Present were the following: Mayor: John C. Porter RE: APPROVAL OF MINUTES Councilman: Glen Pond Jim Morris Morgan Garner Nile Boyle Sander Larson Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer A motion was made by Morgan Garner and seconded by Glen Pond to approve the minutes. All Aye. RE: WORK BY TIGER ASPHALT Mayor Porter asked the council to review a letter that was in the packet from Forsgren Perkins, it was to Mayor Porter and to Chuck Frost. It was a copy of the punch list for the work which needs to be done by Tiger Asphalt under the 1983 Rexburg Street Project. This work would have to be done before a final settlement would be made to Tiger Asphalt. Nile Boyle asked .the mayor if he thought the over-all job was good. The engineers thought it was okay except for those things on the punch list. He asked the council to keep it and we will check the things off as they do them. John Millar and Farrell had gone around town and checked the project and come up the punch line. (copy attached) RE: WATER AGREEMENT WITH RICKS COLLEGE Mayor Porter asked the council to look over and read the Water Agreement with Ricks College. The mayor had given a copy to Chuck Frost and Rex Bennion, they had okayed it and signed it. A motion was made by Nile Boyle and seconded by Jim Morris to approve the agreement and authorize Mayor Porter to sign it. All Aye. (copy attached) RE: LOSS FOR CITY BUILDING The mayor reviewed with the council the statement of less for the city building which he had received from the insurance adjustors. (copy attached) Replacement value is $2,978,118. We had a 90% blanket insurance which has $2,680.306. The problem we had was the Historical Society has part of the insurance on the Tabernacle and we only have insurance for replacement we did after the flood. For replacement on the loss of the building they figured $221,184. They don't replace carpet and deducted $5,742 for that. They depreciated the building over 8 years because it was rebuilt after the flood, it is $29,653; contents were $6,842.19. If we agree, they will give us $186,054.40. If we re-build or buy and remodel and spend mAre, we can get another $28,815.47, but we get $186,054.40 regardless. The mayor said he felt good about it until he got a call from an appraisers firm that hires out on these type of things. They would come in and go over it and see if we have been given a fair appraisal, and possibly they can get us more money. He suggested that the mayor call the American Land Title down in Pocatello that had a fire and. see how they helped them. He had not been able to get in touch with him, but had talked to the man in Rexburg, who said they had done a good job for them. The mayor had talked to John Watson, the architect, and he thinks the figure is too low. He and Richard have sent all the paperwork and a copy of the policy to Seattle to the Appraisal firm who would look over it with no charge and tell us what they think of it. He would check further tomorrow. RE: POLICY TO PAY RENT Jim Morris asked Lynn Archibald if there was a clause in the policy that would cover the rent we had to pay until we could reconstruct the building. He told him there was not. The council asked if we build a building and go to a second layer, how far does the money go for replacement costs. Lynn Archibald said they would put us back as we were with the same construction as before. If the city uses a different kind of construction, the insurance company would negtotiate. He said no matter which way they went, they should explore it with the insurance company before they started. They would like whoever did the demolition to be careful with the floor. There would be no stipulation on it if it would have to be built on the same property, or the same plan. Mary Smith told the council if we sell that City Property or trade property, we would have to pass an ordinance. The council decided to get some opinions from professional people that are in that business as to the cost to rebuild, then the committee would study the proposal and come up with a recommendation. RE: APPROVAL OF BILLS A motion was made by Nile Boyle and seconded by Sander Larson to approve the bills. All Aye. Present were the following: Mayor: John C. Porter Councilman: Glen Pond Nile Boyle Sander Larson Morgan Garner Jim P1orris Councilwoman: Darlene Blackburn RE: APPROVAL OF MINUTES A motion was made by Glen Pond and seconded by Darlene Blackburn to approve the minutes. All Aye.: RE: VISITORS AT THE MEETING Members from a Ricks College journalism class were at the meeting. RE: MOBILE HOME REQUEST Jerome and John Barrick were at the meeting to request putting a mobile home at 249 South 5th West. Jerome told the council that his son,, John, had bought a mobile home. They had talked t~o Reese Realty and checked a map, and they told them they could put it on our property on South 5th West, but they had failed to check with the city for a permit. He had hired a plumber to dig the water and sewer line and an electrician to hook up the electricity. W e got it all set up and a city water department employee came down and said we couldn't put the trailer there. Mr. Barrick said he was shocked. He said he guessed he should have come to the~city first. He had gone to alot of expense to dig the water and sewer line. He wondered what their chances were to leave the mobile home there. He said they were supposed to be in a commercial area, and he had seen alot of mobile homes around the city. He said he had heard there was an ordinance against a mobile home there, and he didn't think there was because his father has a mobile home there. The mayor said that for the last year we have had a series of hearings and meetings with people with mobile homes, and with the exception of those senior citizens, we have given them all notice to move them out. Jerome said he knew of some trailers that were around town and wondered why. Morgan
