Ardyth Carlson said she didn't think it would be as bad as having more student
housing.
Mayor Porter said if these people have had an offer to sell the property for a home
and have been holding it thinking they are going to change it to commercial and get
more money for it, in view of that he felt the council will have to consider that.
Seth Wood said he was sure the Credit Union would grow and th~:re would be increased
traffic to it, and there should be plenty of locations for businesses.
Mayor Porter told Mr. Wood that they co~~ld not. take any action. at the meeting today,
the council will have to do it at an official council meeting. The reason for this
meeting is to ge'~ Mr. Wood's feelings.
Mrs. Carlson said it is a conservative business, and seems like an ideal spot.
Morgan Garner said he thought Seth Wood needed some time to consider it and talk
to his family and he needed to feel good about it.
Mayor Porter said he felt that Seth Wood did not want the Credit Union there, he
felt that there is 1500 members now, but it will grow every year. While there are
only 8 or 9 people an hour now maybe there will be more in a few years. Another
thing is it sounds like they are holding it for a higher price hoping it will be
changed to commercial, and possibly we have that problem all over the city. Jim
Morris said maybe if we turn some of the requests down for zone changes to commercial,
the Real Estate offices would realize that we were not going to change the zones
on the property they want to sell.
RE: BUILDING PERMIT
Mayor Porter said we have another problem. Ken Benfield has applied for a building
permit with the county for a barn. He thought he would get Mary to get a temporary
court injuction to stop it until we can get an opinion from the Attorney General.
He said he would discuss it with Mary. He is also building a bike track up there
which the neighbors think distracts from the residential area.

A meeting of the City Council for the City of Rexburg, Madison County, held
September 7, 1983, at the City Hall.

Rose Bagley, City Clerk
Richard Horner, Treasurer
RE: APPROVE MINUTES
A motion was made by Sander Larson and seconded by Glen Pond to approve the minutes.
All Aye.
RE: DR. M.F. RIGBY
Nile Boyle reported that Dr. M.F. Rigby died, he had done a lot of service to the
city for a lot of years, and had served on the City Council from 1943 to 1949.
RE: LIGHTING AT RAINBOW PARK
Sander Larson said he had received a letter from Mohr Enterprises. They said
it had come to their attention the reason that many lady students attending Ricks
College don't live at Rainbow Park, 42 South 1st West, is the street lighting from

the entrance to Rainbow Park to Ricks College Campus is inadequate. There are no
street lights from Main Street to 1st South, and from 1st South to 2nd South there
are three lights. Sander said he checked it out and it is correct. Many of the
girls that were going to live at Rainbow Park were discouraged by their parents
because of the poor lighting. They also indicate that some of the girls work
early in the morning and have to go to work at the college at 4:30 a.m. and it
is pretty dark. The council felt that it would be well to put a light at least in
the middle of the block which would be about adjacent to the entry way of Rainbow
Park. Nile Boyle told Sander Larson to talk to Jim Morris and have him check this
out.
RE: ALLEY BEHIND STEVE TERRY'S HOME
Sander Larson said he had received a letter from Steve Terry about the alley
behind his home. Sander said he was not here at the meeting, but in the
minutes there were some alternatives and he wondered if they had been done. Nile
Boyle said there were a lot of people that were against closing the alley.
The garbage had been discontinued in the alley. Rose Bagley was instructed to
talk to Farrell Davidson about following through with the speed bumps and grading
and signing it as a one-way alley.
RE: STREET PAVING
Nile Boyle reported on the street paving. He said the paving was finished on
4th South except they needed to raise the man holes. They will do the railroad
crossings and the rest of the paving next Wednesday. Sander Larson said by the
railroad crossing on 2nd South and by the Woodshed Apartments .there is a square
spot that has never been paved, it is part of the street. Morgan Garner said he
would check that out. Nile Boyle said Farrell Davidson was going to check with
the people in the alley behind Coast to Coast and see if they wanted to pay
half on the paving.
RE: PARKING SPACES
Nile Boyle read a letter from Bishop Alyn Andrus of the Bishopric of the 4th
and 15th Ward allowing Linda Eames to use five spaces of parking for her
child care center. That was the only thing that the Planning & Zoning specified
that she have enough parking. (copy attached) These parking spaces would give
her the required amount of spaces she needed.
RE: FINAL BUDGET HEARING
Nile Boyle opened the hearing for the Final Budget of the Fiscal year 1983-1984 in
the amount of $2,202,500. A motion was made by Morgan Garner and seconded
by Glen Pond to approve the final budget for the fiscal year 1983-1984. All Aye.
RE: ANNUAL APPROPRIATION ORDINANCE
Mary Smith read ordinance 657, the annual appropriation ordinance.
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG,
IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1983, TO SEPTEMBER 30, 1984, AND
APPROPRIATING TO SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY
GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL
OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND
CITY COUNCIL TO DEFRAY THE EXPENSE AND LIABILITIES OF SAID CITY FOR THE FISCAL
YEAR ENDING SEPTEMBER 30, 1984.
A motion was made by Councilman Sander Larson and seconded by Glen Pond that the
rules requiring an ordinance of a general and permanent nature to be read on three
occasions be dispensed with and that said ordinance be numbered 657.

Those Voting Nay: None
Ordinance 657 was then placed before the council. The President of the council
then called for the voting for final passage of the ordinance, and the motion
was made by Darlene Blackburn and seconded by Glen Pond that ordinance 657 be
passed.

Those Voting Nay: None
The roll showed all councilmen present voting "Aye" carried, .the President of
the Council declared that the majority of all the members of the City Council
had voted for the passage of said ordinance, and that said ordinance was duly
and regularly passed. Mayor Porter declared the motion carried.
RE: CLAIM FOR DAMAGES
Mary Smith, City Attorney, read a claim she received on August 31 from Kenneth
and Marjorie Waldren for damages when a Rexburg water line ruptured in their
back yard. The water line was under a block wall dividing their property
from their neighbors. The water from the rupture flooded their basement.
The total expenses for damages was $921. They feel that the damage occured
because of negligence of the City of Rexburg. Mary said she had checked it with
the Mayor and he said it isn't a city water line, it is just a private water
line. A motion was made by Morgan Garner and seconded by Darlene Blackburn
to deny the claim and turn it to the Insurance Company. All Aye.
RE: WATER RUN-OFF
Sander Larson said sometime back the water that runs off the fields on the hill
runs right down the hill down by the Farm Crops Building on Center Street and
it has a hole in the street and should be repaired. Rose was instructed to
have Farrell Davidson look at it.
RE: OBSTRUCTED VIEW
Darlene Blackburn said the view is obstructed over on 1st North and 1st East. The
cars parking along the street by Mamma Juliennes Pizza and the old sign that
Taylor Rental had, makes it very hard to see the on-coming traffic from the West.
Rose was insturcted to talk to the police about it to see if it could be
corrected.
RE: HEARING FOR RICKS COLLEGE CREDIT UNION
Nile Boyle opened the hearing on the Ricks College Credit Union on the
corner of Center and 2nd South, which was recessed at the last meeting. .Morgan
Garner and Glen Pond were at the meeting with Seth Wood, who was not in favor
of having the Credit Union there. Morgan Garner said he thought it should be
left residential, he said he thought we had enough commercial property. Morgan
Garner said Seth Wood did not want to change his mind. Morgan said that the thing
that bothered him was that the owners had a chance to sell the property for a
residential home and they wanted to hold out for a bigger price if it could
be changed to commercial property. Glen Pond said he got the same feeling.
A motion was made by Morgan Garner to deny request for a Special Use Permit for
the Ricks College Credit Union and keep it zoned R2. Seconded by Darlene
Blackburn. All Aye.
RE: RE-ZONING
Morgan Garner said he thought we need to stop re-zoning property somehow.
RE: BILLS
A motion was made by Sander Larson and seconded by Glen Pond to pay the bills.
All Aye.
RE: ADJOURNMENT
A motion was made by Sander Larson to adjourn. Seconded by Glen Pond. All Aye.

CONSENT FOR PARKING
CONSENT IS HEREBY GIVEN to Linda Eames, d/b/a LITTLE
ACADEMY to use five (5) parking spaces for employees at the 4th -
18th Ward parking lot during the hours of 7:00 A.M. through 6:00
P.M., Monday through Friday.
Spaces are to be designated by the 4th or 15th Ward
Bishopric.
Linda Eames to be liable for any damage or claims
resulting from the above-mentioned use.
