A meeting of the City Council for the City of Rexburg, Madison County, held
July 5, 1984, at the City Nall
Present were the following
Mayor: John C. Porter
Councilman: Morgan Garner
Glen Pond
Jim Morris
Nile Boyle
Councilwoman: Darlene Blackburn
Also Present: Mary Smith, City Attorney

Richard Horner, Treasurer
RE: APPROVAL OF MINUTES
A motion was made by Darlene Blackburn and seconded by Nile Boyle to approve the
minutes. All Aye.
RE: JACK HOLDIAY & SMALL MALL (COLLEGE SQUARE)
Jack Holladay was at the meeting to talk to the council about remodeling and
rebuilding the small Mall (College Square). The mayor had presented it to the
Planning Board. They think the important thing is to get the parking okayed.
He showed a plat that Var Manwaring had made of the area and parking. He had gone up
to the college and found they need married student housing. They are taking two
rooms and making a one bedroom apartment. They will have all new fixtures and
furniture. If they would use a designated parking program. Behind P~orris' there
is 115 parking places; that is not controlled parking, there is the Brunson property
for uncontrolled parking. There will be approximately 40 apartments plus the I2 or 13
businesses. In the contracts they would designate where the parking was available.
This property is on the LID. There is an alley that is 24' across and could have
about 8 parking places through the alley and still have passageway through there.
Var Manwaring is concerned with his parking area because he has been infringed on
in the past with the people living in the Small h1a11. Mr. Holladay and Mr.
Manwaring had talked and resolved the problem. They would meet the specifications of
the fire protection. He said they would put a security on the building. Chuck Frost
had suggested that he poll the merchants and get their feeling. He had met
with the merchants and they were happy that he was going to make a bright spot in
Rexburg. Mayor Porter suggested that he lease Brunson property and that wouldn't
have enough spots, but it would be close and it would be his own. Nile Boyle told him
he would need to tell the tenants that they had to park behind Morris' or they would
get tickets if they park someplace .else.
RE: VAR MANWARING PARKING LOT
Var Manwaring was at the meeting to discuss the parking lot that belongs to him
that everyone else uses. He would like to have it policed more so it could be
kept free for his customers. The metermaid only tickets it every three hours
and he would like it ticketed every two hours. Var said if they could keep it
cleared for parking between them, he was glad to see something happening and have
someone taking an interest in the place.
The council decided it was okay for him to go ahead with the apartments, but they
would designate that they park behind Morris'.
RE: GENE PALMER TRAILER COURT
Gene Palmer was at the meeting to request annexation of the north of his present
trailer court. He showed a plat of the Ricks-Palmer addition and MiTlhollow
Meadows. He proposed to put in 30 more Tots. He said hehad all of his lots rented
and has a waiting list. A motion was made by Nile Boyle for the City to start
annexation proceedings for the proposed addition to the trailer court. Seconded
by Morgan Garner. All Aye. The mayor said all the department head would check the
plat and okay it.
RE: REED WYATT PUBLLC HEARING
0:00 p.m. a Public Hearing on the Reed Wyatt request fora 6-Plex. Mr. Wyatt
brought a copy of the plans to review. He explained again that the area was large
enough fora 6 dwelling unit, but he found out that he could not build a 6 plex in an
R2 zone. He said if he could not have a 6 Alex, he would have to convert it into a
4 plex and add a duplex in the rear. He had already built the 6 plex and was in
violation. He was at the meeting to ask fora variance to use the building for
a 6 plex. He would then be able to have more area for parking and be able to landscape
the property to make i,t look attractive. He had talked to the neighbors and they
agreed to it if he did not build anymore buildings. It would be okay to leave the
6 plex. Mayor Porter said he had a phone call from Wendell Archibald saying he wanted
to withdraw his objection. He had received a letter from Lottie Virgin saying
she had no objection. Mr. Wyatt had talked to Mike Jolley who said it was
okay. Glen Pond said he talked to the neighbors who said they had no objection
if he did not build any more buildings, but they did object to rezoning
the property.
E1Ray Klingler was at the meeting. He said it was a beautiful building and he
would prefer to leave it like it is if they would not add any more building. It
would be okay for him to build a carport and build a maintenance shop if it was
the size of a double garage.
Mayor Porter said there was a problem with the driveway. It was not fastened to
the street property. He would need to contact Farrell Davidson and have it
checked to make sure it was all in one piece. The water goes down the gutter
and unless the driveway gets sealed it goes under the driveway and then goes under
the curb. Another problem the Fire Inspector, Gordon Tychsen, says with three
stories you have got to have more stairway than you have. You have to have one way
in and two ways out.
Glen Pond said if we grant the variance it must have a restriction that no other
future buildings be placed on that property, so if Mr Wyatt sells it, this
restriction would go with property. Mary Smith told him that it would with a
variance.
A motion was made by Morgan Garner that a variance be granted to Reed Wyatt, and
that it be restricted to the 6-plex and no other buildings be allowed on the
property except a carport and a maintenance shop not to exceed 20' x 2$' in
size. Seconded by Darlene Blackburn.

RE: BUSINESS PARKING LOTS
Mayor Porter said he had met with the Planning & Zoning and they had talked about
businesses that have not paved their parking lots. We have an ordinance that says
they have 12 months to pave the parking lot after they finish the building. The
mayor said he would notify the businesses that have not paved their parking lots.
RE: LOREN STEGELMEYER VET CLINIC
The mayor told the council that Loren Stegelmeyer has a vet clinic north of the
city and wants to hook on to the sewer and will have to pay $1000. The council
felt there would be no problems.
RE: DAVID SEVY BUSINESS
Mayor Porter told the council that David Sevy at 169 North 5th West wanted to
operate a business at that address and also build a building for the purpose of
using it to refinish instruments. The Planning Board had requested that a city
employee take around a petition to all of his neighbors within 300 feet. They
were all in agreement for him to be issued a Special Use Permit for that purpose
when the city employee took around a petition. A motion was made by Nile Boyle
and seconded by Jim Morris that the city proceed to set a public hearing for a
Special Use Permit for the property of David Sevy. All Aye.

RE: SUNBIRDS
Mayor Porter said he got a letter from a Sunbird congratulating the city on the
streets. There was one problem that needed to be corrected that was the low hanging
limbs over the sidewalks.
RE: PEOPLE NOT TRIMMING SHRUBS
The mayor told the council that we are having problems with people not trimming
their shrubs and cleaning their lots in the city. We now have some people that don't
want to pay. There are people that live in houses and they don't clean their
lots and neighbors were complaining. The weeds and everything become afire hazard.
The mayor suggested that we send out a registration letter to the people in violtaion.
RE: FINANCE COMMITTEE
The mayor reported that the Finance Committee had met with Art Porter and he is here
to let us know about the proposition the committee and he had come up with.
Richard had gone over the insurance account for the building. Richard said since
the last time we met the architects fee has come down a little bit and we haven't paid
as much rent and if we purchased the building in the next week or so and calculating
the interest we have $192,500. Art Porter had taken the architect's plan and
estimated that it would cost $45,000 to remodel. This would be with all the business
on the ground floor. He had talked to Charles Zollinger and Harold Harris. Charles
Zollinger was the only one that made a bid for $47,000 to remodel. The remodeling
was- discussed. It was decided to turn the decision back to the Finance
Committee. In the absence of Sander Larson, Darlene Blackburn was appointed to
take his place on the committee. The committee would meet Tuesday morning at
7:00 a.m. with all the contractors and subcontractors and go over everything..
The council would then meet Wednesday morning at 7:00 a.m to make a decision.
RE: BILLS
A motion was mdde by Jim Morris and seconded by Morgan Garner to pay the bills.

RE: ADJOURNMENT
A motion was made by Ni]e Boyle and seconded by Darlene Blackburn to adjourn.

RE: FINANCE COMMITTEE

Glen Pond reported that the finance committee had met with the contractor and
subcontractors and went all over the remodeling and building. The only problem
that arose was air conditioning which would cost extra; about $3,000.
