Present were the following: Mayor: John C. Porter Councilman: Sander Larson Glen Pond Nile Boyle Also Present: Rose Bagley, City Clerk Richard Horner, Treasurer RE:~ APPROVAL OF MINUTES A motion was made by Glen Pond and seconded by Sander Larson to approve the minutes. All Aye. RE: FIREWORKS PERMITS Mayor Porter read fire works permits for: Gina Garner by the Junior High Skaggs Drug John Wade Nelson lot by Rays Husky Kings Rent-a-Video Rexburg 6th Ward Priest Quorum at 101 East Main A motion was made by Nile Boyle and seconded by Sander Larson to approve the above permits. All Aye. RE: PAMIDA LAW SUIT Mayor Porter read a law suit regarding the Pamida Building which collapsed February 14, 1984. The insurance company claims that the city was negligent in not making them build a stronger roof. The procedure we use on a building that size they have to present their plans and it is studied and we okay them. We have no way of knowing whether the stress factor is up to 40 pounds dead weight, but we do tell them that is what they have to have. It is up to their architect to make sure they have it. He said he didn't think any city has the physical facilities to test the roof to see. Byron Blakely said that the State of Idaho requires licensed engineers on structural areas and that is probably a pre-engineered building and the city inpsectors would be required to make sure they meet certain codes to make sure it complied with the 'drawing. They also should check on the engineers, that is ~ahy the engineers have a license. The mayor said that this building was built right after the flood and the inspector that checked this building was Maylan England, who is deceased. A motion was made by .Nile Boyle and seconded by Glen Pond to deny the claim. All Aye. RE: BUDGET Mayor Porter told the council that we had started on the budget. The first one that had been done was the police. There was something that come up that he thought we should start thinking about. (1) there was a suggestion that the insurance benefits be increased, (2) .that vacation and sick leave be changed, (3) some salary schedules be changed. He thought that the city should be paying the same as private industry or anything else in the city. He thought we should use the salary schedule that is being used in this city. Another thing we need to check is the cost of living increase that is being given in other areas. The city clerk said that our employees would like to have Washingtons Birthday as a holiday. RE: BIDS FOR 1 TON TRUCK Mayor Porter said that they had opened the bids fora 1 ton truck that day. Erickson Pontiac $11,900 Stones Town & Country $8971,70 for a dodge. The mayor suggested that we accept the bid for the dodge at Stones Town & Country. RE: PAVING ON 4th SOUTH Mayor Porter discussed the problems of the paving on 4th South. The pavement has not held up. They had written to Tiger Industries and they had agreed to come up and re-do the road. They have proposed to remove the areas that are bad and replace tham and seal coat the whole thing, but they feel that the city should pay half of the seal coating because it is in addition to their contract. Because of the bad spots the engineers feel that zeal coating would be a good thing. He said they were having a meeting next week and would notify the council so they could be there. RE: TELEMETERING The telemeter monitoring has never worked. The people from Idaho Falls don't seem to get anything done. Jim Keller has written to the company and they will send an expert in to go over the system to see what we can do. RE: REMODELING PLANS Byron Blakely was at the meeting to show the plans for remodeling the Porter Building. He said that if the council felt good about it, we could give it to Art Porter and have him get with his contract people and te71 us how far they could go. Nile Boyle said if we have to put $20,000 in every year for the next few years, we may as well build a new building. The mayor said if the plan is acceptable. Art will have to go out arld see the builders and see what they can do. If they can complete if for $190,000 if not we will have to do something else. The downstairs will have to be completed for that. RE: DROP BOX --~ The mayor said he was talking to the post office to see if we can get a drop box like they have to put at the fire department for payment of bills. RE: PAYING BYRON BLAKELY There was a discussion on paying Byron Blakely. The mayor said we had paid him $4900. He had a claim to us for $7480 which make it $12,380 which leave a balance of $1620. He suggested that we pay up to $10,000 and leave a balance of $4000 until we found out what we are going to do. The total bill is $14,000. Nile Boyle asked what he would knock off if we don't finish the new building. Byron said after you bid the job, there is only a balance of 20% left to pay. Byron said there is another thing. The printing cost is additional; it is never included as part of the fee because there is no way they have of knowing whether you want 5 sets of prints or 35 sets of prints. The mayor said he thought that was part of the architects job. He thought we were just going to pay 7% for everythnr~g. The council felt he should be paid up to 20% now and then check around on how other firms charge on the pringing. Byron said he would only charge for the exact cost to him of printing. RE: REMODELING Glen Pond said that Art Porter needs to understand that he needs to remodel the entire main floor and seal the building for a total of $190,000. RE: PAY BILLS A motion was made by Glen Pond and seconded by Nile Boyle to pay the bills. All Aye. RE: ADJOURNMENT A motion was made by Nile Boyle and seconded by Sander Larson to adjourn. All Aye.
