further debt. Glen Pond questioned if we would be able to use the footings
and floor at the old building. Mayor Porter said before we start to build
we will test it. The engineers that the insurance company used assured us
that it was okay, we did have others that said we couldn't. Morgan Garner
said at the hearing that Dick Davis and Charles Zollinger both had said we
could use them. Sander Larson told the council as the committee listened
to what people said, the people were concerned about accessability and tra-
ffic at the building we now occupy. In visiting with the police department,
they are looking at the possibility of making it no parking along in front
of this building to go along with what they have done all the way down the
street. That would make accessability in and out a little bit awkard, as
this street down here would take extra traffic there will be more traffic
coming off this street in a few years. There were many who thought they
would enjoy the features of a little less traffic at the location. A motion
was made by Jim Morris and seconded by Darlene Blackburn to adopt the re-
commendation made by the committee to rebuild on the old location. Clinton
Parkinson ask if he could say something before the motion was voted on. He
wanted to sell the Econo-Mart building to the city. He thought the city
should consider a bigger building, better parking, more square footage and
room for expansion which the Econo-Mart building would offer. Sander Larson
said of all the people he had spoken to there wasn't any that wanted to go
to that location. Mayor Porter said if we did buy that building it would
have to be brought up to code.
RE: MOTION MADE ON NEW CITY HALL LOCATION
Mayor Porter told the council that the motion had been made and was now
before the council for a vote. Those voting aye: Darlene Blackburn,
Jim Morris, Sander Larson, Morgan Garner. Abstaining: Glen Pond. Motion
carried.
Mayor Porter told Clinton Parkinson if the new building cost more than we
have money for then we might be talking to him.
Mayor Porter told the council after he had gotten the letter from the co-
mmittee he had sent out letters to four architecture firms and ask them to
submit a resume and has told them we would go over the propossals and select
three of them and have a persc,nal interview. Because there were only Tour
anyway, the mayor thought we could interview all of them. It was decided
to meet on Wednesday, February 8 at 7:00 pm for the interviews.
A motion was made by Glen Pond and seconded by Sander Larson to approve the
bills. All Aye.

A motion was made by Sander Larson and seconded by Glen Pond to approve
the minutes. All Aye.
RE: TOM WINGER ARGUES GARBAGE CHARGES
Tom Winger of Farmers Insurance was at the council. He felt that he should not
be charged for garbage, because in the four years they have been there they
have not had any garbage collected, he always put it in a plastic bag and
takes it home to put in his fireplace. Mayor Porter told him that we have
an ordinance that states that garbage is mandatory, everyone has to pay
for the service whether they have any garbage or not they have to pay it.
He said he did not understand that there was an ordinance. Mr. Winger
complained that Circle K always had garbage scattered all over. Since his
business was next to it he often picked up their garbage. The mayor said
the city would contact them. Sander Larson suggested that the city write
them a letter telling them to keep the garbage cleaned up.
RE: OBSTRUCTING STREETS WITH SNOW
Mayor Porter told the council that Farrell Davidson and Morgan Garner had
gone out that morning checking the places that people have pushed the snow
out into the streets after the snow plow had cleaned the streets. Morgan
Garner told the council there were a lot of places where people had done
this and it had made a mess. Mayor Porter said we do have an ordinance
that we can arrest people for doing that. Mary found the ordinance.
Ordinance 5--ANY PERSON OF PERSONS WHO OBSTRUCTS, INJURES ANY OF THE STREETS
OR ALLEYS OF THE CITY OF REXBURG EITHER BY PLACING OBSTRUCTION THEREON OR
BY DIGGING IN OR BY ANY STREET can be taken to court.
RE: PEOPLE REPAIRING THEIR OWN WATER. METERS
The mayor said we have had some people who take it upon themselves to re-
pair their water meters, and then they break them. Mary checked our ord-
inances and found Ordinance 316--WHERE PRACTICABLE METERS SHALL BE PLACED
IN OR IMMEDIATELY NEXT TO THE LINE DIVIDING THE PRIVATE PROPERTY FROM THE
PUBLIC STREET, AND EVERYONE HAS TO HAVE A METER. THE SUPERINTENDENT OF
WATERWORKS OR HIS ASSISTANTS SHALL CONSTITUTE SUFFICIENT CAUSE FOR SHUTTING
OFF THE WATER FROM SUCH PROPERTY AND BUILDING, AND IT SHALL BE THE DUTY
OF THE SUPERINTENDENT OF WATERWORKS IN ANY SUCH CASE TO IMMIDIATELY SHUT
OFF SUCH WATER. IT SHALL BE UNLAWFUL FOR ANY PERSON EXCEPT THE SUPERINT-
ENDENT OF WATERWORKS, OR HIS ASSISTANT TO REMOVE, DISCONNECT OR IN ANY ~'
MANNER DISTURB OR BREAK THE SEAL OF ANY WATER METER INSTALLED IN, OR
CONNECTED WITH THE CITY WATERWORKS SYSTEM. The mayor said if anyone dam-
ages the meters so they cannot be used that means it is a misdemeanor.
PROVIDED IN ANY METER LOCATED IN A BASEMENT OR CELLAR IS INJURED BY FRE-
EZING OR OTHER CAUSE SAME MAY BE REMOVED BY ANY LISENCED PLUMBER, WITH
CONSENT OF THE SUPERINTENDENT OF WATERWORKS FIRST OBTAINED. So if anyone
does anything to the water meter they have to first get permission from
the city.
RE: CALL AND REED PRESENT THE AUDIT
Joe Call and Brad Reed representing Rudd, DaBell, Hill & Call were present
to present the audit. (copy on file at office). A motion was made by
Morgan Garner and seconded by Sander Larson to except the audit. All Aye.
RE: FLOODING PROBLEMS AT OLD CITY HALL CITE
Mayor Porter said he met with the architect Monday morning, and they had
agreed on a fee of 7%. Glen Pond ask the mayor if the architect was aware
of the flooding problem in the building. The mayor said they are aware of
it. The problem at the front door is the drainage from the alley to Main
Street, and he didn't think there would be anything we could do to the
building, because there is quite a slope from the curb up to where the door
was; the trouble is that even at Block's it runs in the door because we
have got to do something about that drainage. On the back of the building
we will correct it, we will put the street back down where it was. The
big flooding was from the roof. The mayor said he had Forsgren Perkins
go over and they shot all the corners and several places in the floor to
see if everything is level and to see how high it is from the curb and also
at the back. The architect wanted to know so he would know what to do.
The mayor had told the architect we wanted to go to bid the 1st of April
or sooner.
The architects were here most of the morning measuring all the desks and
office equipment and talking to Richard and Rose and talked to ECIPDA, he
will come back with a preliminary sketch. They were going to design the
building with a drop box in the alley instead of a drive-in window.

RE: NEW GARBAGE TRUCK BIDS
Mayor Porter told the council they had a bid opening for the new garbage
truck and compactor. A copy of the bids was in the packets for the council
(copy attached). The mayor suggested that the low bid with trade is $15,499.
and the low bid without trade is $17,368. if you take the one for $17,368
you could keep the whole outfit that we have and are using at $1869. The
mayor had told Farrell he would have to go over the specifacation of the
truck chassie to see if it met the specs. It appears that the bid from
Tri County Equipment for $32,000 would be the low bid for the specs. A
motion was made by Nile Boyle to except the bid on the compactor without
trade from .Wes tern Road Machinery seconded by Jim Morris. All Aye.
A motion was made by Nile Boyle that after review of the specifications
of the truck we expect the low bid. All Aye.
RE: RICKS COLLEGE FLAG COMMITTEE TO PRESENT NEW FLAG TO CITY
Mayor Porter said on Friday morning a new Flag Committee at Ricks College
have a flag they want to present to the City of Rexburg but he would not
be here. Sander Larson and Morgan Garner said they would be there to
accept the flag.
The mayor told the council we had recieved $26,536. from the Utah Power
and Light for Franchise Tax.
A motion was made by Jim Morris and seconded by Glen Pond to pay the
bills. All Aye.
A motion was made by Morgan Garner and seconded by Jim Morris to adjourn.

Mayor Porter told the council the opening of the bids for the new sweeper had been
that afternood, and he read the bids.
