Present were the following: Presiding Council President: Councilman: Councilwoman: Also Present: Nile Boyle Sander Larson Morgan Garner Jim Morris Glen Pond Darlene Blackburn Mary Smith, Attorney Rose Bagley, City Clerk Richard Horner, Treas. A motion was made by Jim Morris and seconded by Morgan Garner to approve the minutes. All Aye RE: DAIRY QUEEN TO BE BUILT Boyd Price, representing Price Investments in Idaho Falls, was at.the meeting to propose putting a Dairy Queen on the corner of 2nd North and 2nd East, referring to the minutes from the Planning Board Meeting, he said they had re-done the plans to allow for space for snow removal and highway improvements. They have 36 parking spaces, and approximately a 2500 foot building, with a 30 foot extension for a playgound. He had complied with the requirements made by the Planning Board according to the plans he showed the council. A motion was made by Morgan Garner to approve the plot plan for Dairy Queen. seconded by Darlene Blackburn. All Aye RE: RAY LOVELAND GIVEN PERMISSION TO PUT TRAILER AT 248 WEST 3rd SOUTH Morgan Garner explained to the council that Ray Loveland had bought a trailer located at 248 West 3rd South, which was previously owned by Melvin Muir, who had been given permission to keep i.t there until he died, someone had moved in it after his death. He bought the trailer with the idea of renting it out, but he did not know what the ordinance was. He told Morgan he had planned on moving the trailer within one years time, or sooner, and he would move it out into Stones Trailer Court as soon as there was an available spot. A motion was made by Morgan Garner to give permission to leave the trailer there for one year with the stipulation that it be moved at that time. Seconded by Sander Larson. All Aye Spence Larson of Troup 218 of the 18th Ward was at the meeting with his scout troup. RE: RETIREMENT HOME APPROVED Nile Boyle referred to the Retirement Home that was discussed at Planning & Zoning, that Terry Bagley wants to build. He has room to qualify for the parking, but it is his opinion that those older people that will live there are not going to have cars like other apartments. He would like to use less parking and more landscaping to make it look better. We don't have anything in our ordinances that talks about a retirement home. The need there would be a little different. A motion was made by Morgan Garner to grant permission to have 49 parking places instead of regulation parking on the same stipulations as the Planning and Zoning recommended. Seconded by Jim Morris. All Aye. J. D. Hancock of Troup 305 of the 5th Ward brought his scout troup to the meeting. RE: J. D. HANCOCK REQUESTES A VARIANCE TO BUILD TWO FOUR PLEX J. D. Hancock was at the meeting to request a variance to build two four-plex apartments on West 2nd South. He stated that there was apartments across the street, and that Reed Wyatt had built a 6 plex to the East. Mr. Wyatt had got a permit for a 4 plex and built a 6 plex which did not comply with the zoning ordinance. The council felt it should be checked into. Mr. Hancock is short 907 square feet of having enough property to meet the requirements to build two four-plex apartments in the R2 zone. He is trying to buy the Whittle property at the back of his property, and if he gets that property he would have more than enough property, he would need a variance for that. He requested a variance to build within 10 feet of his back property line, instead of the 20 feet required in the zoning ordinance. The Planning Board recommended that he be given a variance. A motion was made by Sander Larson to support the decision of the Planning and Zoning and recommend granting a variance contingent of a Public Hearing. Seconded by Darlene Blackburn. All Aye. Mary Smith told him the Public Hearing would be at the 1st council in May. RE: NEW SWEEPER APPROVED TO BE PURCHASED A motion was made by Morgan Garner that the city purchase a FMC, 3 wheel type Street Sweeper model "Vanguard 3000" from Arrowhead Machinery Company for $61,000. It will be purchased on a lease purchase with the down payment being $17,000, the balance will be paid in three equal payments in 1985, 1986, and 1987, the interest rate being 9%. The First National Bank will be the financing entity. Seconded by Jim Morris. All Aye RE: NILE BOYLE AUTHORIZED TO SIGN ALL LEASE DOCUMENTS A motion was made by Morgan Garner to authorize Nile Boyle to sign all lease documents on the sweeper. Seconded by Jim Morris. All Aye RE: SUB-DIVISION ORDINANCE DISCUSSED The new sub-divion ordinance was discussed. Mary Smith said she had studied it and there was one or two changes she would like to suggest. One was it talks about the fees but not the fee schedule. She would suggest that it be worded that the council be authorized to set the fees by resolution. Mary said she would get with Chuck Frost, Chairman of Planning & Zoning and make the necessary changes. It was recommended by the council that it be turned back to the Planning and Zoning for them to hold a public hearing and after that the City Council would hold a public hearing. RE: REQUEST FOR A FOUR-WAY STOP ON THIRD WEST AND FIRST NORTH Sander Larson and Morgan Garner had received a petition requesting a four-way stop on Third West and First North. The matter will be turned over to the police to sudy and report back. RE: WATER & SEWER COMMETTEE TO MEET Nile Boyle asked the Water & Sewer Committee if they could meet next week. They have televised the sewer lines again and want us to look at them. The meeting will be held next Monday or Tuesday. RE: DRAINAGE PROBLEM BY RAILROAD CROSSING BY BESTWAY BUILDING CENTER Nile Boyle discussed the problem of the water not draining by the Railroad Crossing on the corner by Bestway Building Center. He wondered if it was the city's problem or the Railroads. Morgan Garner said he would check on it. RE: RAISING PLUMBING INSPECTION FEES DISCUSSED Nile Boyle told the council that six months ago we adoped the State Plumbing Code. On December 1, 1983 they raised their fees for all plumbing inspections. De Lynn Edstrom feels since we adopted the code we should raise our fees the same as the State. It wouldn't make much difference but it would make it uniform. The one area that would be quite different would be the Kennedy School. In the past we have done it real cheap for schools, hospitals, and churchs, it would raise their fees. Mary Smith told them she would check the ordinance. The council agreed that we should raise our fees the same as the State contingent on the ordiance. RE: MEEING WITH FEDERAL EMERGENCY MANAGEMENT AGENCY 1 Nile Boyle told the council that on April 9, 1984, at 10:00 A.M. there would be a meeting with the Federal Emergency Management Agency about the National Flood Insurance Program. This would be held with the county at the courthouse. ~: They would like the Public Works Director, Building Inspector, the Engineer, and a councilman to be there. Jim Morris said he would go to the meeting. A motion was made by Jim Morris and seconded by Sander Larson to pay the bills. All Aye. Present were the following: Mayor: John C. Porter Councilman: Morgan Garner Jim Morris Glen Pond Nile Boyle Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by Nile Boyle and seconded by Glen Pond to approve the. minutes. All Aye RE: VICTOR MENDOZA REQUESTS TO HOOK ONTO THE SEWER Mayor Porter told the council that Victor Mendoza had come in the office. He lives out by Amercian Potato, in the small area that is not in the city limits. There are two or three trailer houses on .the property. Mr. Mendoza would like to hook on the sewer line that goPS between Rexburg and Sugar City. We charge a fee to hook onto that line of $1000 and then he will have to run his own line over there. He would like to make arrangements so he can pay the $1000 off in six or eight months, what ever we decide to let him do. The mayor said if he owns the property we would have no problem, or we could put a lean on the trailer, or if he doesn't pay we can shut it off. If some of the other people in trailers out there could share the cost, it would make it better. It will cost him about $1200 to run the line. He works for Warren Walters. The mayor said Mary Smith and Richard could work out the agreement. RE: OPPOSITION TO PROPOSED. PLAN TO WIDEN SECOND EAST Dan and Mary Hess, and Randall Porter were at the meeting representing the property owners living along Second East from 4th South to 1st South. They presented a petition in opposition to the proposed plan to widen that street. Randall Porter said they have a couple of concerns. The homes that are built along the street did not anticipate that the road would be widened to a 4 land road. That would put the road in some cases, only 15' or 20' away from your front door. I would become a dangerous thing and also would reduce .the value of the property. It would destroy the scenic value of the property because they would have to take out approximately 30 or 40 trees that arrange from approximately 25 to 40 years old. That would have a tendency to do two things: it would increase the noise along the street and also reduce the value of the property. They would like the City Council and the Planning and Zoning to consider some other alternatives. One way would be to possibly divert the traffic upwards to 7th South and run it across the hill for the property owners that live east of 2nd East. ,~ s March 5, 1984 To the Rexbur4 City Council Attention: Mr. Morgan f;arner Mr. Sander .Larson Gentlemen: Because of several recent accidents, poor visibility (particularly in winter), and the number of children crossing these streets we respectfully request that the intersection of Third West and First North Streets be made a four- way stop. Another reason for this request is that the east-west traffic sometimes travels at excessive speeds.
