When the first house was built on that street they put a 3/4" line in for their house and then every house after that hooked onto that line. In order to correct it the property owners would have to put in a 2" line, and they would have to stand the cost because they had to get permission from the school to build there and they are the ones that put that line in in the first place. RE: SEWER PROBLEMS ON CORNELL The Mayor said the people on Cornell have been having a lot of sewer problems. There is a line that has no manholes on it. After tracing it down, we found out that when Bill Webster built up there, he took his own line from 2nd South and ran it on up to where he built. As the other houses were built on that street, they hooked onto that line. He did not put any manholes in, so there is no way we can clean it out. This week we have put some manholes in. It will cost about $600 or $700. RE: WATER STUDY The Mayor said the last water study was done in 1972. When the council met about the telemetering, he would like to discuss it. MINUTES OF THE CITY COUNCIL MEETING October 17, 1984 State of Idaho) County of Madison( City of Rexburg) A meeting of the City Council for the City of Rexburg, Madison County, held October 17, 1984, at the City Hall. Present were the following: Mayor John C. Porter RE: APPROVAL OF MINUTES Councilman: Jim Morris Sander Larson Morgan Garner Glen Pond Nile Boyle Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk A motion was made by Darlene Blackburn and seconded by Nile Boyle to approve the minutes. All Aye, RE: SERVICE PROJECT Mayor Porter said he had received a letter from Jacob Haberlie, who is graduating from primary and needs to do a service project. He had made a survey on Culdesac just off of 3rd West. There are 11 children younger than 12 on that street. He had a petition signed by all the people on that street requesting that a sign be put at the entrance limiting the speed on that street because of small children at play. The council felt that this would be a good idea and the mayor said he would instruct Farrell to have the sign put up. RE: BLINKING LIGHTS Mayor Porter read a service agreement with the Utah Power and Light to put up the Blinking Lights on North 5th West and Main and another agreement to install the electricity at the new City Hall. A motion was made by Nile Boyle and seconded by Jim Morris to authorize the mayor to sign the service agreements. All Aye. 1 z~ ~ RE: TAXES The mayor told the council that there are some bonds that come due at the end of the year before our taxes come in, so we plan to borrow on a tax anticipa- tion note. The mayor read a resolution to borrow on the tax anticipation note. We can borrow up to as much as 75% of the property tax on the general fund levy which makes it $238,632 at 72% interest. (copy on file) A motion was made by Nile Boyle and seconded by Darlene Blackburn that the council approve the resolution. All Aye. He said they had felt that $66,000 that we had borrowed would have to be paid back at the same time as this although the note asks for it to be paid back July 31. Mary had checked on it and it is a separate fund that goes into the building fund. RE: APPROVAL OF CARTER PROPERTY The mayor reminded the council that they had approved the exchange of the Carter property with the city property at an earlier meeting. We gave them a piece of property that we bought with the property for a parking lot and they in exchange gave us three feet to widen out our alley. When we approved that, we ran a notice in the paper and there was 90 days that people had a chance to protest, and no one had protested. We had an appraisal on the property. The city property was appraised at $1060 and Carter property was appraised at $1010. These were appraised by Reed Larson a licensed appraiser. The mayor read a resolution stating that (1) City property ceased to be used for public purposes. (2) The City can use the Carter property. (3) Property is of equal value. (4) There have been no protests to widen the alley. A motion was made by Morgan Garner and Seconded by PJile Boyle that the property be exchanged and authorize the Mayor and City Clerk to give Carters a deed of Trust upon receipt of deed of trust from the Carters for their property. All Aye. RE: HANDI BANK PARKING The mayor said there had been a request for more parking in front of the Nandi Bank that is used by the First Security Bank, Valley Bank, and I.B.T.. The problem they are having is people park along that street with no controlled parking and they can't get to the Nandi Bank. They would like to have the three parking spaces in front of the Nandi Bank limited to 5 minute parking. A motion was made by Nile Boyle and seconded by Glen Pond to allow three parking places in front of the Nandi Bank with a limit of 5 minute parking to be reviewed in 6 weeks. All Aye. RE: BLINKER SIGNS The State of Idaho Department of Traffic came in the office, and they have everything read for the blinker signs and as soon as we get the wiring and power they will be on. They also gave the mayor a study they made February 1984, they checked it from 2:10 p.m. to 2:50 p.m. there was an average speed of 35.3 miles per hour on West Main by North 5th West. RE: COLOR FOR NEW CITY HALL. The architect met with Darlene, Mary, and Rose and they picked out the colors for the new city hall. It is coming along on schedule. RE: LID's The new LID was discussed and Jim Morris asked about driveways. The mayor said we would charge so much a square foot which would be paid by property owners. RE: FLAT RATE FOR WATER USERS The mayor discussed a flat rate for water users. Charles Zollinger has a shop on North Center and he has a 3/4" water line to it. All they have in the shop is a restroom facility. The line has a leak and he has to replace it. He would like to put a large 2" line in there because on occasion he has to fill a 1000 gallon water tank for construction. At the present time, he fills it at a fire hydrant which we charge him for, but he feels it costs him money for the man waiting there to get it filled. The 2" line would make such a high demand on his meter and make it not pay to have it. The mayor said he now pays the minimum which is about $60 a year. He would pay for the line and we would charge him $100 or $120 a year and there wouldn't be a meter. He only has to fill the tank about four or five times a year. A motion was made by Nile Boyle to work it out with Charles Zollinger seconded by Morgan Garner. All Aye. zs RE: AUDIT CONTRACT The mayor asked .the council if -they had had a chance to read the. audit contract for 1983-1984 from Rudd, DaBell, Call, & Hill that had been mailed out to them. The cost of the audit will range from $7,000 to $7,200. A motion was made by Jim Morris and seconded by Morgan Garner to except the audit contract from Rudd, DaBell, Call, & Hill for $7,000. All Aye. (copy attached) RE: BOY SCOUTS ATTEND J.D. Hancock was at the meeting with a group of Boy Scouts. RE: MUTUAL AID AGREEMENT Sander Larson read a Mutual Aid Agreement with the Madison County Fire Department. This agreement would allow the City to assist them and the city would be able to assist the County. Sander Larson stated that he would recommend that we proceed with it. J.D. Hancock, Assistant City Attorney, recommended that Mary Smith review this agreement before it was excepted by the city. A motion was made by Jim Morris and seconded by Sander Larson to accept the Mutual Aid Agreement pending Mary Smith's review and council. All Aye. RE: EXTRA MEETING Mayor Porter announced that after the council meeting the council was going to have a personnel meeting. RE: APPROVE BILLS Jim Morris made a motion to pay the bills seconded by Morgan Garner. All Aye.
