A meeting of the City Council for the City of Rexburg, Madison County held May 16,
1984, at the City Hall.
Present were the following: Mayor: John C. Porter
Councilman: Nile Boyle
Jim Morris
Glen Pond
Morgan Garner
Councilwoman: Darlene Blackburn
Also Present: City Attorney: Mary Smith
City Clerk: Rose Bagley
City Treasurer: Richard Horner
A motion was made by Nile Boyle and seconded by Morgan Garner to approve the
minutes. All Aye.
RE: TWO LAW SUITS
Mayor Porter told the council that we had recevied two law suits. Perry v.
Cedar Point Trucking and Allen Ray Perry. A motion was made by Nile Boyle and
seconded by Darlene Blackburn that we deny both of the claims. All Aye.
RE: CITY CLEANUP
The mayor said the city clean up is underway and we are getting a lot of complaints
from people that clean up their yards and their neighbors don't clean theirs and
their garbage blows to the neighbors clean yard. The council discussed the
Ferguson lot by K Mart. Ards are cleaning it up and when it is done, anyone caught
dumping in it will be given a citation the council decided. The mayor said he
would have the police start watching it and give citations for dumping.
RE: PLANS FOR NEW CITY HALL
The mayor told the council the plans for the new City Hall will be ready on Thursday
for contractors to pick up. The bids will be opened on May 31. A pre-bid meeting
will be held May 22, 1984 at 2:00 P.M. at the existing site.
RE: REED WYATT VARIANCE
The mayor told the council that Reed Wyatt came in and gave us a letter to withdraw
the request for a variance for his 6 plex and will change it back to a 4 plex.
RE: BUDGET
Richard handed out copies of the budget and explained it. There really wasn't any
problem. The streets will have a little problem. We will have a problem with the
revenue sharing because we won't get as much as we had planned. Mayor Porter
told the council we will have extra money from Sales Tax, in October we will get
$30,000. Mary said she would check to see if we would need to amend the budget to
use that money. The mayor thought we could use it. We are locked into the
budget where we levy property tax, you have to spend it in the department that
it is budgeted. Money coming in from sales tax you can move it from one
department to another.
RE: CONTRACT ON PARK
The mayor told the council that he had set up a meeting with the school for
Wednesday at 9:00 a.m. to discuss the contract on the park. Gale Lewis will be here
from the state. She will tell the school the rules and regulations. The board
has approved it, but Dr. Hill has some reservations. He said the American Legion
Baseball should give the money they earn on the signs or anything to go in the pot
to maintain the park.
RE: THINGS TO THINK ABOUT
The mayor said he had made a list of some of things we need to think about in the next
year:
The water department is running into a lot of problems. They are putting in a
sewer line which the contract was $9,000 and when we got in there, there was an
additional line that had to be replaced so we made a change order. The contractor
gave us the same per foot price, by the time we pay for the material that we
furnish, it will be about $13,000..
RE: CLEANING PRESSURE VALVES
The water department has been cleaning the pressure valves that controls the
pressure within the city, and when they cleaned the big one that controls the
pressure in the East part of town they discovered that there wasn't a bypass.
so if anything goes wrong with that pressure valve and they have to shut it down,
it will shut the water down all over that area. While they are inspecting
and repairing, they are putting in a bypass line. There are three of these around
the city. This will cost about $600.
The men in that department are working hard, and they do work for other departments.
We are going to have them keep track of the time they spend in other departments
and charge to that department. In doing that we will probably have enough money
to put another man on during the summer. The same thing happens to the street
department, they do a lot of work for other departments, so we will charge it to
the various departments. It is important to do this on utilities because we
charge the people according to expenditures, and they should not be subsidising
any other department in the city.
RE: ANOTHER MAN IN FIRE DEPARTMENT
The Mayor said he could see the time when we might have to have one more man in the
Fire Department. The county Fire District has passed their override to buy a new
fire truck, and when they get that here we will have a problem housing it. The
county is already talking about another man, and if that happens, we will have to
have another man to match it. One thing about it, it will cut down on the overtime.
RE: KEEPING PARKS BEAUTIFIED & CLEAN
In the parks the time is coming when we will have to spend more time keeping them
beautified and cleaned. Jim Morris said he had talked to Vaughn Jenkins, the
recreation director, and he is going to work with Judge Forbush to use prisoners
to help maintain the restrooms and tennis courts.
RE: MOVIES
The mayor told the council we had some complaints about the movies because they
are not rated and they are letting kids into the R shows. The police are
checking it out and talking to them.
RE: MORE FREQUENT GARBAGE PICKUP
The mayor said there are some stores in town that should have a garbage pickup
oftener. Some of the stores have it picked up once or twice a week, and in the
meantime they have a shipment come in and pile all the containers out in back and
the wind comes up and scatters it all over. When the stores have extra garbage,
we need them to call and we will make an extra pickup and charge them.
RE: ANIMAL SHELTER
Glen Pond asked if they disinfect the floor at the animal shelter. The mayor said
they are supposed to clean it out. They have it so they can just hose it out.
Glen said he had complaints that it wasn't being cleaned and the dogd are
getting infected.
RE: OVERRIDE
After the bid opening in the City Hall on May 31, the mayor suggested that if we
need more money to build the city hall that we have an override. Jim Morris asked
if we would have some money from the tax money. The mayor said he did not think
that that should go to the building. He said the City Hall is something that
the property holders should pay. Nile Boyle said he thought if we get the bid
pretty quick, we will get some good bids. The mayor said if the people want
the new building they will vote for an override.
RE: PASSING RESOLUTION
A motion was made by Morgan Garner. and seconded by Nile Boyle to pass a resolution
authorizing the mayor and city clerk to sign the sweeper lease. All Aye.
RE: COMPLAINTS ABOUT VACANT LOTS & BUILDINGS
The mayor said he had been getting complaints about vacant lots and buildings.
The mayor and city attorney had worked out a deal with Cramer about his
vacant house. Mike May will tear it down for the lumber and then knock it down.
Then Cramer will pay the city $150 to load it up and haul it away.
RE: PAYING BILLS
A motion was made by Morgan Garner and seconded by Jim Morris to pay the bills.
All Aye.

A motion was made by Nile Boyle and seconded by Jim Morris to adjourn. All Aye.

A meeting of the City Council for, the City of Rexburg, Madison County held June 6,
1984, at the City Hall.
Present were- the following: Mayor: John C. Porter

Sander Larson
Councilwoman: Darlene Blackburn
Also Present: te1ary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A group of guests from Ricks College Academy Players made a presentation and
invited the Mayor and Council to the first show that is opening on Firday and
Saturday night.
RE: APPROVAL OF MINUTES
A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the
mintues. All Aye.
RE: HATHAWAY SUB DIVISION
Mayor Porter presented the final plat for the Hathaway Sub Division. Glen Pond
said the Planning and Zoning had approved the plat, all of the department heads had
approved it. A motion was made by Nile Boyle and seconded by Jim Morris to
approve the-final plat as recommended by the Planning and Zoning. All Aye.
RE: REED WYATT 6-PLEX
Mayor Porter told the council that we had a letter from Reed Wyatt to withdraw his
request for a variance to build his 6-plex, but now he has talked to several of
the neighbors and has decided to go ahead and have a public hearing for a varaince
for the 6-plea. A motion was made by Nile Boyle and seconded by Sander Larson
to seta hearing for the variance for Thursday, July 5 at 8:00 p.m. All Aye.
