A meeting of the City Council for the City of Rexburg, Madison County held August 1,
1984, at the City Hall.

A motion was made by Glen Pond and seconded by Jim Morris to approve the minutes.
All Aye.
RE: BEER LICENSE FOR HARDY ENTERPRISES
Mayor Porter read a beer license for Hardy Enterprises for the sale of beer bottled
and canned not to be consumed on the premises. A motion was made by Jim Morris
and seconded by Morgan Garner to approve the license. All Aye.
RE: BUSINESS LICENSE FOR CHRISTIE RICHARDS
Mayor Porter read an application for a business license for Christie Richards--The
Flower Girl at 250 Apache to have a business in her home. The council decided
that that addition has restrictive covenants and the city clerk was instructed
to tell her we could not override those restrictive covenants, and she could not
have a business.
RE: BROKEN CURB -- CITY LID
The mayor said that from the railroad track to the canal the curb is broken, and
the people want it cleaned up. On 3rd East and other places in town the curb and
some sidewalks need to be put in and replaced. He suggested that we announce an
LID and go see people and see if they want to be on the LID to get these repairs
done. It would be a city wide LID.
RE: SEWER GRANT
The mayor discussed with the council the sewer grant we have been trying to get for
five of our interceptor lines to be enlarged. They are surcharging. When the
Legislator passed the 1¢ sales tax, they put so much of that money in the water
improvement, so we immediately sent in this same project and they approved it. Our
grant will be for $312,750. We have to match that with 25% which we have in the
TEDRO funds. He had notified Jim Keller and he will meet with us right away, so
we can get everything ready to go. Our share will be about $110,000.
RE: TELEMETERING
Forsgren Perkins met with the people on the Telemetering, and they think they have
it worked out and they want to meet with us next week.
RE: DRAINAGE SYSTEM
The mayor said he and Farrell had gone around town and looked at places where
water is coming off the eves of houses and they are putting in a drainage
system and making a break in the curb and just putting a pipe in and it comes
down and drains into the street. Farrell had stopped one today. He told them
they had to get permission from the city first.. There are two on second south.
The mayor thought they should have permission to do it and it must be done in a
workman type manner.
RE: DRAINAGE PROBLEM

There is a problem down by Boise Cascade and the Railroad crossing. We have a
storm sewer in the middle of main street. Farrell had talked to the mayor about

~' RESOLUTION
Nile Boyle offered the following Resolution and moved

its adoption:
G~ WHEREAS, on September 28, 1983, the City of Rexburg,
~~ Idaho, was the owner of and in possession of the building
"' located at 12 North Center, Rexburg, Idaho, which was occupied
~~
and used as the City Hall, and

WHEREAS, on September 28, 1983, said City Hall was
<~ accidentally destroyed when a break in a natural gas line
caused an explosion to occur in said City Hall, and
WHEREAS, the damage to the City Hall was so extensive
that the building could not be repaired, and
WHEREAS, the Rexburg City Council at a special

,t meeting held July 11, 1984, voted to restore and rebuild the
Rexburg City Hall at its original location at 12 North Center,

., WHEREAS, the accident occurred after the 1983-1984
annual appropriation was made, and
WHEREAS, the City of Rexburg does not have funds
~~' available to finance the complete restoration of the building
`` and it will be necessary for the Mayor and Finance Committee to
's borrow the sum of $ 66,000 which sum should be sufficient

to complete the restoration of the City Hall Building. That
~~' such sum be borrowed for a space of time not exceeding the
'~~, close of the next fiscal year.
n NOW, THEREFORE, BE IT RESOLVED that the Mayor and
Finance Committee of the City Council of the City of Rexburg,
Idaho be and the are hereby authorized and directed to borrow

'{ be incurred in making the restoration of the Rexburg City Hall.
s~ That such sum be borrowed for a space of time not exceeding the
close of the next fiscal year. That such sum and interest
shall be added to the amount authorized to be raised in the
next general tax levy and embraced therein.

Jim Morris seconded the adoption of the Resolution
and the motion for its adoption was unanimously carried, all
Council members present voting "aye" and none "nay".
CERTIFICATE
The foregoing Resolution was unanimously adopted by
the City Council of the City of Rexburg, Idaho, at its regular
meeting held August 1, 1984, at 7:30 o'clock P.M.

putting a pump in there and on the other side where C & L Body Shop is; there is
another drainage problem. He thought we should hook into the storm sewer right
there. We have some money this year we .can use to take care of the project.
RE: MONEY FOR NEW CITY HALL

The mayor had called up the state to find out what we could do to get the
money for the new city hall. It looks like we will have to have about $60,000.
We have to pass an emergency resolution. In the resolution we put the State
Code number under which we can call an emergency. When we certify our
property tax levy, we put at the bottom so much money and tell them what it is for
and attach the resolution, and they will allow it without any problem. A motion
was made by Nile Boyle to declare by resolution that the city hall blew up and an
emergency exists. (resolution on file) Seconded by Jim Morris.

RE: EXCHANGE OF PROPERTY
Mary Smith read ordinance 661 on an exchange of property with Tom Carter. He gave
us some property in the alley, and we in turn gave him property to square up
his property. It never was recorded, and he is selling the property now and wants
to get it taken care of.
ORDINANCE 661
AN ORDINANCE EXPRESSING THE INTENTION OF THE CITY OF REXBURG TO EXCHANGE CERTAIN
REAL PROPERTY HEREINAFTER DESCRIBED AS TRACT N0. 1, BELONGING TO THE CITY OF
REXBURG AND WHICH HAS CEASED TO BE USED FOR PUBLIC PURPOSES, FOR CERTAIN REAL
PROPERTY HEREINAFTER DESCRIBED AS TRACT N0. 2; PROVIDING THAT NOTICE OF SUCH
INTENTION TO EXCHANGE BE GIVEN AND THAT NO EXCHANGE OCCUR UNTIL SIXTY DAYS HAVE
EXPIRED FROM THE DATE AND PASSAGE OF THIS ORDINANCE, AS HEREINAFTER FULLY SET FORTH:
PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE.
A motion was made by Councilman Nile Boyle and seconded by councilman Jim Morris
that the rules requiring an ordinance of a general and permanent nature to be read
on three occasions be dispensed with and that said ordinance be number 661.

Ordinance 661 was then placed before the council. The mayor then called for the
voting for final passage of the Ordinance, and the motion was made by Morgan
Garner and seconded by Glen Pond that ordinance 661 be passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor declared that
the majority of all the members of the City Council had voted for the passage
of said ordinance, and that said ordinance was duly and regularly passed. Mayor
Porter declared the motion carried.
RE: PUBLIC HEARING
The public hearing will be 60 days from today, on October 17, 1984, at 8:00 p.m.
RE: BILLS
A motion was made by Jim Morris and seconded by Morgan Garner to pay the bills.

RE: INDUSTRY IN REXBURG
Mayor Porter told the council that the Chamber is planning to go to California and
wants to get a contribution from California to help them. They want to promote
industry in the Rexburg area. The council suggested $500 and then they would help
raise some more.

A motion was made by Glen Pond and seconded by Jim Morris to adjourn. All Aye.

A motion was made by Glen Pond and seconded by Morgan Garner to approve the minutes.

RE: TWO ISSUES FROM PLANNING & ZONING
Chuck Frost was at the meeting to represent the Planning and Zoning. He said he
would like to discuss two issues:
(1) The first one is sidewalks. He said he was happy about the proposal that was
in the paper that the city is going to have an LID for sidewalks. They had included
in the new sub-division ordinance a provision for sidewalks. Anything that is built
in the future should be required to have sidewalks. They would like to recommend
to the city council that all future building permits have a sidewalk as part of
their construction. When riding around the different subdivisions, you will see one
home with sidewalk and one without. Sometimes you will go down a block and there
will only be one sidewalk on the whole block. .The parents have come to Planning and
Zoning complaining because there is not sidewalks by the Lincoln School, Adams
School, and the high school. Chuck thought the LID is a good idea because there
are a lot of old sidewalks that are broken up badly and need to be replaced. This
effort would beautify the city. The mayor would like to include in the LID replacing
old curb and gutter. The council discussed putting sidewalks next to the street,
because when the snowplow goes through the sidewalks are worthless. Chuck Frost
said if you get the sidewalk next to the curb, that is as much property as property
owners can spare. There are difficulties around town because people have planted
next to the curb and put fences next to the curb, this could be overcome by
educating them. The mayor said the engineers are working on the costs and as soon
as they get the costs we will go around and contact people.
