a different kind of construction, the insurance company would negtotiate. He said
no matter which way they went, they should explore it with the insurance company
before they started. They would like whoever did the demolition to be careful with
the floor. There would be no stipulation on it if it would have to be built on the
same property, or the same plan. Mary Smith told the council if we sell that
City Property or trade property, we would have to pass an ordinance. The council
decided to get some opinions from professional people that are in that business
as to the cost to rebuild, then the committee would study the proposal and come
up with a recommendation.
RE: APPROVAL OF BILLS
A motion was made by Nile Boyle and seconded by Sander Larson to approve
the bills. All Aye.
RE: ADJOURNMENT
A motion was made by Darlene Blackburn and seconded by Morgan Garner to adjourn.

November 2, 1983, at the City Hall.

A motion was made by Glen Pond and seconded by Darlene Blackburn to approve

RE: VISITORS AT THE MEETING
Members from a Ricks College journalism class were at the meeting.
RE: MOBILE HOME REQUEST
Jerome and John Barrick were at the meeting to request putting a mobile home at
249 South 5th West. Jerome told the council that his son,., John, had bought
a mobile home. They had talked t~o Reese Realty and checked a map, and they
told them they could put it on our property on South 5th West, but they had
failed to check with the city for a permit. He had hired a plumber to dig the
water and sewer line and an electrician to hook up the electricity. W e got
it all set up and a city water department employee came down and said we couldn't
put the trailer there. Mr. Barrick said he was shocked. He said he guessed he
should have come to the~city first. He had gone to alot of expense to dig the
water and sewer line. He wondered what their chances were to leave the mobile
home there. He said they were supposed to be in a commercial area, and he had
seen alot of mobile homes around the city. He said he had heard there was an ordinance
against a mobile home there, and he didn't think there was because his father has a
mobile home there. The mayor said that for the last year we have had a series of
hearings and meetings with people with mobile homes, and with the exception of
those senior citizens, we have given them all notice to move them out. Jerome
said he knew of some trailers that were around town and wondered why. Morgan

Garner said the trailer board had met with all the trailer owners and reviewed each
case individually, and gave them some things they had to do. He gave notice to the
people that needed to move the trailers., There are still a few we have to take
action on. Mayor Porter told him we have put a stop to trailers moving into the
city. The ones that have been here since the flood have caused the problem, and
now we are trying to get them out. Double wide trailers can be on a permanent
foundation because they are called a moduler home. Jerome said that the trailer
improved the looks of the property. Mayor Porter told him when you move a
trailer in the city, you are supposed to get permits and should have done it.
He told him his father had come into City Hall and asked to get the water turned
off and the meter taken out. The mayor told him before any action can be taken,
we would have to call a special meeting and take it before the trailer committee.
Morgan Garner told him they would call a meeting as soon as possible.
RE: STATE PLUMBING CODE
Mayor Porter told the council that when Norris Reese was on the council the city
met with the plumbers and agreed that we would go by the State Plumbing Code with
the exception that there would be one vent in the house that would have to be a
3" vent. The uniform building code says that that is up to the discretion of the
governing board which is the council. After that meeting, those are the rules
we set up. One plumber in town now says he is going by the Idaho Code which says
only a 2" vent, all other plumbers are complying. The mayor had told the plumbing
inspector the only thing to do is to red tag it, and he would bring it up to the
council. He suggested to Nile Boyle, the councilman over the Water & Sewer
Department, to call a meeting of his committee and the call all the plumbers go
over it.
RE: BUILDING PERMITS
Mayor Porter reviewed the building permits of $587,950 for the month of October.
RE: DENNIS HUFFMAN-WATER & SEWER LINE
Nile Boyle discussed a problem that Dennis Huffman had. He is building some
apartments on North 5th West. He purchased a lot on 5th West.. A few years ago,
H & K installed a storm drain for the City in front of the property. At that time
we didn't think much about whether or not they had replaced the water and sewer
line. When he had started to build the apratments, he had called the city to have
the line located, and they could not find the lines. The lot was vancant, and so
they had not replaced the line. He was concerned if we would charge him the price of
another hook up. It was not Mr. Huffman's fault that it wasn't connected. A
motion was made by Nile Boyle and seconded by Morgan Garner to forego the hook up
fee for the water and sewer. He would have to pay for everything except the
hook up fee. All Aye.
RE: COMPLAINTS CONCERNING PLUMBING INSPECTOR
Marlin Hill was at the meeting. He gave a letter to the Mayor and the Council
(copy attached) complaining about the Plumbing Inspector, that he is owner and
operator of a local plumbing business in Rexburg and that it is in direct conflict
of interest, and that he has solicited work for his own company while performing
his duties as an inspector. He said he could not work with Ralph. He is so
concerned with the letter of the law that he does not realize that we all have to work
together. He said he is doing the Crandall & W orkman medical office. He is a
contractor, journeyman plumber, and he spends most of his time on the job
plumbing with his brother, Bryce. He did leave Bryce by himself part of the time,
and Ralph Thompson came up and told the contractor he did not want Bryce working
without a journeyman plumber. Mr. Hill accused Ralph Thompson of soliciting work
for Thompson Plumbing while doing inspecting. One apartment owner had told him that
Ralph had told him he could not do the plumbing on his apartment house, but he
could get Thompson Plumbing to do it. He said he could not work with Ralph and
would not have him inspecting his jobs anymore. Mayor Porter told him that you
could not do the plumbing in an apartment unless you are a licensed plumber.
P1ayor Porter told Mr. Hill that the city had had problems with him before. He had
brought up the same thing when we had Jerry Brian working for the city. l~1r. Hill
said he felt that he had been pushed around ,and he didn't like it. Mayor Porter
told him they would have a meeting with all theplumbers and discuss the problem.
Mr. Hill asked what they were going to do in the meantime. The mayor said we
would not do anything until thee;meeting. Sander Larson told him to write down
all the allegations, times, dates, parties involved, etc. so it is in
writing so we can take it from there with the inppector. It will then be taken
up with the committee.
RE: BLOCK GRANT
Mayor Porter said we submitted another application to get a Block Grant to enlarge the
sewer line.
RE: BUDGET FOR PICKUP
Mayor Porter told the council that DeLynn had budgeted for another pickup. He had
received three bids on a small sized pickup.

The mayor said they would award the bid to the low bidder if it was okay with the
council. It was okayed by the council.
RE: BUILDING NEW CITY HALL
The council discussed various locations for building the new City Hall. An architect
from Bryon L. Blakley & Assoc. was at the meeting to show plans and a picture for
the lot of Ed Covingtons across from the library. The~lot is 5840 square feet. They
discussed the lot adjacent to Carters. W e own the back of the Carter property.
Estimate cost $300,000 for landscaping, building, and lot. The building would be
$275,000. They discussed several lots and the old city hall building spot.
RE: GARBAGE INCINERATOR
Mayor Porter said he had a call from a fellow in Minnesota. His office is in New
Jersey there in the garbage incineration. They use the steam from the incinerator
to make powdered milk. In this area we have a lot of creameries that have to
dispose with whey. They would like to set up a meeting with the City and the County
and maybe include St. Anthony and Rigby, and the creameries. They think they can come
in and build a garbage incinerator and make powdered milk for calf starter and also
create electricity which they will sell to Utah Power & Light. All they want to do
is come in and study and get us to agree to let them haul our garbage. They will build
the plant. He said he would go to the county commissioner meeting and see what they
have to say. The mayor said he would call and tell them we are interested.
RE: INSURANCE ADJUSTORS
The mayor said he had not heard anything from the insurance people since we had
met with them last. Larry Thompson had called him and said a plumbing firm in
Idaho Falls had called him to get some information on the plumbing because they
were making an estimate on the loss. She thought the adjustors were making a
readjustment on the loss. In the meantime, he had had a call from the adjustors
in Seattle. They would come in on the policy holders side. If we wanted .them to
come down the down, they would do it for $5000. He told them he would have to
see where we were getting with the others.
RE: DEMOLITION OF OLD BUILDING
The mayor said they are demolishing the old building, They have the walls down, but
don't have it cleaned up yet.
RE: TROUBLE WITH TELEMETERING
Mayor Porter told the council that we are having trouble with the telemetering again.
They would have a meeting on Monday with the engineers and check it all out.
RE: OLD HOUSE
Mayor Porter said we are still having trouble with the people that we have been trying
to tear down their old house. They still have taken no action. Mary is getting the
papers ready to condemn the building, and she needs the authority. A motion was
made by Nile Boyle and seconded by Darlene Blackburn to give Mary the authority to
go ahead and condemn the building. All Aye.
RE: RECREATION DIRECTOR
Jim Morris said he had several applications for Recreation Director. He would turn it
over to the personnel committee.
RE: PAY BILLS
A motion was mady by Sander Larson and seconded by Morgan Garner to pay the bills.

RE: ADJOURNMENT
A motion was made by Nile Boyle and seconded by Jim Plorris to adjourn. All Aye.

Mayor Porter read the vote totals from each precinct and checked the totals. There
was an error in the addition for the total of votes in Precinct #4, vote total for
Sander L. Larson was 154, correct total was 164; vote total for James A. Terry
was 72, correct total was 67; making the total votes for Sander L. Larson 466 instead
of 456, and making the total votes for James A. Terry 141 instead of 146.
A motion was made by Jim Morris and seconded by Morgan Garner to accept the Canvas
of the votes as corrected. All Aye.
RE: BARRICK TRAILER
h1organ Garner discussed with the council the Barrick trailer. The Trailer Committee
had met and they said it was in a commercial zone, and because of the circumstances
the committee felt that we should give them a variance to leave the trailer there
until July 1, 1984. Mayor Porter said another thing in the ordinance says that in a
commercial area, they are allowed to put a trailer there for the caretaker. A motion
was made by Sander Larson and seconded by Nile Boyle to let them leave the trailer
there until July 1, 1984 with the understanding that they move it by July 1, 1984, and
it will be the understanding of the city council that they will relocate the trailer
at that time and will not come back to the city council and request to leave it there.

Sander Larson also said that it should be the understanding that if it becomes too-.
much of a burden, then we would recommend that they not put it in at all, and locate
