A special meeting of the City Council for the City of Rexburg, Madison County,
held November 9, 1983, at the City Hall.
Present were the following: Mayor: John C. Porter
Councilman: Jim Morris
Morgan Garner

Also Present: Rose Bagley, City Clerk
Playor Porter told the council the purpose of the meeting was to canvas the votes.

Mayor Porter read the vote totals from each precinct and checked the totals. There
was an error in the addition for the total of votes in Precinct #4, vote total for
Sander L. Larson was 154, correct total was 164; vote total for James A. Terry
was 72, correct total was 67; making the total votes for Sander L. Larson 466 instead
of 456, and making the total votes for James A. Terry 141 instead of 146.
A motion was made by Jim Morris and seconded by Morgan Garner to accept the Canvas
of the votes as corrected. All Aye.
RE: BARRICK TRAILER
Morgan Garner discussed with the council the Barrick trailer. The Trailer Committee
had met and they said it was in a commercial zone, and because of the circumstances
the committee felt that we should give them a variance to leave the trailer there
until July 1, 1984. Mayor Porter said another thing in the ordinance says that in a
commercial area, they are allowed to put a trailer there for the caretaker. A motion
was made by Sander Larson and seconded by Nile Boyle to let them leave the trailer
there until July 1, 1984 with the understanding that they move it by July 1, 1984, and
it will be the understanding of the city council that they will relocate the trailer
at that time and will not come back to the city council and request to leave it there.

Sander Larson also said that it should be the understanding that if it becomes too
much of a burden, then we would recommend that they not put it in at all, and locate
it at a more permanent setting. It is our understanding as a city council that it
will be moved at the set time. They need to have the understanding that the variance
will not be extended. The council instructed Rose Bagley to have Mary Smith write
a letter to the Barricks. The council also said they should be charged double for
the building permit, because they had moved the trailer in before they got the permit.
RE: INSURANCE
Nile Boyle asked about the insurance. The mayor said the adjustors are talking
about cutting the amount they had agreed to pay us down. He said he thought we needed
to get someone to help us. W e need someone to represent us that knows what they are
doing. Sander Larson asked if there was someone in Idaho that did this same
thing as the people in Seattle. Mayor Porter said these people do a good job and would
charge only $5000. They would like to do this for a government indemnity. The
Council told the Mayor to tell them we are leaning that way and will make a
decision next week at our regular council meeting. The council said they did
not want Archibald Insurance to get hurt.

RE: APPROVAL OF MINUTES
A motion was made be by Darlene Blackburn and seconded by Jim Morris to approve the
minutes. All Aye.
RE: UNIFORM PLUMBING CODE
Mayro Porter reported that last Thursday night the water and sewer committee and the
plumbers in the area had a meeting. One of the things they ..suggested is that we
except the Uniform Plumbing Code as we have already adopted it for 1982 with no
additions as we have had. Besides the plumbing code, we have had some things the
council has approved by resolution that we should do, such as the 3" vent. He said
it was the opinion of the committee, the mayor, Nile Boyle, and Glen Pond, to
present tonight that we except the code and forget the additional regulations that
we have had in the past. DeLynn was at the meeting and he felt we should follow
the state code as it was outlined. A motion was made by Jim Morris and
seconded by Glen Pond that we go entirely by the 1982 Uniform Plumbing Code
with no additions that the City itself imposes. All Aye.
RE: APPRENTICE ON JOB
Mayor Porter said that code also prescribes that whenever there is an apprentice
working on the job he has to be supervised by a licensed plumber at all times.
That also solves the problem brought up last week at the meeting by Marlin Hill.
There was one other thing they discussed. Ralph Thompson, who is the plumbing
inspector, his contractors license is being used by Thompson Plumbing and Heating.
The mayor said he had not had a chance to check with the state to see if that is
in violation. In the meantime, Mr. Thompson came in and suggested that as of the.
first of the year he planned on resigning anyway. The mayor had talked to DeLynn
Edstrom to have him take over the inspection at that time.

Please find a report of a recent inspection made by representatives of our
department on your Land & Water Conservation Fund project. We commend you on
achievements made in your facilities. However, sometimes the local project.
sponsors overlook some important matters and periodic inspections can correct
or prevent serious problems.
One situation you should be especially aware of is conversion of
use. Land & Water Conservation Fund projects may not be converted to
any non-recreation use without prior approval of the Secretary of
Interior. Conversions of use include: property interests conveyed
for non-public outdoor recreation uses; non-outdoor recreation uses
(public or private) are made of the project area or a portion
thereof, such as installation of overhead powerlines, a water tower,
or street; non-eligible indoor facilities are developed within the
project area; or public outdoor recreation use of property acquired
or developed with fund assistance is terminated. To avoid problems,
contact me before any of the above situations occur on your project.

conform, please notify me.
