A meeting of the City Council for the City of Rexburg, Madison County, held
April 18, 1984, at the City Hall.
Present were the following:
Mayor: John C. Porter
Councilman: Morgan Garner
Jim Morris
Glen Pond
Nile Boyle
Councilwoman: Darlene Blackburn
Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A motion was made by Nile Boyle and seconded by Glen Pond to approve the minutes.

RE: VICTOR MENDOZA REQUESTS TO HOOK ONTO THE SEWER
Mayor Porter told the council that Victor Mendoza had come in the office. He
lives out by Amercian Potato, in the small area that is not in the city limits.
There are two or three trailer houses on the property. Mr. Mendoza would like to
hook on the sewer line that goPS between Rexburg and Sugar City. We charge
a fee to hook onto that line of $1000 and then he will have to run his own line
over there. He would like to make arrangements so he can pay the $1000 off in
six or eight months, what ever we decide to let him do. The mayor said if he
owns the property we would have no problem, or we could put a lean on the
trailer, or if he doesn't pay we can shut it off. If some of the other people
in trailers out there could share the cost, it would make it better. It will
cost him about $1200 to run the line. He works for Warren Walters. The mayor
said Mary Smith and Richard could work out the agreement.
RE: OPPOSITION TO PROPOSED. PLAN TO WIDEN SECOND EAST
Dan and Mary Hess, and Randall Porter were at the meeting representing the
property owners living along Second East from 4th South to 1st South. They
presented a petition in opposition to the proposed plan to widen that street.
Randall Porter said they have a couple of concerns. The homes that are
built along the street did not anticipate that the road would be widened to a
4 land road. That would put the road in some cases, only 15' or 20' away
from your front door. I would become a dangerous thing and also would reduce
.the value of the property. It would destroy the scenic value of the property
because they would have to take out approximately 30 or 40 trees that arrange
from approximately 25 to 40 years old. That would have a tendency to do two
things: it would increase the noise along the street and also reduce the value of the
property. They would like the City Council and the Planning and Zoning to
consider some other alternatives. One way would be to possibly divert the
traffic upwards to 7th South and run it across the hill for the property owners
that live east of 2nd East.
Dan Hess suggested to divert traffic down lst West, 2nd West, and 3rd West
since the Army Reserve blocks off that street. The property owner say
they now have a difficult time getting on the street on 2nd East. When
we built 4th south we realized it would encourage speeding of the college
kids so they put the landscaping in the center of the street to help, this
might help on 2nd East. They need a buffer between the sidewalk when they
remove snow. They are concerned about the value of their property.
Mayor Porter said there isn't any plan drawn on the street The state
has just excepted the engineer that the council recommended whith is
Forsgren Perkins. The state is now negotiating a contract with Forsgren
Perkins, because they pay 90% of it. When that is done Forsgren Perkins, the
State and the city will go over the contract and costs. After everything is
worked out, then the engineers will start designing the project. At that
time we will take your petition into consideration. He told them when the
council talked about the project there were two widths of the street suggested,
one was 45' and one was 50' but the council made no decision at that time.
The sidewalks will be taken out but they will be replaced with new ones,
and new curb and gutter will be put in.
RE: NEW CITY HALL DISCUSSED
The mayor told the council that Mary Smith is contacting the Insurance Adjustor
to see if they will re-open the case on our City Hall. We have a paragraph
from the inspection engineer that inspected it for the insurance company and
he says that the back end needs to be repaired, so we think we can get a little
more money. In the meantime we had Forsgren Perkins go and check the building.
They had checked the foundation all around; they think that the acutal foundation
is alright to construct a building on it if the brick work and everything is no
heavier than it was before; it will hold 1,200 pounds per square foot. They
do say that the back end needs to be reenforced and also the retaining
wall that went down through it will have to be dug out and checked. He talked
to Dick Davis, who built the old building, and he thinks that except in the front
that the bearing wall may have a big enough foundation. The mayor said it did
not appear to be as big of a problem as the Archichet had thought. The mayor
said he anticipated,. after talking to the Architect, we are talking about $25,000
or $30,000 more. We had discussed just filling the basement in, but the mayor
thought we could just make a hallway and go into the basement and use it for
storage.
RE: INTERSECTION OF 3RD WEST AND 1ST NORTH
The Mayor said the police had made a survey of an intersection of 3rd West and
1st North. (copy attached) It was decided that the council would go down
and look at it and make a decision at the next meeting.
RE: SPRING CLEANUP
The council decided that the Spring Cleanup would start Monday, April 23
and go for one month. The city would send trucks. around to pick up extra
garbage off the curb free of charge. It would have to be put in containers.
RE: SEWER PROBLEMS, NEW LINE TO BE PUT IN
Nile Boyle reported on the sewer problems that they found on the T.V.
There are three bad spots; one is up by Brick Parkinsons, one on 2nd South
up Harvard is real bad, and the third one is on lst West. The main sewer line
needs to be replaced, it has collasped in places. The one on 1st West has not
collasped, it is just so cracked that it ponds. The two that should be done
immediately is the one from Brick Parkinson's to Harvard and one South on
Harvard. The mayor said after talking to DeLynn and Nile about it we decided
that the city would buy the material and supervise. it and we would hire someone
to dig it up and re-lay it and cover it up. We have put a notice in the paper
calling for bids for 600 feet of sewer and one manhole. DeLynn thinks the one
on lst West, if they keep on flushing it out, it will be okay for a while,
because it is quite a big project. Mayor Porter thought that when we had the
flood the water was on top of the street and eventually it seeped down and
even though the sewer had been there for twenty-five or thirty years, it caused
it to settle in places. As you drive around town every once in a while you
will see a dip where the sewer line is and it has settled.
RE: SEWER DAMAGE CLAIMS
The mayor told the council we had some sewer claims that the insurance company
would not pay for sewer damage. De Lynn had gone through them all and elimated

As the statistics would show, there does not appear to be
a speed problem in that area as indicated by the survey, but
there is considerable traffic as well as numerous pedestrians
frequenting at or near the intersection at various times of the
day. Most of these pedestrians are youngsters living in the imm-
ediate area.
My initial traffic planning for 1st north was to eliminate
any stop signs so that an even flow of traffic would be possible
in allowing citizens to get to their residen~v~in the Ricks-Wade
addition and apartment housing located on 5th west. Currently,
the only stop sign is at the intersection of 5th west and lst north.
But maybe, because of the increased traffic and the amount of chil-
dren in the residential areas along 1st north, it may be feasible
to consider a 4 way stop at 1st north and 3rd west to prevent the
occasional speeder and force most of the traffic back on to the
4 lane highway of west main street.
It should also be noted that the department shows two separate
accidents occurring at the intersection of 1st north and 3rd west,
from the lst of April 1983 through the 1st of April 1984. Both
accidents resulted in considerable vehicle damage, but no injuries.

The following is the results of a traffic survey you requested
on 4-6-84, along with the actual survey sheets. The survey was con-
ducted on West 1st North, west of 2nd west.

Review of this state's Federal-Aid Urban Program indicates that too few
projects are being readied by local government for construction over
.the next two years. This raises concern that federal funds could lapse
or that future appropriations by the Congress might be influenced by
the apparent indifference.
The problem isn't due to the lack of projects. In fact, by the latter
half of the Six-Rear Program, anticipated project costs outweigh the
funds available. The problem is in getting those later projects ready
for construction sooner.
The Idaho Transportation Department intends to improve the situation by
offering to advance the later projects. Based on the concept of first
ready-first served, consideration. will be given even to the extent of
allowing an agency to exceed its allocation, provided uncommitted funds
continue to be available.
If your agency has a sponsored project or projects tentatively
scheduled for construction in Fiscal Year 1986 or later, you should
make every effort to expedite project development. The engineer or
engineers performing the preliminary engineering should be directed to
complete development as soon as possible, as well.

Seventh South, not be widened in order to preserve
the trees and encourage safe driving. We strongly feel that the widening
of the street will encourage speeding, whereas the present speed limit is
25 miles per hour, to protect pedestrian traffic.
The Coliege put center island landscaping on Fourth South to discourage
speeding problems there.
We therefore, petition that this street be limited to preserve our trees
and maintain safety to this area and protect the value of our property.

some of the items, and took 10% depreciation, and then we paid 75% just like the
insurance company had done for Brick Parkinson. On the actual work of cleaning
up and cleaning material we paid full value.
RE: 25~ FEE ON SEWER TO COVER CLAIMS DISCUSSED
Nile Boyle discussed putting a 25~ fee on the sewer to cover this type of sewer
damages, it would bring in $5000 or $6000 a year. We should also set up a plan
on evaluation of % of payment. It was suggested that we set this up at the time
of budget.
RE: PROJECTS FOR SCOUTS
The mayor told the council that from time to time scouts are looking for
projects to earn their Eagle Award. He ask them if they knew of anything
to let him know.

RE: GARY BROCK COMPLAINS ABOUT PRONOGRAPHY BEING SOLD IN REXBURG
Gary Brock was at the meeting, he wanted the city council to be aware that
there were two business in Rexburg that were selling pronography, and R rated and
X rated video movies. Three weeks ago he had gone to Junior High School and
had been in the mens room, there were three young men 13 and 14 years of age
looking at some of the filthist garbage that you could image. They looked over
their shoulders and told him they had bought it at so and so and they could also
buy this type of thing at so and so. They dropped it in the garbage and he
picked it up to show the council. He said he was a concerned parent. He was
in the Marine Core and he saw what pronography could do to good men, they are
never the same. He said it was his understanding that this type of material had
to be behind the counter inaccessible to the minor. These three young boys had this
