craig Heiner at 236 East Main to Limited Commercial so he could put a Medical
Building on the property. The lot is zoned R1 at the present time. The Planning
Board have recommended that it be changes to Limited Commercial with the same re-
gulations as Professional Plaza and that the lot be part of the Professional Plaza.
Everyone on that street have been contacted and signed a petition and they have
also been sent a letter. The mayor showed the council the plat. He would be re-
quired to have the same set backs as for residential property. Dr. Smith was at
the meeting and ask questions. No one was at the meeting to protest. A motion
was made by Morgan Garner and seconded by Jim Morris to approve the zone change
from R1 to Limited Commercial subject to the restrictions of Professional Plaza
and to comply with the Residential set backs.

RE: BIRCH STREET RESIDENTS RESPOND TO TRAFFIC SIGNS
A group of people from Birch Street was at the meeting, acting as spokesman was
Bruce Sutherland. They thanked the council for the help with the signs. They
said it had helped the speed somewhat going down hill, and between Linden and
Maple Ave. They requested having a policeman up there once in a while to give
tickets. They asked the mayor about the speed bumps. He said he had ordered in-
formation on them but would ckeck further. He asked if they could have the
children at play sign and the speed limit sign on the same post. The mayor said
he would ckeck on it. They asked about a third sign going up hill on Linden and
Birch. The council felt that it would not be a good idea because of the slick
roads in the winter. The council told them they would have the police patrol that
street and issue tickets.
RE: STREET REPAIR PROBLEMS
Morgan Garner reported on street repair problems. He and the mayor and Farrell
had gone up on the hill and checked the streets. It looked like we will have to
replace some driveways, curbs and approaches and will have to take out some and
start over. On Shoshone there is 5 sections that is bad and by the Stake Center
there is several that have bad areas, there is one bad one on Cresthaven. The
mayor suggested that we find out the cost on how much a foot it will cost and
work out a formula and have the property owners pay so much and the city will pay
so much. We need to get the repairs done this year.
